Office of the Governor State of Oregon EXECUTIVE ORDER 20-54 IMPLEMENTING LAW ENFORCEMENT PLAN TO KEEP THE PEACE, PROTECT FREE SPEECH, AND PREVENT VIOLENCE IN THE CITY OF PORTLAND On September 26, 2020, a demonstration sponsored by the ?Proud Boys? is planned to occur at Delta Park in the City of Portland. Additional demonstrations are also planned at other locations within the city. At times during the past several years, Portland has been the location of Violent clashes between groups with opposing political beliefs. Pursuant to ORS 401.165 et seq., I find that there is an imminent risk of civil disturbance this weekend that threatens injury or possible loss of life, and ?nd that the actions described below are necessary to address that imminent threat. A coordinated law enforcement response is necessary, and the City of Portland has agreed to indemnify law enforcement agencies that participate in that response. NOW THEREFORE, IT IS HEREBY DIRECTED AND ORDERED: Pursuant to my emergency powers under ORS 401.165, ORS 401.168, ORS 401.175, and ORS 401.188, I hereby order as follows: 1. Declaring an Emergency: For the reasons described above, and pursuant to ORS 401.165, I proclaim and declare a state of emergency to address and ensure appropriate coordination of resources to control anticipated civil disturbance in Multnomah County. 2. Geographic Scope: The geographic scope of this emergency declaration is the county of Multnomah. This area will be referred to herein as the ?law enforcement coordination area.? 3. Duration: This Executive Order is effective from 12:01 am. on Saturday September 26, 2020, and expires at 12:01 am. on Monday, September 28, 2020, unless extended or terminated earlier, by the Governor. This period of time will be referred to herein as the ?law enforcement coordination period.? 4. Law Enforcement Incident Command: Law Enforcement: Pursuant to ORS 401.168, ORS 401.175(2) and (5hereby assume control of local law enforcement (including the Portland Police Bureau, the Multnomah County Sheriff?s Of?ce, the Gresham Police Department, and the Port of Portland Police), as necessary, for purposes of responding to the events described above, for the duration of the law enforcement coordination period. Any of?cers not required to respond to these events, as determined by the incident commanders named in paragraph 4(b) of this Executive Order, remain under local control. Office of the Governor State of Oregon EXECUTIVE ORDER NO. 20-54 PAGE TWO Uni?ed Incident Command: Multnomah County Sheriff Michael Reese and Oregon State Police Superintendent Travis Hampton will jointly serve as incident commanders in the law enforcement coordination area for the law enforcement coordination period, and will coordinate a uni?ed incident response, consisting of the Oregon State Police, the local law enforcement listed in paragraph 4(a) of this Executive Order, and other law enforcement agencies in the law enforcement coordination area during the law enforcement coordination period. 5. Delegation of Additional Authorities: In addition to other authority vested by law, during the law enforcement coordination period I delegate to incident commanders Sheriff Reese and Superintendent Hampton the authority to exercise the following authorities, if they determine it necessary: Road Closures and Restrictions: Pursuant to my authority under ORS 401.175, the authority to close roads and highways in the emergency area, or to limit travel on such roads. Curfew: Pursuant to my authority under ORS 401.168, the authority to declare a curfew in the emergency area. 6. Enforcement: In addition to other enforcement authorized by law, the directives in this order are enforceable pursuant to ORS 401.990. Done at Salem, Oregon, this 25th day of September, 2020.
