ZIP Code Date I Hanover Maryland 21076 07/14/2019 Phone Type I Pu - Date Cell 07/14/2019 Narrative On June 28, 2019 at approximately 1210 hours, I responded to 1365 Mellon Rd, Hanover MD 21076 (Denny's) for a report of a trespassing. The notes of the call indicated that the complainant, Mr. Hamid Mohebbi (Manager), advised that a black female seated inside the business was attempting to sell donuts. Upon arrival, I met with Mr. Mohebbi. Mr. Mohebbi advised that prior to notifying Police, he approached a black female about attempting to sell donuts to his customers. He stated that the female was going from table to table, asking the patrons to purchase donuts that she brought into the restaurant. Mr. Mohebbi continued that he advised the female to stop approaching customers and she was not allowed to sell donuts in the establishment. He stated that the female became argumentative with him and at that point, he asked her to leave. Mr. Mohebbi stated that since the female told him that she wouldn't leave, he noti?ed the Police. Mr. Mohebbi immediately walked away without providing further information. Cpl. Wolford #1739, Ofc. Henderson #2299, and I approached the female who was seated at a booth near the front exit of the restaurant. The female was later identi?ed as Ms. Marguerite Rosemary Morris Ms. Morris was in possession of a large amount of items, including books (such as LSAT study books), 1 ree boxes of Krispy Kreme donuts, clothing, and electronic devices. I asked Ms. Morris what the issue was. Ms. Morris advised that she believed Mr. Mohebbi was discriminating against her because he asked her to leave the restaurant without just cause. Ms. Morris continued that when she was approached by Mr. Mohebbi about selling donuts, she stopped approaching customers. She said that as a family was leaving the establishment, she gave a box of donuts to them (but did not sell them). She stated that she was selling the donuts for her church organization. Ms. Morris stated that Mr. Mohebbi approached her again and accused her of selling the donuts, which she was already told not to do. She said that Mr. Mohebbi told her to leave, but she felt that she didn't have to because she did nothing wrong, and the owner of the establishment did not tell her to leave. Ms. Morris stated that she was a lawyer and knew she had a right to remain in the restaurant. She also added that Ms. Mohebbi was racist and only wanted her to leave because she was black. Cpl. Wolford and I made contact with Mr. Mohebbi again and asked him to come over to Ms. Morris to explain to her what the issue was (per Ms. Morris' request). In the presence of Ms. Morris, I asked Mr. Mohebbi what the ultimate goal was with Ms. Morris. Mr. Mohebbi advised that he just wanted Ms. Morris to pay her tab and leave the restaurant. Ms. Morris immediately became argumentative and advised again that Mr. Mohebbi was falsely accusing her of selling donuts. She continued that the owner of the restaurant was familiar with her and that she would not leave unless the owner told her to. I advised Ms. Morris multiple times that Mr. Mohebbi had the legal authority as the agent of the owner, to ask her to leave the establishment. I advised Ms. Morris that if she had a problem with the restaurant, she could make a complaint from the outside of the establishment. Ms. Morris stated that she was not leaving the restaurant unless she was being taken out in handcuffs. For approximately twenty to thirty minutes, I exercised extended courtesy and tried to explain to Ms. Morris that she was handling the situation incorrectly. I told her that it would be silly for her to be arrested over willingly refusing to leave the restaUrant. advised Ms. Morris that I didn't want to arrest her. but if she did not leave the restaurant after being told to do so by Mr. Mohebbi, she would be placed under arrest. Ms. Morris advised me to arrest her multiple times. It is important to note that during a majority of our contact with her, she was not causing a disturbance but was drawing attention from other patrons due to our presence there. While speaking with Ms. Morris, Mr. Mohebbi returned to the table and advised that if Ms. Morris gave him the donuts, she did not have to leave. Ms. Morris agreed and turned the donuts over to him. At that point, no further police assistance was required. Mr. Mohebbi didn't ban Ms. Morris in our presence, or request us to ban her. Cpl. Wolford, Ofc. The notes of the call advised that there was a female on location causing a scene and that it was an ongoing issue. The manager was the caller and advised that he wanted her officially banned. He advised the call taker that she was inside the store, refusing to leave, and yelling. The female in question was identi?ed as Marguerite Rosemary Morris (DOB -. I arrived on scene with Cpl. Miller #1545 and Cpl. Wengert #1599. Upon arrival, I spoke with the manager and caller, Hamid Mohebbi (DOB -). He advised that Ms. Morris was on scene and had caused issues in the restaurant in the past. He began to tell me the history of his encounters with her. He advised me that on 06/28/19 she was on location trying to sell donuts to customers while they were eating. He advised that he told her