Palmer 1115) have been a sworn member of the Colorado Springs Police Department for 27 years and my current full time assignment is with the CSPD Homeless Outreach Team aka the HOT Team. On this date my supervisor, Sgt. O. Chaney 142 reached out to me and other team members via text message to respond to work to support the department with ongoing protests near the Police Operations Center (POC). This was in response the previous evening in which protesters caused disturbances, failed to obey police commands and property was damaged. My instructions were to respond to my station, Gold Hill and receive further instructions in a briefing by 1400 hours. At that briefing I was assigned to a processing team headed by GH Detective Sgt. J. Otero 1764 and my role in this function was to assist arresting officers with the processing and or booking paperwork of arrestees. I was accompanied by Detective M. Happ 1102, Senior Marshall J. Hopkins 784, and later in the shift Officer J. Parisi 1618. We processed one arrest at Gold Hill before it was determined that it would be more effective to conduct the processing at CJC. Most arrestees arrived via transport van and we were told of their names, charges and the arresting officer’s name. Most of these subjects were booked on the misdemeanor charge of 18-8-104 Obstructing a Peace Officer with the exception of a subject who was charged with 18-4-501 Criminal Mischief for spraying a restaurant with graffiti. The purpose of this case report is to have a master number for all misdemeanor county charges and to have a number for arresting officers to complete supplements documenting their actions which led to the arrests we processed. In addition to these forthcoming supplements, Detective Happ took several digital photos of each person processed and he subsequently placed them into the CSPD DIMS System for permanent storage. Officer Statement During this demonstration there were periods where the assembly was peaceful and lawful and the crowd was allowed to continue their protest as there were few or minor violations of the law. As the day progressed and into the night there were periods where portions of the crowd became unruly and advanced on the POC despite orders to remain back. During these periods officers were attacked with rocks, bottles and fireworks all while trying to keep the peace and protect assets around the city. It was during these periods that lawful orders were given loud and clear utilizing a PA system that the assembly was no longer lawful and subjects needed to vacate. All of the arrestees that I processed had failed to abide by these lawful orders and they were subsequently arrested after failing to comply. The forthcoming supplements should document the specific orders given, how many times they were given and other measures utilized such as chemical agents and a noise device known as the LRAD. (Long Range Acoustic Device.) One subject brought to CJC was observed by offices defacing private property at the China Town Restaurant located at 326 S Nevada Av. One of the last subjecls arrested was a Juslin Eric Salmons- charged with Obslrucling a Peace Officer on summons #3122660. Daly 1858, was working in the downtown area on a 4-officer response team. I was assigned with Officers R. Williamson 301, J. Winn 3530 and P. Hubbard 6171. Officers were given clear directives to let any protesters who are leaving the area be allowed to leave. If protesters were not leaving, or causing a disturbance, they were to be arrested. OFFICER STATEMENT: I was wearing a standard issue CSPD uniform with the addition of a ballistic helmet, gas mask and an OC fogger. At approximately 0030 hrs on 6/1/2020, I was in the area of Costilla St and S. Nevada Ave. I observed a male walking westbound through a parking lot towards the intersection that was clearly announced to be evacuated. I approached this male and gave clear orders to leave the area. He began leaving the area but was stating that he was trying to get to his girlfriend. Officer Hubbard approached this male and was trying to help him get to a vehicle so he could leave. As Officer Hubbard was assisting this male he was approached by another male, later identified as Justin Salmons DOB . Salmons approached Officer Hubbard and tried to start a confrontation. Salmons was physically confrontational with Officer Hubbard. All officers were wearing gas masks so loud commands and hand gestures were important to relay directions. Officer Hubbard was pointing to Salmons to leave the area as Salmons smacked Officer Hubbard’s hands. Officer Hubbard was able to deescalate Salmons and Salmons walked away westbound towards the intersection of Costilla St and S. Nevada Ave. Salmons walked into the middle of the intersection. I was speaking to other officers in the area informing them that there were still rocks being thrown at us when I observed Salmons. I began to walk towards the intersection as I head loud verbal commands being given over a loudspeaker directed at Salmons. The commands were being given from a tactical vehicle which was on S. Nevada Ave to the south of the intersection of Costilla St. Salmons was yelling at the officers when he was told over the public address system “As long as you move, we are not going to bother you.” Salmons yelled back “Fuck you.” Salmons then walked northwest in the intersection directly in front of a vehicle trying to drive eastbound on Costilla St. He appeared to be agitated, he was walking briskly waving his arms. He was not walking in a direct line to leave the area. He was directed by the public address system to “Please get out of the intersection.” Salmons turned around and began walking towards the tactical vehicle giving commands, pointing and stating, “You ’re the fucking problem.” A response was given over the Daly, Mark 1858 Wisler, Scott CSPD Case Supplement 2020-00019311 Page 2 OF 4 2020-00019311 public address “Sir, get on the ground.” I heard pepper balls being deployed at Salmons and observed him being struck by at least 1 pepper ball. Salmons was hit in the lower back and bent over at the waist and crouched down on his left side. When he got to the ground, he rolled over onto his buttocks puts his hands under himself and begins to try and get up onto his feet. I was several steps behind a tactical enforcement officer who had deployed the pepper balls. That officer ran towards Salmons as did several other officers and I. Salmons was placed back on the ground and rolled over on his stomach by other officers as I was approaching. My ballistic helmet came off as I was running because the chin strap will not attach when I have a gas mask on. I picked up my helmet and put it back on my head. I moved into position on the right side of Salmons mid torso so I could assist the other 4 officers who were struggling to gain control of Salmons. I heard commands being given to Salmons to give me your hands and to stop resisting. Salmons was trying to get his arms under his body while officers were trying to gain control of his hands and arms. When I saw an opening, I pushed one of the officers, later to be identified as Sgt. K. Wrede 1876, out of the way so I could get into a handcuffing position. Sgt Wrede was on Salmons left side attempting to gain control of his left arm. There was a tactical enforcement officer attempting to gain control of Salmons right arm and 2 officers on Salmons lower body and legs. I placed both of my knees on the ground and went to grab Salmons right hand which was behind his back. When I grabbed his hand, he closed his hand around my left hand. I performed 2-3 fist strike with my right hand to his hand which made him open his hand and lose his grip on mine. I produced a set of flex cuffs from my pocket and attempted to slide them up over Salmons wrists. When I did this Salmons grabbed the flex cuffs in his hands preventing me from placing them on him. I performed 3-4 fist strikes with my right hand to his hands which made him open his hands and lose his grip on the flex cuffs. Salmons was able to free his left hand while I was holding on to his right hand and get it under himself. Sgt Wrede was trying to regain control of Salmons left hand as I was trying to maintain control of his right. I was struggling to secure the