Please be advised that our Office had received reports with attached photos on 6 January 2020 on discharging of sediment from work activities on site into the lake and landslip around embankment which causes soil being washed into the lake. Subsequently, our Monitoring and Enforcement team had conducted a site iHSpection on 07?h January 2020 and con?rmed that the embankment had eroded causing rocks and mud to break into the lake. In addition, we also noted waste materials (timbers, bricks etc.) scattered around the site anduncovered cables on the ground. This a clear breach of the following conditions of your approved development consent: ?12. All waste materials must be disposed of at Tafaigata land?ll? ?14. The use and development shall be managed so that the amenity of the area is not compromised, by excessive noise, excessive dust, visually o?ensive signage, poor airspace, excessive tra?ic generation, smell, fumes and waste materials. ?15. The proposed activity shall not have an undue detrimental environmental impact on: a) Environmental quality of the site or land adjoining the site; b) Any vegetation on site and trees; and c) Likely future development. ?19. That all earthworks shall be in accordance with the Code of Environmental Practice for Earthworks 2007 that all erosion and sediment controls must be installed prior to the commencement of earthworks and maintained in an e?ective capacity at all times during construction works. In light of the above non-compliance, we advise that immediate mitigations measures are carried out to ensure compliance with the above conditions of your approved development consent. We also request that an earthworks plan and report on proposed mitigation measures are submitted to our Of?ce no later than 14th Tuesday 2020. We will continue to monitor the site and failure to comply with this letter as well as the conditions granted will result in further enforcement actions under the PUM Act.
