Upon arrival I observed 30-40 persons walking west across Hwy 12, to their parked cars and leaving the area. I spoke with Candy Gutierrez who advised she observed an older white male, driving a red Ford truck, north on Allan Rd, stop in front of the protesters. The male then yelled at them that he was going to get his 50 caliber gun and come back and shoot them. Candy stated the protesters all began to yell at the male and over power his voice. The male then drove away from the scene, North on Allan Rd. Candy was able to record part of the incident on her cell phone, however it was after the male made the statement. The video recording is clear enough I could readily identify the male driver as Stacey Sedge. Candy submitted a written statement and e-mailed the video recording to me, which were subsequently burned to CD. After the male left the area, all of the protesters, left the area as they were fearful for their safety and believed the male was going to return to the area and follow through on his statement. I then spoke with Agustine Lopez, who stated he was on the east side of Allan Rd. during the incident. Agustine stated he did not hear the statement, but realized there was something wrong based upon the protester reaction when the male stopped his vehicle. Agustine was able to read and write the vehicle's license plate. The registration, WA. C74843J, returned to a 2013 red Ford F250 pickup, which matches the vehicle in the video recording. The registration also returned as Stacey Sedge as the registered owner. Shortly later Stacey arrived at the scene driving a utility side by side ATV. Upon arrival I introduced myself as a Deputy with the Yakima County Sheriff's Office and then read Stacey his Miranda rights from my agency Miranda card. Stacey admitted to driving through the area and stated "I probably said I was going to get a 50 caliber gun and come back and shoot you." Stacey then stated he did not own any guns and he was not going to follow through with his statement. Stacey was subsequently arrested and booked for violation of RCW 9A.46.020(2)(b)(ii) Harassment C Felony and RCW 9.36.080(7) Hate Crime/Malicious Harassment. Later in the morning I returned to the scene and spoke with Angelina Lara, who advised she was not a witness earlier, but she spoke English and would assist with speaking with other witnesses. I contacted, Rosa M. Pena, Berta Meza, Teresa Valladares, who stated they observed and heard Stacey Sedge stop his vehicle, and tell them he was going to get his gun and return and shoot them. Rosa advised some of the other victims who were on scene earlier might return to the protest later in the afternoon. I requested Rosa to record the names and information of the persons who were witnesses and I would add them as victims. If any other victims or witness are located I will complete a supplemental report. The suspect in the case, Stacey Sedge, had reportedly driven by protesters at this location in his red Ford Truck (WA / C74843J) and threatened to return and shoot them. A witnesses at the location had obtained a license plate from the vehicle which returned to Stacey. Further, I was informed Stacey had a history of threatening individuals and was a convicted felon. Upon arrival, I made contact with Deputy Watkins who was contacting witnesses on the west side of Allan Road. Deputy Watkins informed me Stacey had stopped his vehicle in front of the protestors and shouted at them that he was going to go and retrieve his 50 caliber rifle and return and shoot them all. Several protestors fled the area after Stacey made this statement. Deputy Watkins told me there was approximately 50 protestors in the area when he first arrived but most had left the area. Approximately 4 protestors remained. Deputy Watkins was receiving statements from 2 of the witnesses still on scene. Deputy Watkins was familiar with the suspect, Stacey, and had positively identified him from a photo one of the witnesses took of him. I viewed the photo and observed an older white male inside a red Ford Truck. While in the area continuing to investigate the incident, Deputy Swale observed a subject north of us on Allan Road sitting in a side by side ATV. Deputy Swale was also familiar with Stacey and stated this subject matched Stacey's description. A short time later, the subject in the side by side, identified as Stacey, drove to our location and parked next to my patrol vehicle. I approached Stacey and he asked me what we all were doing down here. I told Stacey we were investigating a threats incident and advised him he was being detained. Deputy Watkins walked across the street to my location and began to read Stacey his Miranda Rights. I walked across the street where two of the witnesses were standing. Candy Gutierrez and Augustine Lopez told me Stacey was the subject who had threatened everyone. I asked them both how sure they were that Stacey was the suspect and both stated "100 %". Deputy Watkins placed Stacey under arrest and handcuffed him. I drove Stacy's side by side back to his residence and left it secured there. When Deputy Swale and I arrived at Stacey's residence, we found his front door standing open. I verbally identified us as Law Enforcement but never received a response from inside the residence. Deputy Swale and I entered and cleared the residence finding no one inside. Report: Law Enforcement Position on Release: yso CASE 20c07659 SUPERIOR COURT PROBABLE CAUSE Page 2 of 4 cho 1%3?d%8 WATKINS C72 Rel'd to: Albert Samaha vso CASE 20:07659 NARRATIVE In the State ofWashington, County of Yakima, on May 14, 2020 at 101 Bonlow Dr., Naches, WA., Stacey Sedge violated RCW 9A.46.020 Harassment - Felony and RCW 9A.36.080 (7) Hate Crime Offense/Malicious Harassment. On May 14,2020, Dep. Watkins responded to a' report ofa Threats at 101 Bonlow Dr., Naches. As Dep. Watkins arrived on scene he observed approximately 30?40 subjects walking west across Hwy 12 to their parked vehicles and leaving the area. Dep. Watkins had driving through the area approximately 45 minutes earlier and observed approximately the same amount of persons protesting in front of Allan Bros. fruit warehouse. After speaking with the witnesses who remained on scene, Dep. Watkins was told all of the subjects believed the male was going to follow through on his statement and wanted to leave for their safety. Dep. Watkins spoke with Candy Gutierrez who stated the persons were protesting Allan Bros. Fruit and standing on the west side of Allan Road, when a white older male drove north on Allan Rd., stopped in front of them and yelled am going to get my 50 caliber gun and come back and shoot you all." Candy was able to record a video on her cell phone showing the driver of the vehicle, however the recording was made after the statement. The male driver is readily identifiable as being Stacey Sedge. Dep. Watkins then spoke with Agustine Lopez, who advised he was on the east side of Allan Rd., when the male made the statement. Agustine did not hear the statement, but determined there was a problem, based upon the reaction of the protesters. As the male drove away he was able to read and record the vehicle license plate. The vehicle?s registration matched the vehicles description and returned to a Stacey Sedge on 90 Naches Wenas Rd. Shortly later Stacey arrived on scene driving a utility side by side ATV. Dep. Watkins immediately recognized Stacey, approached him and identified himselfas a Deputy with the Yakima Co. Sheriff Office. Dep. Watkins read Stacey his Miranda rights from his Miranda card. Post Miranda Stacy admitted to driving through the area in his vehicle and made the statement probably said I was going to get a 50 caliber gun and come back and shoot you." Stacey then stated he did not have any guns and did not mean it. While transporting Stacey to the jail, he made the statement about how Allan Bros. treats those people very well and they should not be protesting. When Dep. Watkins asked what he meant about those people, Stacey stated the Mexicans. Dep. Watkins placed Stacey under arrest, transported Stacey to Yakima Co. Jail, where he was subsequently booked for the violation. YSO CASE SUPERIOR COURT PROBABLE CAUSE Page 3 of4 YCSO WATKINS C72 Rel'd to: Albert Samaha It should be noted on October 18, 2020 Stacey was found guilty of RCW 9A.36.080 (7) Hate Crime Offense Malicious Harassment for an arrest where he fired gun shots at three Hispanic males, who confronted Stacey about driving his ATV on the county road and not following the traffic laws. Dep. Watkins is currently working on locating and identifying other witness/victims for this incident. Once located they will be added to the incident.