flex cuffs. The cuffs would not tighten. When I tried to grab the tab on top of the cuffs to pull them tight, they would not move. I was trying to tighten them and control Salmons hands at the same time. While I was doing so Salmons continued to try and grab my fingers so I asked an officer that was on Salmons legs to help me and see if he could get the flex cuffs to tighten into position. This officer was not able to secure the flex cuffs either. Sgt Wrede handed us a set of standard issue handcuffs and we were able to secure Salmons hands. Salmons was stating that he could not breathe. Sgt Wrede told him that he would be positioned better shortly. I called out to officers to get him on his side. We rolled Salmons to his side and sat him up. Sgt Wrede and I assisted Salmons to his feet and began walking him to the southwest looking for a vehicle to place him in. Salmons asked aren’t you going to search me? He stated to officers that he had a knife. Sgt. Wrede removed Salmons from the car, and we began to search him. I searched his left side and Sgt Wrede searched his right. I observed a leather sheath on Salmons right hip area. Salmons was placed back into the car. Sgt Wrede held up a large (4-5 inch) fixed blade knife that he recovered from Salmons’ person and informed officers that Salmons had been reaching for this knife. Salmons was transported to the criminal justice center where he was booked into jail. I then approached that male whom was carrying a skateboard and tried to help him get to a vehicle so he could leave. While I was assisting this male I was approached by another male, later identified as Justin Salmons DOB . Mr. Salmons approached me and tried to start a confrontation. Mr. Salmons was physically confrontational with me attempting to push me and also stating I was antagonizing the male with the skateboard. All officers were wearing gas masks so loud commands and hand gestures were important to relay directions. I explained to Mr. Salmons that I was aiding the gentleman with the skateboard not antagonizing him. I then began to point North West and gave Mr. Salmons directives to leave the area. It was at that time that Mr. Salmons smacked my hand I was using to point. I was able to deescalate Mr. Salmons and Mr. Salmons walked away westbound towards the intersection of Costilla St and S. Nevada Ave. After dealing with the situation mentioned above I remained on the South East corner of Costilla and Nevada Ave. While there I observed Mr. Salmons stop in the middle of the intersection and disregard several commands given by Colorado Springs Police Department Tactical Enforcement Unit (TEU) vehicle loud speaker to safely exit the intersection; and stop blocking traffic attempting to leave the area. Mr. Salmons was then hit with non lethal weapons. I then observed him resist Officers attempts to take him into custody for obstruction. After a brief struggle he was taken into custody and removed from the intersection. This concludes my involvement with any incidents on this day. End of supplement. Nevada Ave. While staging at the POC I was contacted by Teller County Sheriff's Office Deputy N. Pieper. Deputy Pieper informed me that he had camera footage of the suspect, Justin Salmons DOB: pushing CSPD patrol officers on the southeast corner of E. Costilla St. and S. Nevada Ave. just prior to my contact with him. He advised me that he would attempt to get me the video footage electronically. 6/8/2020 Approximately 1410 hours I contacted Deputy Pieper via text and we arranged to meet at the POC at 1515 hours in order to download the footage of the suspect pushing patrol officers. Approximately 1525 hours Detective B. Rogers/2641 of the Technical Investigations Unit downloaded the video from Deputy Pieper's phone. Christopher 3339 APPROVING SUPERVISOR IBM Bauer, Tray ESFD Die m- I an 2020-00019301 Initiating information: 6/1/2020 Approximately 0031 hours I, Officer Laabs/3339, a member of the Colorado Springs Police Department's Tactical Enforcement Unit (TEU) was assigned with other TEU officers as part of a detail in response to violent demonstrators in the area of the Police Operations Center, 705 S. Nevada Ave. Part of our responsibilities was to support the Public Order Response Team (PORT) as they moved north along Nevada Ave. PORT was pushing non-compliant protestors out of the area as arrest teams made up of other officers took into custody people who continued to defy the repeated lawful orders to disperse. I would note that during this incident, multiple rocks, bottles and fireworks had been thrown at officers prior to PORT or TEU taking action. Officer statement: As the arrest teams and PORT moved north along N. Nevada Ave., I rode on the driver's side rails of the Teller County Bearcat (which had been sent to support CSPD). As we moved slowly north, my supervisor, Sgt. Bauer/1479 continued telling people to leave the area using a loud speaker system. Sgt. Bauer was stationed in the CSPD Bearcat. The Bearcats were parallel in the northbound lanes of N. Nevada Ave. as we approached the intersection with E. Costilla St. At the intersection, we stopped and I was able to see various arrest teams as they contacted citizens in the area. I looked to the east and saw two officers in contact with two citizens on the southeast corner of N. Nevada Ave. and E. Costilla St. I could not hear them over the engine noise of the Bearcat, but it was apparent by their hand gestures the officers were telling the citizens to leave the area. One citizen complied and walked away eastbound on E. Costilla St. The other male citizen appeared to be arguing with officers and at one point I observed him physically push away from the two officers and start walking towards N. Nevada Ave. This male was later identified as the suspect, Justin Salmons DOB: I slowly walked to the southeast corner of the intersection in order to block the male suspect if he attempted to move south along N. Nevada Ave. The suspect noticed me and began cursing at me as he walked northwest into the intersection. The suspect glared at me and I instructed him to go home and to have a good night. The suspect replied "Go fuck yourself" as he intentionally walked into the center of the intersection of E. Costilla St. and N. Nevada Ave. I instructed the suspect to keep walking and he flipped me off and said "fuck you". At this time the suspect was complying with orders to leave the area and I did not follow him. I few seconds later, Sgt. Bauer addressed a different person via the loudspeaker and the suspect stopped in the Laabs, Christopher 3339 Bauer, Troy CSPD Case Supplement 2020-00019301 Page 2 OF 4 2020-00019301 middle of the intersection and made rude gestures towards officers involving his crotch and hands while yelling "fuck you". Because of his location in the intersection, traffic had to stop and could not safely get through. The suspect then slowly walked towards the northwest corner and Sgt Bauer addressed him saying something to the effect of: please clear the intersection so we can get this traffic out of here. The suspect then spun around and marched purposefully back into the center of the intersection and started cursing at Sgt. Bauer. This caused traffic to again be blocked. Sgt. Bauer made the announcement "Sir, get on the ground" to which the suspect did not comply. K9 Officer Comstock/4631 engaged the suspect with a less lethal pepperball launcher. The suspect fell to the ground after being struck, but immediately started to get back up again, yelling "What the fuck". As the suspect started to get back up, I ran to him and pushed him back onto the ground as other officers moved in to take him into custody. The suspect immediately resisted, attempting to pull his hand away from my control. I held on to his right wrist and tried to control it as other officers began trying to get his left hand behind his back in order to handcuff him. The suspect continually tried to get control of his arms and tried to stand up while officers were giving him clear instructions to stop resisting. During this the suspect called me a "Fucking cunt" and a "Motherfucking pig", among other curses. The suspect continued to resist and another officer delivered strikes in order to get the suspect to put his left