Conduct Resolution Agreement Center for Community Standards Name: Alpha Tau Omega (ATO)– Gamma Chi Fraternity Student organization agrees that it is responsible for violating the following Standards on the incident dates as listed: WAC 504-26-206 - Hazing. (1) No student or student organization at Washington State University may conspire to engage in hazing or participate in hazing of another. (a) Hazing includes any activity expected of someone joining a group (or maintaining full status in a group) that causes or is likely to cause a risk of mental, emotional and/or physical harm, regardless of the person's willingness to participate. (b) Hazing activities may include but are not limited to the following: Abuse of alcohol during new member activities; striking another person whether by use of any object or one's body; creation of excessive fatigue; physical and/or psychological shock; morally degrading or humiliating games or activities that create a risk of bodily, emotional, or mental harm. (c) Hazing does not include practice, training, conditioning and eligibility requirements for customary athletic events such as intramural or club sports and NCAA athletics, or other similar contests or competitions, but gratuitous hazing activities occurring as part of such customary athletic event or contest are prohibited. (2) Washington state law also prohibits hazing which may subject violators to criminal prosecution. As used in RCW 28B.10.901 and 28B.10.902, "hazing" includes any method of initiation into a student organization or living group, or any pastime or amusement engaged in with respect to such an organization or living group that causes, or is likely to cause, bodily danger or physical harm, or serious mental or emotional harm, to any student or other person attending a public or private institution of higher education or other postsecondary education institution in this state. (3) Washington state law (RCW 28B.10.901) also provides sanctions for hazing: (a) Any person who violates this rule, in addition to other sanctions that may be imposed, shall forfeit any entitlement to statefunded grants, scholarships, or awards for a period of time determined by the university. (b) Any organization, association, or student living group that knowingly permits hazing by its members or others subject to its direction or control shall be deprived of any official recognition or approval granted by the university. WAC 504-26-204 - Abuse of others or disruption or interference with the university community. Abuse of others or disruption or interference with the university community includes, but is not limited to: (1) Physical abuse, threats, intimidation, and/or other conduct that threatens, endangers, harms, or undermines the health, safety, or welfare of the university community or any person, including, but not limited to, domestic or intimate partner violence. (2) Conduct that disrupts the university community or prevents other students, employees, or guests of the university from completing their duties. (3) Conduct that interferes with or disrupts the university's mission, operations, or activities. WAC 504-26-224 - Reckless endangerment. Engaging in conduct that creates an unreasonable risk of harm to another person or property. WAC 504-26-212 - Alcohol. Use, possession, manufacture, or distribution of alcoholic beverages (except as expressly permitted by university regulations, and federal, state, and local laws), or public intoxication. Alcoholic beverages may not, in any circumstance, be used by, possessed by, or distributed to any person not of legal age. WAC 504-26-209 - Violation of university policy, rule, or regulation. Violation of any university policy, rule, or regulation published electronically on the university web site or in hard copy including, but not limited to, Washington State University's alcohol and drug policy, executive policy 15 (policy prohibiting discrimination, sexual harassment and sexual misconduct), and housing and residence life policy. Incident dates: Throughout Fall 2019, Primary incident on 11/11/2019 Agreement date: The organization agrees to the following sanctions: Sanction(s) Loss of recognition through May 15, 2026. Loss of recognition is defined as withholding university services, privileges or administrative approval from a student organization. Services, privileges and approval to be withdrawn include, but are not limited to, intramural sports (although individual members may participate), information technology services, university facility use and rental, campus involvement office organizational activities, and office of Greek life advising and advising from Student Involvement staff. Loss of recognition means that ATO may not identify itself as an official WSU organization during the loss of recognition period and cannot receive any of the benefits of being an officially recognized student organization. Initials Organizational Planning Documents. If ATO wishes to seek re-recognition after May 15, 2026, it must submit organizational planning documents, which must contain the following information:  Re-recognition Information: Re-recognition information should include information about how the chapter plans to safely and successfully rejoin the Greek community at WSU. It must minimally include: o Mission, values, and goals of the organization, and how they align with WSU’s mission o Names of intended officers and advisors. Active members from Fall 2019 are ineligible to serve as advisors during re-recognition. o Risk management policies, including event management practices o Defined expectations for big/little relationships, including how the chapter Standards Board may address reported violations of those expectations o Plan for managing chapter and media communication relating to Mr. Sam Martinez’s death o How ATO intends to support and positively benefit the University community  Chapter Development: In conjunction with the expectations of ATO Headquarters and the WSU IFC, you must submit a plan that explains how you intend to develop your chapter membership. As an executive board, you must work with campus, community, and/or fraternity partners to develop the exact content of this education, but it should align with your organizational values and mission statement and the WSU values and mission statement. This chapter development plan should be implemented annually for a minimum of five years following re-recognition. If the