McGee, Plaintiffs, ) ) ) ) ) ) ) ) ) ) ) ) ) vs.) Corporation of Harpers Ferry, Harwick Smith Johnson, Charlotte Ward Thompson, Christian Pechuekonis, Marjorie Flinn Yost ET AL, Defendants Case No. CC-19-2019-P-136 ORDER On November 6, 2019, this Court entered an Order Reversing the September 11 Order regarding Election Results. From that Order both parties appealed to the West Virginia Supreme Court. On June 15, 2020 the WV Supreme Court entered its Opinion regarding this Court’s November 6 Order and on July 16, 2020 remanded the case back to this Court. While the WV Supreme Court affirmed this Court’s ruling that the four votes in question should be opened and counted; the WV Supreme Court did reverse this Court’s November 6, 2019 ruling regarding the question of standing of Nancy Singleton Case. Accordingly, for the reasons stated more fully by the WV Supreme Court in its Order dated June 15, 2020, this Court does find that Nancy Singleton Case does have standing to participate in the election contest pursuant to WV Code 3-7-6. For all the reasons set forth by the Supreme Court in its June 15, 2020 Opinion and this Court’s Order of November 6, 2019 and this Order herein, this Court does REVERSE the decision of the Harpers Ferry Contest Tribunal Order Declaring Election Results and ORDERS that the Harpers Ferry Town Council count the provisional ballots of L. McCarty, G.