hand behind his back. The suspect said "Stop fucking hitting me. Why are you hitting me?" all the while actively resisting officer control. Another officer ordered the suspect to "Give me your hand" to which the suspect replied "Fuck you." The officer then said "Put it behind your back and stop resisting." Officers were able to get the suspects left hand behind him, however he continued to try to break free and was attempting to grab onto officers. At this point I was still controlling the suspect's right hand. As he fought with officers the suspect said "You're a fucking garbage motherfucking piece of shit." The suspect still refused to comply with orders and was actively trying to get his arm away from my control. The suspect yelled that we were trying to kill him and "Let go of my foot." I specifically told the suspect to "Relax and stop fighting". He continued to resist. I gave him additional orders to stop resisting and he replied "I'm not" despite his actions. He then started to insult the officers who were trying to handcuff him as they placed the cuff on his left hand. I was able to get his right arm behind him and as he was finally being placed into handcuffs, the suspect said he could not breathe. He said this three times as he still resisted the handcuffing. He was finally placed in handcuffs and helped to his feet. Approximately 8 seconds elapsed from when the suspect said he couldn't breathe and when he was on his feet. As soon as he was on his feet he remained non-compliant and said "Hey, fuck you too" and tried to shove an officer with his shoulder as he was being led to a police car. I was dressed in full police uniform and was riding passenger in an unmarked police vehicle with SIU Detectives R. Thymian|004313, W. Woodworth|2851, A. Rutter|4922, and Sgt. K. Wrede|1876. On this date, I, along with other detectives with SIU were assigned to a protest detail in downtown Colorado Springs. On 06/01/2020, at approximately 0018 hours, I, along with the aforementioned detectives, were in the 100 block of E. Rio Grande St. when an order was given to surge the crowd and disperse them away from the area in front of the CSPD Police Operations Center (POC), located at 705 S. Nevada Ave. At this time SIU took part in the surge with other members of CSPD to push the crowd northbound on S. Nevada Ave away from the POC. It should be noted that we were utilizing our police vehicle with lights and sirens activated for an added effect to push the crowd northbound and for protection from incoming projectiles. At approximately 0032 hours, SIU and other officers were met by resistance by individuals failing to leave the area at the intersection of S. Nevada Ave. and E. Costilla St. At this time, I observed a male, later identified as JUSTIN SALMONS (DOB: , walk towards the police vehicles in the roadway and begin yelling and challenging officers in the middle of the intersection. At this this time, I, along with other members of SIU exited in the vehicle to effect an arrest of Mr. Salmons. As I was approaching Mr. Salmons's location, I heard and observed less lethal munitions being fired at Mr. Salmons from the CSPD Tactical Enforcement Unit (TEU). I observed Mr. Salmons fall to the ground after being struck with less lethal munitions and then he appeared to attempt to stand back up. At that time I observed a member of TEU as well as other CSPD personnel physically engage Mr. Salmons in an attempt to take him into custody. I saw that Mr. Salmons's legs were not secure and observed him kicking and flailing his legs despite multiple verbal commands to stop resisting and place his hands behind his back. It should be noted the contact with Mr. Salmons took place in the middle of the intersection and the intersection was not secure and there were several vehicles around as well as other protestors and pedestrians. I remained standing and provided security to the Officers on the ground engaged with Mr. Salmons. Once Officers had Mr. Salmons in custody and secured with handcuffs I walked with the group escorting Mr. Salmons to a CSPD Police vehicle where he was placed in the rear of the vehicle. I heard Officers speaking about a knife that was recovered from Mr. Salmons's person. After Mr. Salmons was secured in a CSPD Police vehicle I returned to providing scene security and dispersing the remaining crowd. Nothing further from this Detective at this time. Ray, John 4173 Wrede, Keith CSPD Case Supplement 2020-00019301 Page 2 OF 2 2020-00019301 BWC Available Initiating Information On Sunday 05/31/2020 at approximately 1532 hours, I, Detective A. Rutter | 4922, while assigned to the Colorado Springs Police Department (CSPD) Strategic Investigations Unit (SIU), was working in the Downtown Area (DTA) of the City of Colorado Springs, County of El Paso, and State of Colorado, where protest demonstrations were taking place. While working, I was in a full CSPD patrol uniform which made it possible for easy identification as a police officer. Detective Statement I was assigned to be a response team along with the other members of SIU. Our mission was to respond to violent and aggressive persons who were disrupting the message of peace that was being presented by the majority of the protestors. While working as a response team, we, along with all the other response teams and members of the CSPD were targeted by violent rioters who threw missiles including rocks, frozen water bottles, glass bottles, batteries, fireworks, and eggs. Those who threw these items would cower away and back into the ranks of the peaceful gatherers to avoid being recognized and apprehended. At approximately 0018 hours on 06/01/2020, after several commands given by CSPD through a loud speaker to all members, peaceful and violent, in the crowd to disperse, the CSPD crowd control team, using shield to help protect themselves from the missiles being thrown, along with several marked and unmarked CSPD vehicles with lights flashing and sirens blaring, began ushering the crowd away from their gathering point of the Police Operations Center (POC) located at 705 S. Nevada Ave. Commands were continued through the loud speaker, informing the crowd that due to the violence, the assembly had become unlawful and it was time to disperse. Warnings were given that, due to the violence and aggression shown by the rioters, the safety of anyone involved could not be guaranteed. At approximately 0032 hours, fourteen minutes after the orders to disperse began, we approached the intersection of S. Nevada Ave. and E. Costilla St. I observed a male, who was later identified as Justin Salmons DOB , standing in the intersection, yelling obscenities, and screaming about violence towards police. Due to his behavior, other demonstrators began to gather around Justin and a small crowd was forming. Orders to disperse continued, Justin refused to follow the orders and began walking towards police officers. Because of his refusal to follow orders, and to protect the community from his aggressive, erratic, unpredictable behavior, it was necessary to take Justin Salmons into custody. Pepper balls were first used in an attempt to deescalate Justin. After being struck with pepper balls, Justin briefly fell to the ground and immediately stood back up. The pepper balls appeared to have little or no effect on Justin, and did not change his behavior. It should be noted that, as of this supplement, I am not aware of which officer is responsible for the deployment and use of pepper balls on Justin Salmons. Justin was taken to the ground by Officer C. Laabs | 3339, and he along with Sgt. K. Wrede, and Officer M. Daly | 1858, began attempting to control Justin's hands to place flexible cuffs on him, while giving clear and loud Rutter, Andrew 4922 Wrede, Keith CSPD Case Supplement 2020-00019301 Page 2 OF 3 2020-00019301 commands for him to stop resisting. Justin continued to resist and attempted to stand up. As I approached, Justin was on his right side with his right leg behind him, and appeared to be using his left leg to attempt to knee strike the officers attempting to cuff him. His right leg was slightly behind his body, and I kneeled on his right leg to gain control. As I kneeled on his leg, he used his left leg to attempt to push away from us and stand