Esplin - Utah State Bureau of Investigations, Agency Case No. 20INV0468, upon a written declaration states on information and belief that the defendant, BETSY SAOMAMAO JONES, committed the crime(s) of: COUNT 1 CRIMINAL MISCHIEF (GANG), 76-6-106(2)(c) UCA, a Second Degree Felony, as follows: That on or about May 30, 2020 at 350 North State Street, in Salt Lake County, State of Utah, the STATE vs BETSY SAOMAMAO JONES DAO # 20010755 Page 2 defendant did intentionally damage, deface, or destroy the property of another and the actor's conduct caused or was intended to cause pecuniary loss equal to or in excess of $1,500 but was less than $5,000 in value. Furthermore, the defendant committed these crimes while in concert with two or more persons as defined in Utah Code 76-3-203.1. THIS INFORMATION IS BASED ON EVIDENCE OBTAINED FROM THE FOLLOWING WITNESSES: Andrew Marr, B. J., Agent D. Holt, Agent R. Contreras, N. C., Agent A. Ashby, and Agent S. Esplin. DECLARATION OF PROBABLE CAUSE: Your declarant bases this information upon the following: The written report of Utah State Bureau of Investigations Agent S. Esplin that he has reviewed reports and viewed photographs and video of the Salt Lake City Protest on May 30, 2020. Agent Esplin determined that while at the Utah State Capitol, located at 350 North State Street, Salt Lake County, Utah, at least six people, including defendants SEDELIA ELENA RUBIO, STEVEN DANIEL RAMIREZ, and BESTY SAOMAMAO JONES, used cans of spray paint to damage one of the walls. Some of the photographs showed the defendants painting the same words and letters, and others showed the defendants and the three unidentified people posing together in front of the damaged wall. Agent Esplin noted that RUBIO used spray paint to paint letters on the wall, and then handed the can of paint to an unidentified male. At one point, RUBIO handed what appeared to be car keys to an unidentified female, and the female walked to a car parked nearby. A records check revealed the car was registered to RUBIO. The defendants were identified by comparing driver’s license photographs to photographs and video of the group of people damaging the Capitol Wall. Total amount of damage caused by the group is estimated at approximately $3,700. The Court is notified each defendant committed the crime of Criminal Mischief while in concert with two or more other persons. The defendants are, therefore, subject to enhanced penalties. Due to the nature of these charges, there is a substantial likelihood of further danger to the community. The State requests that bail be set in the amount of $10,000.
