Dear Mr. Presant:
This letter is to notify you of my plans to file a civil lawsuit against you through the
Tulare County Superior Court Civil Division for an unspecified amount of damages.
You were previously sent an email from my attorney regarding your trespass onto
my property ordering you to Cease and Desist. You admitted in a public meeting on
5/28/2020 that was recorded on the Caring Cause Face Book site, that you did so to
prove that I had abandoned my property. You parked in my driveway, knocked on
my door, peeped into my windows, and turned a water faucet on.
These actions were attested to and verified by my neighbor, who asked you to
identify yourself. You told her you were a friend of mine and she asked if you had
my phone number, because she could provide my number if you did not. You said
you had my phone number, to which she suggested you call me, which you never
have. She said you then took pictures of my yard and property.
There was no reason for you to enter my property. You live across town, there was
no For Sale sign posted, nor any other reason for your actions. You never called me
or emailed me of any concerns. You not only trespassed upon my property, you
contacted Code Enforcement and provided pictures of my house and driveway. I live
on a dead-end cul-de-sac – the only person that would have concerns about my
property is my neighbor across the street, the very same neighbor you conversed
with. She has no concerns regarding the desert landscaping or driveway
appearance.
My husband and I received a letter from the City of Tulare Code Enforcement
Division referencing a “recent inspection that a violation of the Tulare Municipal
Code exists on your property at 1741 E. Cheryl Lane, Tulare.”
My claim for damages will include not only expenses that I have incurred for legal
fees, but also the expenses incurred relating to the Violation Notice. In addition, I
will ask for compensation for “pain and suffering.” Not only did you make public
statements regarding the condition of my property, you defamed me by stating that
I had abandoned the property and left the state. Because of your statements,
Xavier Avila questioned me as to whether or not I had a refrigerator and furnishings
in my house on the public video. Because of your statements, I was further
subjected to persons driving by my property to “see for themselves” – posted on
the Caring Cause Face Book forum.
I do not know what your motivation was, or is, but you have caused irreparable
harm.