up. I delivered multiple closed fist strikes to his left leg, aimed at his common peroneal nerve to gain compliance and prevent Justin from pushing away, standing up, and continuing his aggressive, erratic, and unpredictable behavior. The common peroneal nerve is located in the middle part of the leg and provides sensation over the posterolateral part of the leg. After the strikes, Justin lowered his leg, which became briefly controlled by Officer J. Ray | 4173. Officer R. Thymian | 4313, arrived to assist and took control of the left leg so Officer Ray could perform other tasks related to the safety of the community. Officers continued to struggle to get Justin's hands secured and he continued to resist and rolled from his stomach, partially onto his right side. As he did this, I delivered back hand strikes to his exposed side, which caused him to roll back onto his stomach. Once he was back on his stomach, Officer Thymian released Justin's left leg and assisted with the handcuffing. While still kneeling on Justin's right leg I placed my right hand on Justin's left leg, pinning it to the ground, and used my left hand to apply pressure on Justin's ankle to distract Justin's attention from resisting the handcuffing attempts, to the pressure he felt on his ankle. This technique was effective, and Justin was secured into handcuffs. Immediately after Justin was secured in handcuffs, I released the pressure from his ankle. Once all officers involved were ready to stand up, I let go of Justin's left leg, and stood up from the kneeling position I was in on his right leg. Justin, who was still screaming obscenities at us, was escorted to a marked patrol vehicle, where a search of his person was conducted. During the search, Justin continued to attempt to physically resist, and verbally assault officers. I participated in the search, only by helping control Justin's movement by holding onto his left arm, and ensuring he wasn't able to flee on foot while the search was being conducted. As a result of that search, I was informed Justin was armed with a knife which was located on his person. While resisting the officers who were trying to cuff him, Justin made multiple attempts to reach his hands towards the side of his body where the knife was found. Upon completion of the search, Justin was placed into the backseat of a CSPD vehicle, and later transported to the El Paso County Criminal Justice Center. As I was providing scene security for the arrest team I observed Mr. Salmons left leg was not secure and he was attempting to kick arresting officers while he was on the ground. Upon seeing this I then moved into a position where I was securing his left leg with my hands by keeping it depressed on the ground. From my position, I observed Mr. Salmons left arm tucked under his body and he was refusing to provide it to arresting officers. From this position, I observed Det. Rutter deliver strikes to Mr. Salmons' left thigh area to gain compliance. During this time, I observed that Sgt. Wrede was able to gain hold of Mr. Salmons' left hand and place it behind his back. Once both hands were behind his back, I observed a plastic pair of zip-tie hand-cuffs were be administered however there was an equipment error and the zip-tie hand-cuff was not operating as designed. After seeing this I moved from Mr. Salmons' leg area to assist with the cuffing. Once the equipment error was identified, a pair of standard issue metal police handcuffs were introduced and I was able to handcuff Mr. Salmons successfully. Once Mr. Salmons was successfully handcuffed he was picked up off the ground and was walked over to a police vehicle. While I was at the patrol vehicle where Mr. Salmons was being placed, I heard him yell to officers that he was in possession of a knife in his back pocket. I then observed an officer retrieve the knife from his back pocket and place him in the patrol vehicle. Once Mr. Salmons was placed in the back of the police vehicle, I returned to scene security with a crowd disbursement role. Initiating Information: Case# 20-19301 Call Screen# 20229752 On Sunday, May 31, 2020 at approximately 1200 hours, I received a phone call from Lt.Buzzell-115. He advised that large crowds of protesters were already gathering in the downtown area. Lt. Buzzell informed me that the protests were peaceful but based on events from Saturday May 30th as well as intel being gathered, there was a possibility of the protests turning violent. Lt. Buzzell requested that I send out a Tac-Ops page to brief at the SED (Specialized Enforcement Division) offices at 1400 on May 31, 2020. The Tac-Ops page was sent out via dispatch at 1220 hours. I met Sgt. Wolf-991 and Lt. Buzzell at the SED office at approximately 1300 hours to start making plans for the protest. We made plans to be in the area of the POC (Police Operation Center, 705 South Nevada Ave) by 1700 hours. Additionally, we made plans to stay out of area and limit our visibility yet be able to respond if needed for several different scenarios. Some of the scenarios we planned for were officer rescues and defending the POC from being victim to extensive damage or arson. We made plans to defend the protesters from outside threats and to support the PORT-Public Order Response Team if they encountered an assaultive crowd or needed assistance dispersing the crowd. I instructed teams to meet at the POC in the rear lot, out of sight, by 1700. 1900 hours: I instructed teams to take up places south, southeast, or southwest of the POC, but out of sight and to await further instruction from Lt. Buzzell. The CSPD BearCat team parked on the south side of 909 South Tejon Street. 2100 hours: I was advised that the protest crowd had moved into the intersection of Cimarron Street and Nevada Ave and was blocking the northbound lanes. The crowd marched southbound on Nevada Avenue towards the Police Operations Center Once at the POC, the crowd gathered around the barricades placed on the west side of East Bauer, Troy 1479 Wolf, Robert CSPD Case Supplement 2020-00019301 Page 3 OF 9 2020-00019301 Rio Grande St. at Nevada Ave and began blocking north bound traffic. Shortly after, I was requested to bring our BearCat and the Teller County BearCat to support the PORT team on the north side of the POC about halfway between Weber St. and Nevada Ave. on Rio Grande St. I directed our BearCat and the Teller County BearCat to respond as requested. We took up positions to the east of the PORT facing west to give them support. Between 2100 hrs. and 2120 hrs. I watched as the crowd chanted and slowly tried to pass the barriers on the west side of the POC. They slowly crept eastbound on Rio Grande in front of the POC. Sgt. Cheney approached the crowd many times and asked them to move back. This was sometimes effective, other times it was not. The protesters continued to creep east of the barriers would sit down and raise their hands in a nonaggressive manner and chant. 2129 hours: At approximate 2129 hrs. Staff One (Chief Niski) went into the crowd and I watched the crowd circle around him and chant. Staff One exited the crowd and the crowd got behind the barriers and began chanting again. Shortly after Staff One left, the crowd crossed over the barriers and began moving east, slowly person by person, sitting down and raising their hands trying to take up more space on the east side of the western barriers in front of the POC. 2142 hours: At 2142 hours the crowd had pushed well past the barriers on the west end of the POC and Sgt. Cheney once again approached the crowd and asked them to move back. Sgt. Cheney was out amongst the crowd and at approximately 2155 hours I observed several plastic water bottles with an unknown substance in them fly from the crowd into the PORT team. The PORT team seemed unaffected by the water bottles while behind their shields and I reported that to Lt. Buzzell. The water bottles seem to incite the crowd who then pushed once again east, past the western barricades set up on Rio Grande in front of the POC towards the PORT team at 2156 hrs. I had Officer Carson issue the following statement over the LRAD (LRAD 450XL Long Range Acoustical Device) speaker system, "This the Colorado Springs Police Department, please back away from the officers." The announcement was met with further screaming from the crowd. I took the LRAD mic and I issued the following statement, "Please back away for your safety. We want to respect your rights. We need you to back away from the officers. Protest peacefully please. We respect what you are doing, and we just want it to remain peaceful." The LRAD was set on wide mode and mid yellow level which is approximately 90 to 100 db level according to manufactures guidelines. After this announcement I began seeing more traffic cones being carried above people's heads and hearing air horns being blown. I received a message from a friend who was observing the crowd who stated there were Bauer, Troy 1479 Wolf, Robert CSPD Case Supplement 2020-00019301 Page 4 OF 9 2020-00019301 rumors in the crowd that they believed CSPD would tear gas them at 10 PM. Along with the traffic cones, I also noticed more people were donning gas masks in the crowd. 