to stop and she continued until he called police. He advised me that she left the location on that day after police were called. He advised that he told her on that day to not return to the location anymore. ReportOf?oer "We At 7 07/01/2020 13:59 [page 2 o; 5 19-726439 ANNE ARUNDEL COUNTY POLICE DEPARTMENT Narrative He advised me that just prior to him calling on 07/12119, Ms. Morris was eatin at the location and was being served by one of his employee's identi?ed as Sonya Howard (DOB I spoke with Sonya and she advised me that she was taking Ms. Morris's order and that she ordered her meal with extra tomatoes and croutons. Ms. Howard advised her that it is an upcharge to add extras to the meal. Ms. Howard advised that Ms. Morris began to get "confrontational" with her and was being "rude and loud" because of the extra charge. She advised that Ms. Morris called her racist for charging her for the extras. Ms. Howard advised that she returned with the salad and Ms. Morris said "I'm recording you". Ms. Howard advised that Ms. Morris was "causing a scene" in the restaurant over this issue. She advised that she notified Mr. Mohebbi of the problem and he advised me that this was the point he realized that Ms. Morris was in the restaurant. He advised that he asked her to pay and leave and she began to raise her voice and call him racist as well. He advised that she was causing a disturbance to the customers and staff and he called police to have her removed and officially banned from the location. He advised he wanted her to pay and leave the restaurant. I made contact with Ms. Morris and notified her that we were called due to a report of her causing a disturbance in the restaurant. She immediately interrupted and advised that she did nothing wrong and that Mr. Mohebbi was making a false report. I attempted to explain the reasoning for their request to have her leave the premises. She advised that all of their claims were false and that she was not leaving unless we arrest her. I again explained that due to her causing an apparent disturbance prior to our arrival and the previous incident involving donuts, the manager had the authority to ask her to leave the property and ban her from the location. I told her that if she does not leave she could be arrested for trespassing because she was notified to leave already and that it was private prepe . She was seated with a child that she advised was her sister's grandson. He was identi?ed as . We advised her that an arrest would cause an issue with looking after the an tried lo reason wit er to eave the restaurant. She continued interrupting us multiple times during our interaction and was making multiple phone calls during our interaction. We attempted to reason with her for approximately 20-30 minutes to explain to her that she needed to leave. She continued to state that we would have to arrest her for her to leave. She advised that she was still eating. I spoke with the manager again and he advised that even though she did not pay he just wanted her to leave and she did not have to pay. He insisted that if she remained on scene and police left, she would continue to be a disturbance to him, his staff, and the customers. Ms. Howard also nodded in agreement to this. After several more minutes, I advised Ms. Morris again that she would be arrested if she did not leave. She again advised that I would have to arrest her for her to leave. I advised her that she was under arrest at that time. She had a large amount of property with her in the booth. We gave her time to gather her items. She advised at that point that she wanted to pay her bill. I allowed her to approach the front counter and pay while we assisted her with removing her property from the restaurant. While she was paying, she took out her phone and was ?lming the staff on the other side of the counter. She was raising her voice with them and began causing another disturbance. I took possession of her phone and picked up one of her bags to help her out of the restaurant with her property. assisted her in placing her items in the trunk of her Nissan (MD -) that was parked out front. At that point, I was told to stand by for a supervisor to arrive and I did not take her into custody. Ms. Morris stood by with us in the parking lot. Sgt. McBee #608, Sgt. Betz #1392, and Lt. Gilmer #1319 arrived on scene. It was determined by supervision to provide Ms. Morris a written notice of her ban from the location and release her from the scene rather than moving fonNard with an arrest and charges. Mr. Mohebbi drafted a written notice and provided her with a copy. lwas given a copy to upload to thisreport. Mr. Mohebbi and Ms. Howard also completed Witness statements of the incident which were also uploaded to this report. Mr. Mohebbi left the scene shortly after completing his statement and after Ms. Morris was released from the scene. My information was provided to another staff member to give to him with the times requested for the video footage inside the Denny's along with the case number. Lt. Gilmer advised me that during a conversation he was having with Ms. Morris about an unrelated issue, she received a phone call from an unknown number which she put on speaker. Lt. Miller #1545, and Cpl. Wengert #1599 with a Disorderly Conduct call. Notes of the call indicated that a female (later identi?ed as Marguerite Morris), 50-60 YOA, was inside the restaurant causing a scene and refusing to leave. Lt. Gilmer #1310 and myself responded to the seene to assist the Of?cer's and supervise the incident. I arrived on scene and spoke with Ofc. Baldwin #2117 about the details of the incident (see original report) while Lt. Gilmer spoke with Marguerite Morris. Ofc. Baldwin advised me the manager on duty was requesting that Morris be banned from the restaurant. I advised Ofc. Baldwin that the manager would need to provide Morris with a written banning notice and he advised the manager. The manager then created a banning notice and a copy was provided to Morris by Of?cers on scene. I also advised Ofc. Baldwin to have the manager and waitress that had been serving Morris complete a written statement of the events. A determination was made that the incident had been successfully deescalated and physical arrest was not necessary at this time. Morris had agreed to leave the property and had paid for the food she ingested. Any further details on this incident will follow on a supplement report. The complainant was an employee, identified as Hamid and the notes of the call indicated that there was a female at the business causing a scene by yelling and refusing to leave. The female was described as black female, approximately 50?60 years old, wearing a black shirt. The complainant also advised that they wanted to have the female banned from the location. Upon arrival, Ofc. Baldwin #2117 and lwere met at the door to the restaurant by Hamid Mohebbi, who identi?ed himself as the complainant and also as the supervisor on duty. He explained that he has an cn-going problem with this female causing problems every time she comes in. He explained that the last time she came in she attempted to sell donuts inside the restaurant and when he told her she couldn't do that she accused him of being racist. He advised that on today's date there was a dispute because she was upset with being charged for the additional toppings she requested for her salad. He advised that she again accused him of being racist and started recording him and the other employees with her cell phone. He explained that there were other customers in the restaurant when this occurred and she was causing a disruption. Mohebbi stated that he wanted her to pay biil and'leave. He also stated that he wanted her banned from the location. We entered the restaurant and he identified which table she was sitting at. Ofc. Baldwin and I walked over to the table where we met with the female, 'te Mor is, who was sitting across from a young male, who she later identi?ed as her sister's grandsonm Ofc. Baldwin asked her to explain what had occurred. Morris immediately became defensive and stated a manager (Hamid) was racist (Morris is an African-American.) She stated that she didn't do anything wrong and that this was a false police report. She then called out to another table siting across the restaurant from her and asked them if she did anything wrong. It should be noted that there were several other tables in the restaurant occupied by African-American customers. Morris explained that she comes here all the time and never has any problems unless that manager is working. She advised that she was in there last night until midnight. She explained that today she ordered a salad and when it came it didn't have croutons or cherry tomatoes on it. She complained to the waitress about this who then brought the additional toppings but informed her that there would be an additional charge for them. Morris advised she's never been charged for them before and that this was done intentionally by the manager because he's racist. Morris admitted that when the waitress came to the table she attempted to record her with her cell phone and also did the same thing when Mohebbi brought the check. Ofc. Baldwin explained to Morris that the manager had requested that she pay her bill and leave the business. She stated that the only way she would leave was if she was arrested. We advised her that wasn't necessary and that we were just politely asking her to leave. We explained that if she refused to leave it would be considered trespassing. She stated "well then arrest me!" I asked her the age of the young boy with her and she stated he was ten years old. asked her if she had someone to come get him if she ended up getting arrested. She said she didn't know. i then explained to her that if she was arrested and that we would have to contact Child Protective Services to come take custody of him. Morris refused to be reasonable about the situation and continued to state that she hadn't done anything wrong and was being targeted because of her race. She then took her cell phone and advised she was calling the head of the NAACP. She made a phone call and began to explain to someone her version of what occurred. She told that person that she wasn't going to leave the restaurant and was going to force us to arrest her. She stated she needed to stand up to the manager for making a false police report. After she ended that conversation, I