IZI was found to have committed the below acts, resulting from my (described) investigation. On the 21st day of July, 2020 at 1500 AM. PM. (Speci?cally include facts constituting cause for arrest). NARRATIVE: On 7/12/2020 PBSO responded to an aggravated assault call that had just occurred at the Walmart in Royal Palm Beach. Upon arrival deputies met with Chris Estrada and his daughter, Lily. Estrada gave the following summarized (by original report) statement that ?he was shopping with his daughter, Lily Estrada, when he was walking in the electronics section and he made a comment to an unknown white male in a black shirt, pushing another unknown white male in a wheelchair, about him not wearing a mask. Christopher stated that the unknown white male began to curse at him and Christopher then stated to the male that he should not curse in front of his daughter. He stated that the argument became hostile and the two exchanged multiple Obscenities toward each other. Christopher stated that the unknown white male then reached toward his waist area and Christopher stated that he "did not care about your(his) gun" and then began to point his umbrella at the unknown white male. He stated that at this time a crowd of people were around him trying to defuse the situation. Christopher stated that at this time the unknown white male revealed a firearm and then brandished it by putting it up near his face while stating "I?ll kill you". Christopher stated that at this time the two separated and he returned to his daughter. He stated that the unknown white male(s) then left the area and then the store. He stated that he was scared for his life and that he wanted to press charges against this unknown male for aggravated assault.? A taped sworn statement was collected from Christopher Estrada that corroborates the above made statements. Contact with the reporting deputy revealed that this exchange had occurred on his in-car video system and was not yet ready for review after being uploaded to the database. An NTI was generated by the responding deputy with poor quality photographs from the scene and disseminated as unclassified throughout Palm Beach County. On 7/14/2020 this case was submitted to the District 9 detective bureau for review and investigation. The report and officer safety NTI BOLO were reviewed along with a video from an anonymous citizen. Page 1 of 7 NARRATIVE CONTINUATION The video obtained via an anonymous citizen showed the rear main aisle just outside of the electronics section (visibly labeled and and the male (dark hair, wearing black t-shirt, dark shorts, black shoes with white bottoms and glasses) pull what appears to be a black firearm from the right front side of his waistband and briefly point it towards another male further in on the aisle (that subject?s head is visible). The audio captures two male voices as they shouted expletives at each other. One yells, ?You wanna fucking gol?? while the other appears to yell, ?fuck that little It is unclear if this is an exact quote from either of the males as there is other background and the video appears to have been taken from between 20-25 feet away. The video does not show the actions of the individual further in the aisle, only that he is approximately 5-6 feet away from the man wielding the firearm. The video is a very brief depiction of that angle. A video with no audio obtained from Walmart Loss Prevention from aisle L3 and L4 was then reviewed which depicted the following summarized event: The male wearing a black shirt (subject 2) was walking down the electronics aisle towards the main rear aisle of the store (away from camera) pushing an elderly male in a wheelchair in front of him. As the male reached the main aisle, a young girl appeared to almost collide with the wheelchair as a male (subject 1) wearing a black mask, white/grey t-shirt and gray shorts (carrying a white and black golf umbrella) reached out to stop her from colliding with the wheelchair (this would later be identified as Chris and Lily Estrada). Estrada appeared to do a double take at subject 2 and possibly say something to him (his mask conceals his mouth) at which time subject 1 turns back towards him in the aisle and exchanges words with subject 2. Both subjects then appear to exchange increasingly heated words from a distance of approximately 10-12 feet until subject 2 lifts his right hand, middle finger towards subject 1. Subject 1 then lifts the umbrella and points it at subject 2 as if to emphasize whatever he is saying as subject 2 begins to walk away saying something more. At that point subject 1 advanced to a distance of approximately 1 foot from subject 2 as he lowered the umbrella and appeared to begin yelling at subject 2. Subject 1 then backs away to between 3-5 feet as he continued to point is finger at subject 2. The heated verbal exchange continued as subject 1 pointed his finger at subject 2. Another individual (older male) entered the video and appeared to attempt to deescalate the encounter. Subject 2 then turns away as though he is going to leave, however turned back to continue the confrontation. Subject 1 then pointed the umbrella towards subject 2 again at which time subject 2 reached into his waistband and pulled a black firearm out and briefly pointed it at subject 1. At this time the little girl (Lily Estrada) reentered the frame and began to tug on her father?s arm (subject 1) as though to lead him away from the