2158 hours: I issued a second set of announcements but no lawful orders to disperse the second set of announcements were as follows, "please listen to your organizers. Let's keep this civil. We do not want problems. We support your cause, we want to protect your rights to demonstrate. Please back away from the officers." At this time, the announcement seemed effective and I observed the crowd move back to the concrete barricades on the west side of the POC. 2204 hours: I once again saw an increase of traffic cones being carried above people's head and passed from person to person within the crowd. The crowd was still blocking all northbound lanes of South Nevada at Rio Grande. I also observed members of the crowd once again encroaching the PORT team crossing across the concrete barriers on the west, moving one body length forward at a time sitting in the roadway on Rio Grande. 2216 hours: I observed a water bottle thrown from the crowd at a PORT team member and saw the crowd surround the area the bottle came from and seem to be moving the suspect that threw the bottle north on Nevada Avenue and out of the crowd. 2217 hours: I observed a small firework thrown from the crowd explode at the feet of the PORT team. After the firework exploded, the PORT team advanced towards the crowd at which time I heard bullhorns from the crowd and then observed more fireworks thrown towards the PORT team's location 2218 hours: After the PORT team took more water bottles and fireworks, I was instructed to give a lawful order to the crowd to disperse. I used the LRAD (Mid Yellow/ Wide Mode) to give the following order that was prerecorded per Commander Strossner, "This is Lt. Kern, a lieutenant with the Colorado Springs Police Department, I do by declare this an unlawful assembly and in the name of the people of the state of Colorado I command you to immediately disperse." After one lawful order, I observed the crowd immediately retreat to the west, behind the concrete barriers and a few in the crowd moved northbound along the northbound lanes of S. Nevada Ave. I also observed one rock and some small fireworks thrown towards the PORT team. The rock and the fireworks appeared to have come from the north of the PORT team and observed a person, who I believe to be the suspect, run to a red Dodge pickup truck and speed off northbound through the alley east of 600 South Nevada Bauer, Troy 1479 Wolf, Robert CSPD Case Supplement 2020-00019301 Page 5 OF 9 2020-00019301 Ave. 2224 hours: At approximately 2024 hours more fireworks were thrown from the crowd. Several water bottles were also thrown, additionally I heard one rock hit the side of the BearCat. The fireworks and water bottles along with the rocks seemed to come from the crowd north of the PORT team in the alley across from the POC. After the fireworks and water bottles were thrown, I was asked by Lt. Buzzell to issue more warnings to be dispersed from the Bearcats LRAD. I played the prerecorded message to disperse two times, the message was as follows: "This is Lt. Kern, a lieutenant with the Colorado Springs Police Department. I do by declare this an unlawful assembly and in the name of the people of the state of Colorado I command you to immediately disperse." After issuing the instructions to disperse, the crowd retreated to the west side of the concrete barriers in front of the POC. The crowd did not disperse, and they were still taking up the entire northbound lanes of S. Nevada Avenue at Rio Grande St. Shortly after falling back, the crowd then pushed to the barriers and began chanting. 2230 hours: Due to the fact that several aggressive parties were collecting in the alley north of the POC (which runs east and west) and on the right flank of the PORT team, I turned the LRAD speaker to face north in the alley and issued another warning for that crowd to disperse. The warning was as follows: "This is Lt. Kern a lieutenant with the Colorado Springs Police Department. I do by declare this an unlawful assembly and in the name of the people of the state of Colorado I command you to immediately disperse." After this warning it seemed that several in the crowd were encouraging some of the more aggressive individuals to leave. We saw several parties leaving northbound through the alley. 2240 hours: At approximately 2240 hours, the crowd stepped over the western barricade in front of the POC and began inching forward again. The crowd would take a knee or sit down and then move approximately one person forward towards the PORT team. 2245 hours: At approximately 2245 hours. I used the LRAD to make the following announcement, "Please back up back away from the officers we don't want trouble." The LRAD announcement seemed effective and the crowd again moved back away from the PORT team. I also observed several individuals that were in the northbound lanes of the S. Nevada Ave. beginning disperse northbound. 0009 hours: Bauer, Troy 1479 Wolf, Robert CSPD Case Supplement 2020-00019301 Page 6 OF 9 2020-00019301 At approximately 0009 hours, the crowd showed no sign of dispersing and they were blocking all northbound lanes of Nevada Avenue at Rio Grande. The crowd was becoming more agitated and the PORT team continued to take unknown projectiles from within the crowd. I was asked to give lawful orders instructing the crowd to disperse. I played the prerecorded announcement to disperse over the LRAD two times: "This is Lt. Kern a lieutenant with the Colorado Springs Police Department. I do by declare this an unlawful assembly and in the name of the people of the state of Colorado I command you to immediately disperse." Immediately following the LRAD announcements, the crowd began throwing projectiles at the PORT team to include rocks and water bottles. 0010 hours: At approximately 0010 hours, I heard a loud pop that sounded different than the fireworks. In my experience the pop was consistent with a small caliber gunshot. After hearing what I believed to be a gunshot, I used the LRAD to make the following announcements, "Please leave. We do not want to arrest anybody. It is unsafe and that was not our gunfire. It is unsafe. Please leave we do not want anyone to get hurt. Please leave." At this point the PORT team surged forward in an effort to disperse the crowd and I followed with the BearCat. I continued making LRAD announcements pleading with people to disperse from the area due to the unsafe nature of the crowd. I saw that the crowd began running northbound in the northbound lanes of S. Nevada Ave. A large portion of the crowd dispersed, but a large group of approximately 50 to 60 people stayed at the barriers confronting the PORT team. At this time, I directed safe smoke, which is a non-carcinogenic smoke, to be deployed into the intersection of Rio Grande and Nevada Avenue. Three canisters of safe smoke were deployed. I followed with announcements that it was only smoke. After deploying the safe smoke, most of the crowd began fleeing northbound, dispersing from the area of the police operation center. We began following the crowd in the BearCat and I continued to make LRAD announcements asking for people disperse and leave the area because it was unsafe. I informed them that we could not guarantee their safety but would help them get back in their cars for them to leave as quickly as possible. The majority of the crowd was dispersing as asked. I directed the BearCat to continue following the crowd northbound on S. Nevada Ave through Marino up to Cimarron during this time. I used LRAD to direct people how to disperse, to thank them for dispersing, and to make sure intersections were open for protesters leaving in their vehicles. 