tried to explain to her that getting arrested wouldn't solve the issue at hand and would only make matters worse. I explained to her that she needed to contact someone above the on-duty manager and also needed to contact Denny's corporate of?ce. Morris then stated that Denny's has a history of racial profiling. She then made another phone call to someone who she identified as ajudge. Cpl. Wengert #1599 had arrived on scene around this time. HE came over to the table and sat down next to Morris to attempt to speak to her. She immediately said "you ain't going to talk me out of this!" He explained that he had just arrived and asked her to explain what was going on. She then continued her phone call with the "judge". Cpl. Wengert asked if he could speak to the person on the phone when Morris was done and she handed over the phone to him. While Cpl. Wengert attempted to speak to the person on the phone, Morris continued to try to interrupt and talk over him. Ofc. Baldwin went back to speak to Mohebbi who again stated that he wanted Morris removed from the business and banned not to return. He stated she didn't even have to pay her bill, he just wanted her gone. Ofc. Baldwin and I again politely asked her if she would leave. She continued to refuse to leave and stated the only way she would leave is if she was arrested. He then advised her she was under arrest. It should be noted this was after tried to patiently reason with her for approximately 50 minutes. Cpl. Morris had several large bags full of items with her along with a laptop and books. We asked her if she had a car outside and she said yes. We explained that it would be best for her to secure her property inside her vehicle instead of taking all of it to the station. She stated "so you're arresting me?" Ofc. Baldwin said yes. She replied "because I'm only walking out of here if you're arresting me." We allowed her to walk out of the business without handcuffs to further avoid causing a large disturbance. As we were walking out we had to walk past Mohebbi who was standing near the front door. Morris stopped and attempted to instigate an argument with Mohebbi and then tried to take her phone out to take pictures of him. We advised her that she was under arrest and to keep moving. She continued to try to use her phone so Ofc. Baldwin told her she wasn't allowed to use her phone while in custody and'took it from her. We then proceeded outside the restaurant with her where she was allowed to place her items in the trunk of her vehicle. As we were walking to our vehicles to prepare to place Morris into handcuffs and into the vehicle, Cpl. Wengert advised that he received a phone call from a supervisor who was inquiring as to the details of the incident. Ofc. Baldwin then received a phone call from his supervisor, Sgt. Betz #1392 who advised he was in route to the location. While waiting for Sgt. Betz to arrive, Morris stated that if we didn't arrest her she was going to go right back inside the restaurant. Sgt. Betz, Sgt. McBee #608 and Lt. Gilmer #1319 all responded to the scene. Lt. Gilmer spoke with Morris and made the decision that she wasn't going to be arrested for the incident. I then began contacting my officers to check their status since we were approaching shift change. Upon speaking with Corporal Wengert, was advised that they were assisting W5C1 (Of?cer Baldwin) with a disorderly female identi?ed as Marquerite Morris at the Denny's located 1365 Mellon Road. Corporal Wengert further advised that if Marquerite Morris did not leave Denny's as directed Of?cer Baldwin 2217 would be placing her under arrest for trespassing. I advised them to stand by until a supervisor arrived. I noti?ed Lieutenant Grover of the status and he informed me a Lieutenant would be responding. Since two of my officers were still at the Denny's, I responded to assist. Upon my arrival I observed Lieutenant Gilmer approaching a female just outside the entrance to Denny's. Corporal Miller informed me that the female was Marquerite Morris. exited my patrol vehicle and walked over to Lieutenant Gilmer and Ms. Morris. As I stood there heard Morris explain that she thought the manager of Denny's had ?led a false report to police that forced our response. Morris went onto to say the issue revolves around her bill where she was charged for "croutons and tomatoes? on her salad. She went onto say that she felt the manager was charging her because she was "Black". Morris stated that she had purchased the same salad previously and had not been billed for these condiments but was today. Morris could not understand why she was asked to leave, and did not understand being banned when she never received any documentation advising her of that fact. I inquired if she would like a document stating she was banned, and she replied "yes". I then spoke with the manager of Denny's, Hamid Mohebbi and informed him of her request. Mohebbi advised that it would take a few minutes but he would supply one. After a few minutes, Mohebbi appeared at the door with the banning documents, to avoid any verbal confrontation between the two; I received the banning letter from Mohebbi and explained it to Morris as I handed it to her. When I arrived in the restaurant, I