needs of the organization change, the plan can be modified with approval from the Center for Community Standards and the Center for Fraternity and Sorority Life. Minimally, 90% of chapter membership must receive information annually about: o Hazing prevention education o Alcohol education from a harm reduction standpoint o Bystander intervention o Healthy group development When describing the chapter development curriculum, please be sure to include: o What resources will be utilized? o How will the officers/advisors of the organization get buy-in from members, advisors, coaches, alumni, and national representatives in the plan? o In addition to attendance/participation tracking, how will the results and impact of the plan be measurable? To request re-recognition, ATO must submit the organizational planning documents to the Center for Community Standards. The documents will be reviewed by both the Center for Community Standards and the Center for Fraternity and Sorority Life to make sure they comply with the requirements above. ATO Colony Development Process. When returning to campus, the chapter will follow the then current ATO Colony Development Process or subsequent replacement. This process is updated regularly, so upon return ATO’s Director of Growth can share an updated version. Social Probation. ATO will not be permitted to hold events with alcohol for the first 18 months of its re-recognition, except that from month 7 through 12 of Social Probation it will be allowed to host up to one event with alcohol and from month 13 through 18 of Social Probation it will be allowed to host up to two events with alcohol, provided that at the time of the event ATO is in full compliance with the sanctions in this document, the alcohol is provided and served by a licensed third party, and ATO follows all other applicable University rules and regulations. Following the first 18 months of re-recognition, ATO will be removed from Social Probation only if it is in full compliance with the sanctions in this document. In the event that ATO becomes non-compliant with the sanctions assigned in this document after being removed from Social Probation, ATO will be notified in writing of the noncompliance and given one month to return to compliance. After one month, if the chapter has not regained compliance with the assigned sanctions, it will be placed back on Social Probation until it returns to compliance. Social Probation is defined as a period of time where the chapter is not allowed to host events with alcohol (except as allowed herein). If, following the initial 18 months of Social Probation, the chapter disagrees with its Social Probation status, it can challenge its application in the same manner a student would challenge a hold on a student’s account (see WAC 504-26-520 for current process). CFSL Monthly Meetings. The ATO President must meet with the designated advisor from the CFSL for monthly meetings for three academic years following successful re-recognition. These monthly meetings may be reduced at the discretion of the CFSL advisors. It is the ATO President’s responsibility to schedule these meetings. Center for Community Standards Meeting. If ATO is re-recognized, the ATO President will meet with a representative from the Center for Community Standards for an overview of the chapter’s community standards history within one month of election. These meetings will occur for the first five years of re-recognition. Alcohol Free Chapter Facility. If ATO is re-recognized, the chapter facility will remain dry for two calendar years from the date the chapter returns to being a residential fraternity. Hazing Prevention Education. If ATO is re-recognized, the chapter must prepare ongoing hazing prevention educational curriculum for its members. The curriculum must be completed annually by all members for a minimum of five years beginning with ire-recognition. The curriculum provided must be approved by the Center for Fraternity and Sorority Life and must be gmundecl in evidence-based practices. If any member is unable to complete the curriculum due to extenuating circumstances, the Center for Community Standards will work with the chapter to find an appropriate alternative on a case by case basis. - Responsible Expansion Growth Protocols. If ATO seeks re-recognition, the chapter will comply with existing expansion growth protocols, as supported by the North American Interfraternity Conference, at the time seeking re?recognition. - Disciplinary Probation. If ATO is re-recogniZed, the chapter will be placed on disciplinary probation for one calendar year upon re-recognition. Disciplinary probation indicates to the organization that referral to the University Couduct Board with the recommendation of loss of recognition is a likely outcome if the organization is alleged to have violated any institutional - regulation(s) or fails to complete any conditions of probation during the probationary period. AGREEMENT: ATO agrees that it was responsible for violation(s) of the Standards of Conduct for Students and to the assigned sanctions as noted above. ATO understands that under WAC Chapter 504?26 and RCW Chapter 34.05, ATO has the right to a full adjudicatory hearing on the merits of its case as well as several appeals, including the right of judicial review. ATO understands these rights and knowingly and intelligently waives them. ATO has had the opportunity to consult with an attorney regarding this matter. This agreement means that ATO violated the Standards of Conduct for Students and the sanctions contained in this agreement are ?nal and that ATO has no right to appeal. ATO understands that any violation of a sanction will be the basis for further action by the University. By signing this agreement on behalf of the Gamma Chi Chapter of ATO, I do not make any representations on behalf of myself individ? ually; meaning that I do not admit or deny any factual or legal representations contained in this agreement on behalf of myself, nor do I admit or deny that I had any role whatsoever in the factual allegations that form the basis of this agreement. Finally, signing this agree- ment is not an admission that I have any personal knowledge of the factual allegations or representations contained in this agreement. Nothing contained in this agreement or the University?s investigation of this matter can be attributed to me by my signing this agreement on behalf of the Gamma Chi Chapter of ATO.