0020 hours: At approximately 0020 hours, I used LRAD announcement to address small pockets of protesters resisting dispersing the area. I informed them that the area was not safe that they could be arrested if they did not disperse. I asked them to, "Please leave now." 0024 hours: At approximately 0024 hours most of the crowd had dispersed, but there were still small pockets of resistance refusing to leave the area. At this time, I called for the patrol arrest teams in marked CSPD cruisers to come Bauer, Troy 1479 Wolf, Robert CSPD Case Supplement 2020-00019301 Page 7 OF 9 2020-00019301 forward and start making arrests on people refusing to disperse. The objective of sending the marked cars northbound on S. Nevada Ave. was to keep the crowd dispersing from the area. I directed the BearCat and the Teller County BearCat to follow the patrol units. 0026 hours: Patrol units and Tactical teams followed by the BearCats had pushed up to the intersection of Cimarron St. and Nevada Avenue. Several patrol units were blocking the intersection, so I used the LRAD to direct them out of the intersection to let civilian traffic pass both east and westbound on Cimarron. 0031 hours: At approximately 0031 hours, I observed a male party, later identified as Justin Salmons DOB: . Mr. Salmons was walking in the middle of the roadway on East Costilla St and Nevada Avenue. Mr. Salmons was in the lanes of traffic entering the center of the intersection. I was in the process of trying to clear cars out so civilian traffic could flow eastbound and westbound disperse the area for their safety. Salmons was clearly in the way. Mr. Salmons stopped in the intersection blocking eastbound Costilla Street at Nevada and began yelling profanities at the BearCat. I used the LRAD to tell Mr. Salmons that he if he kept moving, we would not bother him. Mr. Salmons did not keep moving but stood in intersection yelling profanities towards me. Mr. Salmons began walking towards the northeast corner allowing one SUV to pass intersection. Salmons then turned around and started walking through the intersection, blocking traffic while heading back towards the BearCat. He was clearly blocking eastbound lanes of E. Costilla St. He began yelling more profanities. Salmons turned to continue walking in the traffic lanes and I ordered that he be placed under arrest by tactical teams. At that time I ordered Salmons to the ground. I observed several pepper ball rounds deployed from my right strike Mr. Salmons in the lower back and buttocks area. I saw officers converge on Mr. Salmons and could hear them yelling at him to rollover. It appeared Mr. Salmons struggled against being taken into custody while in intersection. Several people were getting other cars to film the incident. After Sammons was taken into custody, I continued to clear the intersection for safe dispersal of the citizens. (There is excellent footage of this incident on Officer Robert Comstock's-4631 Body Worn Camera.) 0040 hours: At approximate 0040 hours, most of the crowd had dispersed and those that left behind were walking in an orderly manner on the sidewalks in a legal fashion. I directed tactical units to return to the police operation center and requested that northbound Nevada Avenue be opened up for the flow of traffic. After this time, there were no incidents that took place with the tactical units. Tactical units stood down at approximate 0100 hrs. Woodworth/2851, assigned to the Colorado Springs Police Department Strategic Investigations Unit, was called in to assist with crowd control due to reported protests in the downtown Colorado Springs area. I was operating in a fully uniformed capacity. Initial information was that a large group of protesters were protesting in the downtown Colorado Springs area and would transition from the Police Operations Center located at Rio Grande Street and S. Nevada Avenue all the way up Nevada to the Colorado Springs City Hall. I maintained a roving position with other detectives assigned to the Strategic Investigations Unit, monitoring and maintaining visual observations of the protesters. While assisting with crowd control, it was advised that lawful orders for the crowd of protesters to disburse was given at approximately 0009 hours, at which time the majority of the protesters were located in the roadway of S. Nevada Avenue at the Police Operations Center, 705 S. Nevada Avenue. Multiple orders were given for the crowd to disburse. After orders were given and the crowd failed to disburse, I assisted with other officers conducting crowd control in moving northbound from the Police Operations Center, pushing the crowd northbound on S. Nevada Avenue, continuing to give orders to disburse and leave the area. While doing so, I observed the crowd control team was also on foot walking northbound on Nevada Avenue pushing the crowd northbound away from the Police Operations Center. While assisting with attempting to disburse the crowd, I observed two unknown officers running northbound on the west sidewalk of S. Nevada Avenue as we were approaching Costilla Street. The two officers were chasing and attempting to apprehend an individual. I observed the two officers were able to apprehend the individual on the southwest corner of Nevada Avenue and Costilla Street, and I, along with other detectives from SIU exited our unmarked patrol vehicle equipped with emergency lights and siren activated to assist the officers by providing scene security while they took the individual into custody. I observed at this time the crowd control and other officers had also reached the intersection. I observed a male entering the intersection from the southeast side of Nevada Avenue who appeared to be yelling at officers on that side of the roadway. Entering the intersection, he also began blocking oncoming vehicle traffic. I observed the male, who was later identified as Justin Salmons DOB: continued to remain in the intersection, failing to respond to commands to disburse and leave the area. Woodworth, Wesley 2851 Wrede, Keith CSPD Case Supplement 2020-00019301 Page 2 OF 3 2020-00019301 My observation of Mr. Salmons was briefly distracted when a vehicle pulled up in front of me on Costilla Street at Nevada Avenue and appeared to be attempting to cross the intersection eastbound on Costilla Street. The vehicle was a mid-size what appeared to be small truck, and the driver pointed toward Mr. Salmons who was in the intersection and asked if he could make a citizen's arrest. At this time I heard cracking sounds coming from the direction of Mr. Salmons, and looked over and observed what appeared to be pepper ball impacts to Mr. Salmons. I then observed officers move forward to attempt to take Mr. Salmons into custody. I observed officers make contact with Mr. Salmons, who had initially fallen to the ground due to what was believed to be the pepper balls, and the officers pushed him back down to the ground. I observed a white SUV which was traveling eastbound on Costilla had stopped directly in front of the officers and Mr. Salmons. I immediately contacted the driver of the white SUV, an unknown female, and told her to place her vehicle into park so as not to run over the officers or Mr. Salmons. The female had her phone up and began yelling it was her first amendment right to record the police contact, and continued filming after placing the vehicle into park. I heard officers continuing to give Mr. Salmons commands to stop resisting and to place his hands behind his back, and looked over towards the direction of officers and Mr. Salmons and observed him yelling (unknown exactly what) and he appeared to be trying to pull his left arm underneath his chest as he was lying on the ground. I observed officers giving strikes with their hands to what appeared to be the back of Mr. Salmons' upper leg while giving commands to stop resisting. Mr. Salmons was then taken into custody, and I had the unknown female driver in the white SUV back the SUV up and