observed Cpl. Miller #1545, and Officer Baldwin #2217 talking to an African American woman who was seated with a young child. I stood by as they spoke to her for several minutes. lwas approached by thestore manager, Hamid Mahebbi who advised the woman, who was later identi?ed as Marguerite Morris was in the restaurant approximately two weeks prior trying to sell Crispy Cream donuts to Denny's customers. Mr. Mahebbi advised he told her not to return to that Denny's at that time. On today's date, Ms. Morris ordered a salad, when the salad was delivered it did not have croutons or tomatoes. When she inquired about these items she was informed that these items would be an additional charge. Ms. Morris then became loud and argumentative with the manager and waitress and called them racist because she was going to be charge croutons and tomatoes. i turned my attention back to Ms. Morris and the officers and heard her refuse to leave the store because she did nothing wrong. At that time, i asked her if she could explain her side to me. She said I was not going to change her mind and hat she was not leaving. I sat down in a chair next to her as she began explaining her side. Ms. Morris Said when she ordered her fried chicken salad as she normally does; the waitress returned with a grilled chicken salad with no tomatoes or croutons. Ms. Morris said she pointed out that she ordered fried chicken and not grilled. She then asked about the tomatoes and croutons because they have come with the salad in the past. The waitress advised Ms. Morris, it depends on' who makes the'salad, and if they put them on or not. At some point, Ms. Morris decided to record the waitress telling her she had to pay extra for the tomatoes and croutons. Ms. Morris advised the Manager, Mr. Mahebbi came over and asked her to leave. When she refused to leave, she said he called and made a false police report. While I was speaking with Ms. Morris, she called a woman she advised was Judge Jones. I spoke with her and informed her of the situation so she could talk to Ms. Morris. Ms. Morris continued to state she was not leaving unless she was arrested. After listening to her side, I observed an African American couple sitting two tables across from Ms. Morris, who were watching our interaction. I asked them if they saw or heard anything disruptive before our arrival. They said they observed the interaction between Ms. Morris, the waitress, and the manager, but the conversation was not loud enough for them to hear what they were saying I was not able to get their information before they exited the restaurant. Betz of an incident that was occurring at the Denny's restaurant located at 1365 Mellon Rd in Hanover. Details of the incident was that officers were currently on the scene with a disorderly subject who was refusing to leave the restaurant. Betz requested me to respond with him to the scene to assist in supervising the incident. When I arrived I took note that Officer Miller was standing next to a black female who I recognized as Ms. Marguerite Morris. I spoke with Ms. Morris and ask her about the incident. I learned that she was previously in the restaurant studying for an upcoming college exam. During that time she had a dispute with the manager of the business over her food order (See original report and supplements under this case number) The dispute led to the manager of the restaurant calling the police. When of?cers arrived they attempted to mediate the situation. Based on information received from the of?cers they attempted this with the involved parties for over 45 minutes. The incident eventually led to the store manager asking officers to escort Ms. Morris out of the business. Of?cers continued to attempt to deescalate the incident but eventually Ms. Morris insisted on being arrested. On scene officers reported that they advised Morris that she was under arrest at which time she requested time to pay her food bill. After paying for her bill of?cers escorted Morris out of the dining room area. During this time Morris reportedly began to talk loud in the restaurant and took out her cell phone and began filming. On scene officers assisted Morris by carrying the bags that she had with her and taking possession of her phone. Once outside officers remained with Morris until the arrival of Sgt. Betz, Sgt. McBee, and myself. I was told by of?cers that at no time did they have to place their hands on Ms. Morris nor was she ever placed in handcuffs. Once there Sgt. McBee and I attempted to deescalate the incident by speaking with Ms. Morris and advising her of her options to contact Denny's corporate management. Eventually we were able to persuaded Ms. Morris to leave the property. Her cell phone was returned to her. A banning noticed was prepared by the manager of Denny's which forbade Ms. Morris from returning to the property. Ms. Morris was served the letter and she reported that she would not return. It is important to note that although Ms. Morris was initially placed under arrest by officers, the of?cers reported that at no time did they touch her or place her into handcuffs. Morris stated she received a phone call from a private number that she believed to be Mohebbi taunting her on her phone.