encounter. Subject 2 pointed the gun at subject 1?s head before he replaced it into his waistband holster, began to walk away as he pushed the wheelchair, then turned back towards subject 1 to iterate something else in an angry manner. Subject 2 then walked away as he pushed the wheelchair and subject 1 walked away through the electronics? aisle with his daughter. Subject 2 was reportedly intercepted by Walmart loss prevention as they approached the locked exit doors (due to the current pandemic) at which time the doors were unlocked for both subject 2 and the wheelchair bound elderly person so that they could exit immediately from the store without further issue. Another Need to Identify BOLO was issued which depicted higher quality still frames from both the cell phone video footage submitted by an anonymous bystander and the actual Walmart aisle footage at that time. Immediately after the NTI BOLO was issued, contact was received from the P880 SID Behavioral Unit requesting the identity of the gun-wielding subject once he was identified for their Page 2 of 7 NARRATIVE CONTINUATION potential follow-up. Shortly after the BOLO went out, Vincent Scavetta contacted the P880 communications line and identified himself as the subject 2 (black shirt with firearm). Scavetta advised dispatch (and later a road patrol unit) that he wanted to give his side of the encounter at which time he was advised that a detective would contact him on the following day to meet with him. Research into Scavetta revealed no apparent encounters with law enforcement, an active Florida concealed weapons license exp 10/19/26) and he had a 2019 white Chevy Equinox registered in his name which matched a distanced still frame of the white SUV subject 2 had entered when he exited Walmart with the wheelchair-bound elderly man. On 7/15/2020 investigators met with Vincent Scavetta at the P830 district 9 substation in response to contact via phone and had in his possession his FL CCW and the firearm he had carried in Walmart (Smith Wesson .40 caliber semi-automatic SN HR56256) per request. The firearm was seized for evidence purposes in this investigation at that time and was found to not be stolen by PBSO teletype. Vincent Scavetta then gave the following sworn, post-Miranda statement which is summarized as follows and not verbatim: Scavetta advised that he had parked at the far end (description matched the grocery east side) entrance of Walmart. As Scavetta and his father (wheelchair) approached the entrance, it was pouring rain. Once they reached the entrance they found it to be locked at which time they went through the west entrance while they continued to be soaked. Once inside of the Walmart, Scavetta took his mask off as it was soaked; making it difficult to breath and fogged up his glasses to the point that he could barely see. Scavetta pushed his father through the store and at some point ended up on the electronic aisle. As Scavetta began to turn the corner off of the aisle; a man and girl entered the aisle and the man told him he should really be wearing a mask. At that time Scavetta stated that he cursed at the man and knew that he shouldn?t have, but it 'is what it is?. Scavetta told the man, ?that?s bullshit, don?t tell me what to fucking do?. The man then began to tell Scavetta to not curse in front of his daughter. At that point the man got up into Scavetta?s face and threatened him and his father. Scavetta described the man as posturing and telling him to hit him repeatedly while close to his face. At that point both men were in a screaming match towards one another. At some point the man backed away from Scavetta a few feet and struck him with the tip of the umbrella on his forehead. Scavetta drew his firearm, in fear for his life, as he was not aware if the man was in possession of another weapon or if he would attack him again with the umbrella. Scavetta told the man, ?don?t you ever fucking threaten me again? at which time he holstered his firearm and left with his father. Scavetta confirmed that his father is dependent on the wheelchair or a walker. When specifically asked what the man was screaming at him, Scavetta stated that he was telling him and his father that he was going to kick both their asses. When asked if any video with audio would confirm that, Scavetta backed away from specifics and stated that he did not recall and had been confused at the time. Scavetta described himself as 5?8, 177 with no combat familiarity or training and in moderate shape. Scavetta stated that he had not ever been in a physical altercation and was unsure on how to throw a punch, had not pulled his firearm in any similar situation and had been a legal firearm owner since the age of 18. Scavetta was asked if he had any interest in video games at which time he stated that he did not play many shooter games that reveled in gun violence. Scavetta denied any desire to wield a firearm in a confrontation of any type. Scavetta reiterated that the man had actually made contact with the umbrella on his forehead. Page 3 of 7 NARRATIVE CONTINUATION Scavetta described the man as being thin, pretty fit, 35-40 years old, taller than him, heavier set than him. Scavetta stated that he believed the man was going to possibly strike him as he was within 3-6 inches from his face while he screamed at him. Scavetta described the child accompanying the man as 5-6 years old, smaller stature and of no threat to him. He did acknowledge