We write to you because we understand that Google has sought a continuance on the question of sealing the state of Arizona’s complaint and exhibits in CV2020-006219. We respectfully ask that you deny this continuance. The issue of user location tracking by Google and other tech companies is of urgent public importance, and there is presently a robust public debate on this topic. Given this context, it is vital that the court seal only those parts of the complaint and exhibits that actually contain trade secrets or other information that are legitimately deemed confidential. Delaying the decision to seal the case documents would diminish our capacity, as well as the public’s opportunity, to exercise First Amendment rights to speak regarding the Attorney General’s complaint and exhibits. Such a delay would also have a chilling effect on our ability as scholars, practitioners, and advocates to access information that is essential to our research and professional activities. In consequence, a delay will impede the role of research and advocacy in ensuring informed public discourse. We respectfully request that this letter is included as part of the Court’s docket.