proceed northbound on Nevada Avenue along with other vehicle traffic. Mr. Salmons was taken into custody and placed in a transport van for processing. I then re-entered the unmarked police cruiser with activated lights and siren, along with other SIU detectives, and continued to conduct further crowd control actions, but no other parties were contacted. I, Ofc. Comstock 4631, was assigned to the Teller County bearcat along with officers Laabs/3339, Alamo/4891, and Waldera/4665 to assist with the protest downtown Colorado Springs. I was assigned to a less lethal tool referred to as a pepper ball gun. Arrival on scene My team was staged downtown near 705 S. Nevada the police operations center and was advised to stay out of the area and out of sight unless needed. It remained relatively peaceful during the daylight hours but as soon as night fell the protest began to escalate. At approximately 2051 hrs. the crowd of protesters moved past the barricades that had been placed on the north side of the police operations center. Several minutes later the protesters begin to break down the police tape that had been put up near the front doors of police operations center. Aired over the radio several times were individuals that had been seen wearing body armor and carrying long guns along with gas masks. At approximately 2217 hrs. the crowd began to throw water bottles and fireworks at officers. Shortly thereafter at 2218 hrs. the crowd was given lawful orders to vacate the area. They continued to yell at officers and occasionally would continue to throw water bottles along with rocks and fireworks at officers. At approximately 2244 hours announcements were given again to the crowd to move back and back away from officers. By approximately 2327 hrs. the crowd had become very agitated and by 2328 hrs. the amount of objects being thrown at officers had become intolerable. By this time we had moved up in the Teller County bearcat behind the port team in front of the police operations center. At approximate 0009 hrs. two lawful orders were given over the L-rad system for the crowd to disperse. After the lawful orders were given another announcement was given to the crowd to advise them that they needed to leave the area immediately. After the crowd failed to disperse, announcements were then given again that we were going to throw smoke and that they needed to leave the area. As the smoke pushed the crowd back they continued to reassemble and create problems for the officers. We began to push north from the police operations center with the Bearcats to continue to disperse the crowd and not allow them to reassemble as a group. Contact with suspect As we approached the intersection of South Nevada Avenue and E. Castillo St. there was several groups of people failing to disperse and leave the area. We stopped both Bearcats just short of the intersection and Sgt. Bauer/1479 began to give announcements over the PA system advising them that it was no longer safe for them to be out and that we could no longer guarantee their safety and they needed to leave the area and go home. There was a white male later identified as Justin Salmons DOB walking and standing in the center of the intersection yelling at officers. There were cars turning in the intersection attempting to avoid Mr. Salmons. Sgt. Bauer advised Mr. Salmons to continue to walk and clear the intersection so he was not hit by any vehicles. Mr. Salmon's had almost made it to the northwest corner of the intersection when he then abruptly turned around and began to walk back towards officers towards the center of the intersection. While he was doing this another vehicle was making a turn northbound onto South Nevada Avenue and had to slow down and maneuver their vehicle around Mr. Salmons. As Mr. Salmons made his way across the intersection Sgt. Bauer advised him to get on the ground. I along with Ofc. Laabs and several other officers began to move towards Mr. Salmons. Upon hearing Sgt. Bauer's instructions to get on the ground Mr. Salmons immediately turned away Comstock, Robert 4631 Snuggs, Michael CSPD Case Supplement 2020-00019301 Page 2 OF 3 2020-00019301 from officers. At 0031 hrs. I immediately sent approximately three pepper balls in the direction of Mr. Salmons and upon seeing a reaction from Mr. Salmons I stopped firing. I continued to move towards Mr. Salmons along with other officers as Mr. Salmons grabbed his stomach and bent over. I then saw Ofc. Laabs tackle Mr. Salmons and several other officers assisting him. I pushed past them and gave verbal instructions to another male and female that were moving towards officers' location and Mr. Salmon. I advised these two individuals that they were free to film but they were not to move any closer to officers. The male party on my left began to take several steps forward and I advised him that he needed to take several steps back to which he complied. Mr. Salmons was taken into custody, the other groups of individuals left the area and the intersection was clear. Officer statement We then returned to the area of the police operations center and began to unload our gear and prepared to go home and call off shift. I completed a supplement to this case at a later date and time the sending my involvement with this case. Nothing further from this officer at this time. End of report. Wrede dictating BODY WORN CAMERA Body Worn Camera for the initial confrontation is unavailable due to the fact my body camera did not function properly. As I accelerated and ran toward the individual to take him into custody the feature that automatically detects the acceleration of my body camera did not turn on. Additionally, the feature on my body worn camera that detects some type of a struggle also did not function properly and failed to automatically activate. Once the individual was safely placed in handcuffs I physically activated my body worn camera using the remote. DETECTIVE'S STATEMENT On 06/01/2020, I, Sergeant K. Wrede, 1876, was working my assigned position as the supervisor of the Strategic Investigations Unit (SIU). On that day, SIU was assigned call sign Response Team 8, and was assigned to the downtown Colorado Springs area in support peacekeeping operations and/or arresting individuals involved in illegal activities associated with peaceful demonstrations. Assigned to my team that day were Detective R. Thymian, Detective J. M. Ray, Detective A. Rutter, and Detective W. Woodworth. We were all riding in one vehicle which was an unmarked Although it is unmarked it does have operational red and blue lights all the way around it, as well as an audible siren. All members of SIU that day were dressed in our uniform of the day, which consists of the CSPD French blue uniform, badges, name tags, and patches which clearly identify us as Colorado Springs Police Officers. In addition to our uniforms, we also had on Kevlar helmets for our protection from projectiles, as well as gas mask for protection from chemical agents. At approximately 0009 hours, lawful orders were given via PA system by the Colorado Springs Police Department to disperse from the area as the protest become unlawful, and unsafe. Shortly after the order to disperse was given the command to surge was given over police radio. I began driving my unmarked Durango with the detectives previously mentioned, northbound in the southbound lanes of Nevada Ave. While we were driving we were also accompanied by other officers who were in tactical vehicles, regular patrol vehicles and on foot. A majority of the protestors were complying and Wrede, Keith 1876 Wrede, Keith CSPD Case Supplement 2020-00019301 Page 2 OF 5 2020-00019301 they were running away from the protest location north out of the area, as requested. As I arrived in the corner of Nevada Ave., and Costilla St., I stopped my vehicle and exited as I observed two officers struggling to take an individual into custody. They quickly gained compliance of that individual and took him into custody. I then heard very loud shouting and obscenities coming from a location over my left shoulder. When I turned to look I observed a man yelling and shouting standing directly in the intersection. My attention was drawn to him because he was louder and more disruptive than everyone else in