that when she saw the gun she appeared scared and he had felt bad for pulling his firearm with her present. Once Scavetta perceived the threat was over, he holstered his firearm and left with his father. Scavetta acknowledged that the video the media had been broadcasting showed Scavetta in a very poor light. When asked about the beginning of the encounter, Scavetta admitted that the man was not threatening in any way in the beginning, only suggestive that he wear a mask and should be wearing a mask. Scavetta had reacted by cursing at the man which had likely began the conflict. Once Scavetta?s CCW training was established, he was asked why he did not just walk away instead of engaging in a conflict with the man in front of his child. Scavetta advised that he did not expect the encounter to go the way that it went. In hindsight, Scavetta acknowledged that he should have walked away from the encounter however stated that he had forgotten that he even had a firearm on his person. Scavetta admitted that he had pointed the firearm at the man, however had his finger on the trigger guard, not on the trigger. Scavetta admitted that he did not have a very clear recollection of what had occurred beyond what he had stated due to the stress level of the event. Scavetta stated that he and his father had attempted to leave the store at that time and had been let out through the locked door by someone that appeared to work for Walmart. Scavetta was later contacted by someone that he worked with and told that he had been on crime stoppers at which time he contacted PBSO to identify himself. Scavetta advised that he had not reported the incident as it had been in the heat of the moment and was over. Scavetta stated that this entire incident had nothing to do with the mask mandate in Palm Beach County and nothing to do with his second amendment right to carry a firearm. Scavetta agreed to meet and cooperate with the PBSO behavioral unit for evaluation based on what had occurred in Walmart. It was explained to Scavetta that the case would most likely be fonrvarded to the Palm Beach County State Attorney?s office for a filing decision on the entire matter and to not be surprised should law enforcement approach him to place him under arrest at a later time concerning this incident. A property form detailing the firearm was given to Scavetta as he left the building. All NTI BOLO material was updated via email that the subject of the Need to Identify BOLO had been identified and was cooperative with the investigation at that time. Of the firearm, Scavetta stated that he had fired it the day before and had fired a total guessed amount of six (6) rounds through it since he purchased it. On 7/15/2020 investigators met with Chris Estrada at the PBSO district 9 substation in response to contact via phone at which time he gave the following recorded sworn, post-Miranda statement which is summarized as follows and not verbatim: Estrada was in Walmart walking to the electronics aisle with his daughter at which time he had seen the other gentleman pushing a wheelchair and noticed that neither was wearing a mask. Estrada Page 4 of 7 NARRATIVE CONTINUATION said, ?hey, you should be wearing a mask? at which point the other guy began to curse at him and began to curse back out of concern that his daughter was present. Estrada stated that he wasn't certain whether or not he had raised his umbrella at the man before or after the man stated that he was going to shoot him. When asked if the man had shown him a firearm when he said he was going to shoot him, Estrada advised no, however said the suspect had placed his hand on his waistline over what he presumed was a firearm. While having this confrontation, his daughter had come to him and began pulling on his hand to try to lead him away. Estrada reiterated that he had raised his umbrella towards the man?s face after the threat was made indicating that the man had a gun. Once the encounter was over, Estrada felt that the man should not have a firearm. Estrada was unclear concerning the order of events with the other man. When asked if he had made any contact with the umbrella against the man with the gun, he stated that he doubted any actual contact had occurred, but anything was possible. When asked him if he would have been surprised that he touched the man on the forehead with the umbrella, Estrada stated he did not believe he had, however, would only have done so once the man had obviously threatened him verbally that he was going to shoot him. Estrada stated that ?his blood was flowing? based on how excited the guy seemed to get. Estrada stated that the man with the gun did not physically appear to be the type of guy that would be aggressive (confrontational) based on his appearance prior to his reaction. When the situation was presented to Estrada about how this could become a viral news story nationally and he was asked why he had not walked away, he responded that mutual respect was important to him as this had occurred in front of his kid. Estrada reiterated that he was not disrespectful and was put off by the guy cursing at him in front of his daughter. Estrada recognized it would have been better had he just left it alone and not had the confrontation. Estrada advised that he had told the man at one point, don?t give a fuck about you or your gun? and continued to state that had if he actually made contact with the umbrella, it was only after the man had told him he had a gun and that he would shoot him. The entirety of the situation depicted above was explained to Estrada at which time he was asked what he wanted to see come out of the situation he responded, ?that guy should not have a (CCW) license? and then continued to verbally debate over a considerable amount of time with himself over whether or not to press criminal charges against the man with the gun. Ultimately, Estrada decided that he did not want to pursue charges against the man (despite a strong desire to do so) with the gun (due to his having an arrest history and no third party witnesses presented to attest to anything that was actually said or threatened) as of the time the interview ended with the request that he receive some time of evaluation concerning the incident in the fact he had pulled out his gun and threatened him in front of his daughter in Walmart. Walmart was contacted and asked if they wanted to issue any trespass ban for either individual for that location in reference to the incident at which time they indicated that they would issue trespass against the gentleman with the gun. On 7/16/2020 contact was made via phone with Vincent Scavetta at which time he advised that he had retained an attorney. Contact was received via phone by someone who represented himself as Scavetta?s attorney at which time it was explained to him that this case could possibly be resolved with no criminal charges filed against his client if he submitted to a PBSO behavioral unit evaluation Page 5 of 7 NARRATIVE CONTINUATION for the determination as to if he should have a CCW license. The person advised that he would let his client know and be in contact within the next 48 hours. The person asked if his client was willing to give up his CCW license would the case go away without criminal charges at which time he was advised that it would be likely based on the current circumstances. Based on the preliminary contact from SID Behavioral Unit and their presumed desire to follow up with their own evaluation concerning the subject with a gun, this case was blocked from release pending their final disposition of that process. This report will be forwarded to them for preliminary evaluation in that unit. On 7/17/2020 contact was received by the person representing themselves Scavetta?s attorney via phone at which time they asked several questions about the investigation to which the response was that the case was still open and that information would not be shared. The person representing himself as Scavetta?s attorney then stated that his client would not be willing to meet with the PBSO Behavioral Unit. The person stated that the facts should be submitted for the case and allow the process to proceed at that time. On 7/17/2020 PBSO dispatch sent an email that a phone call from ?Edgar Moses? (self-described as a retired DEA employee) had requested contact and noted that he was a witness to the ? that had occurred on 7/11/2020 at Walmart?. On 7/21/2020 investigators met with Edgar Moses who presented retired credentials for the DEA as well as a Florida Drivers? License. The following is a summary of the recorded, sworn statement and is not verbatim: Edgar Moses had been at Walmart on the day of the incident and had been shopping near the electronics aisle. While shopping; Moses heard a loud verbal conversation which was becoming more heated. Moses had gone towards the noise and had witnessed a man wearing black shirt with a person in a wheelchair yelling at a man with a striped shirt wearing a black mask with a small girl. Moses had approached both men in an attempt to record what was going on and intervene to get them to calm down, however he had not been able to get the recording going on his phone in time when he heard the man (wearing black with wheelchair bound person) yell, KNOW WHAT in a threatening manner towards the man in the stripped shirt with the young girl. The man in the black shirt then pulled out a firearm from his waistband and aimed it at the man in the stripped shirt for a moment before placing it back in his waistband to leave. When asked specifics, Moses stated that he had not heard any threats of physical harm from either man as he approached, only an escalation of angry verbal exchanges. The stripped shirt man?s daughter was yelling to her father in a frightened voice to leave and get him away from the man in the black shirt. Moses stated that prior to the man in the black shirt pulling the firearm, he absolutely did not see any physical contact from the man in the stripped shirt or hear any physical threats from him. Of note: the man with the gun (black shirt) appeared as though he had lost all control and Moses was strongly concerned about the fact that he had a firearm. Moses stated that he didn?t think the man should have a concealed weapons permit in light of his behavior and felt that the situation was dangerous. Moses stated that he had given his contact information to Walmart in case he was needed as a witness, however the information was not fowvarded to law enforcement. Moses identified himself from video stills of the event and verified that it accurately depicted the subjects involved in the incident. Based on the above facts, an arrest warrant is requested for Vincent Bruce Scavetta for one (1) count of Aggravated Assault with a Firearm per F.S.S. 784.021(1a) and one (1) count of Improper Exhibition of a Firearm per F.S.S. 790.10.