the immediate area. His shouting and behavior was agitating individuals around him. Law enforcement officers identify individuals who demonstrate this type of behavior as "agitators". Agitators tend to turn a peaceful situation into a confrontational situation creating a dangerous environment. Additionally, the male was standing directly in the intersection while vehicle traffic was present in the area. I informed SIU detectives that we were going to contact this individual, and we began walking toward him. In addition, loud and clear announcements were being given to the individual via a PA system to clear the intersection to get traffic out of the area. The individual did not comply. Another PA announcement was given for the individual to get on the ground, he did not comply. Once I was approximately 10 yards away from the individual I noticed him get struck by pepper balls in the stomach and chest area that were fired by members of the Tactical Enforcement Unit (TEU). I do not know who fired the pepper balls. Once the pepper balls struck him, he went from standing to somewhat of kneeling position toward his right side. Almost simultaneously TEU Officer Laabs rushed the man and tackled him to the ground as he was attempting to stand back up. At that time I ran towards Officer Laabs to give assistance. As the man was on the ground he was lying on his right arm and right side. While lying on his right arm, Officer Laabs was attempting to roll/push him onto his stomach by pushing his body towards me. I was on my knees, at the man's front side (stomach facing me) and I grabbed his jeans and shirt in an attempt to pull him toward me to roll him fully onto his belly to gain compliance and take him into custody. The man exhibited a good amount of strength and resistance to our efforts. He was given repeated verbal commands to stop resisting by multiple officers. During the initial struggle with him, my gas mask was bumped and some of the pepper particulates that were in the air came inside of my gas mask and were somewhat hindering my vision. Additionally, my vision was obstructed due to the curvature of the gas mask combined with the darkness of night and the flashing of emergency lights. I was the only one on the man's left side attempting to control his left arm, which he kept fighting to put underneath of his body. As I would pull his arm out from him and try to put it behind his back, he would resist me with all of his effort. I was having an extreme amount of difficulty getting the individual to release his arm from under his body and wrestle it to get it placed behind his back. His resistance was Wrede, Keith 1876 Wrede, Keith CSPD Case Supplement 2020-00019301 Page 3 OF 5 2020-00019301 forcing me to use my body weight as leverage to bring his arm around. I tried to lock my arms around his and use by body weight and strength as a pendulum to force his arm out. What was making things more difficult was his resistance with his entire body. The man would move his legs and kick his legs creating a hazard for other officers that were trying to control the lower portion of his body. In addition to moving his legs, he continued to lift his head up, and by lifting his head up it was allowing the left side of his body to rise off the ground, which was creating a scenario where he would be able to roll over and be on his back. Had he been able to roll onto his back, he would be in a better fighting/defensive position, which would have allowed him to kick and punch officers more freely, or get onto his feet and either flee arrest or continue to fight. I feared that if he were to be able to roll over on his back he would be a great risk to himself, other citizens, and officers. In order to control the left side of his body from coming up and rolling, I had to loosen my grip on his left arm that I was already struggling for with both hands, and place my left hand with an open palm on the top of his head and push his head toward the ground. Controlling his head was the only way I could effectively maintain positive control of his left arm and wrist, and keep his left shoulder and upper body from raising up from the ground. With his head toward the ground, I was able to get more control over his upper body which allowed me to better control his bodyweight and eventually to get his left arm to release and be placed behind his back. While struggling with the man, I observed other officers striking him in the legs around the common peroneal area to gain pain compliance. All the while those officers were yelling, "stop resisting." Once I got control of the individual's left arm and brought it behind his back, another officer had control of his right arm. There was a delay in getting the individual handcuffed because we were using white plastic flex cuffs and not metal cuffs. The use of plastic cuffs creates a particularly difficult situation. Unlike normal handcuffs that can open and be placed around an individual's wrist while officers are controlling the upper portion of the individual's hands and arms, flex cuffs have to be slipped over the wrists. Every time we would attempt to slip a flex cuff over the wrist, we would have to reposition our grip, which would allow him to gain control of his arms again. After several attempts using the flex cuffs, I then removed my regular metal handcuffs from my pouch, at which time Detective Thymian and I were able to handcuff the individual quickly and without incident. The duration of the incident on the ground was approximately 2 minutes. Once he was handcuffed I checked to see if my body worn camera on. I determined that it was not, and physically activated it remotely. We stood the individual up and began walking him toward a police vehicle. I opened the door and sat him in the police vehicle. As I was placing him in the vehicle he simultaneously stated, "You didn't read me my rights. You did not pat me down." The door had not been shut on the police car and in the moment I realized myself and other officers had not patted the individual down. I immediately removed him from the vehicle by taking ahold Wrede, Keith 1876 Wrede, Keith CSPD Case Supplement 2020-00019301 Page 4 OF 5 2020-00019301 of his right arm. As I was removing him from the rear passenger side of the vehicle, he was turning slightly away from me. As he was moving away, I noticed an object in his hand. As I pulled on his right arm to get him out of the car, he said he had a knife. Almost simultaneously I observed an object fall to the ground. I immediately observed that object to be a knife with a fixed blade approximately 6" in length. The knife landed on the street near the rear tire of the cruiser. I do not know if he intended to use the knife to cause harm or if he was making me aware that it was on his person. I would note that while this is a very detailed and descriptive account of me removing him from the cruiser, the statement "I have a knife", and him dropping the knife, occurred within in a fraction of a second. Once he was removed from the vehicle he and continued to be resistive as we searched him for additional weapons and contraband. I maintained control of his right side and searched the right half of his body to include his legs, while another officer searched the left side of his body. All the items he had on him were removed from his body and then he was again re-secured in the back of a marked CSPD cruiser. He was positively identified as Justin Salmons . Salmons was transported to an awaiting transport team where he was taken to CJC. I had no further contact with him. INJURIES The only injury I noted on the Salmons was a small abrasion above his eye. I do not know if that injury was caused as a result of police action. I was not injured during the confrontation. FORCE USED The only force that I used against the Salmons was the physical force of me attempting to pull his left arm out from under his body and gain control of him. In addition to that, I used an open left hand, on the back of his head, to force his head and shoulder area toward the ground to prevent him from rising up and rolling onto his back. I did not, at any time, strike Salmons. I did not at any time use any type of less than lethal tool against Salmons. I have no further information.
