As of today, September 24, 2020, this motion has not been signed by the judge assigned to this case. Therefore, the motion is not in effect. However, the State Board of Elections re-issued numbered memo 2020-19 changing how the election process worked based on this. Because the judge has not signed the motion, this memo is not valid. Because of this, the NC Republican Party advises you to not follow the procedures outlined in this revised memo. In addition, the NC House and Senate were not consulted in this motion even though they were intervenor defendants. As parties in the suite, they should have been consulted about this motion and been given the opportunity to disapprove this motion. This should make the motion fatally flawed. Also, as you have likely heard, the two Republican members of the state board resigned due to the process which was used to approve the settlement at issue. 1 Case 5:20-cv-00507-D Document 25-2 Filed 09/29/20 Page 1 of 3 EXHIBIT 2 If and/or when this motion is signed by the judge, there are several plans being formulated to prevent this motion from taking effect. We have been and will continue to fight for a fair and transparent election process. In just a few days, you will be reviewing absentee ballot container envelopes and we are asking that you do not just accept the research of board staff but review the envelopes yourself. And if you are not comfortable approving an envelope do not do it. We are doing our best to have Republican observers at each of these meetings, but as you know they are severely limited in how they can be involved in the process, so we are dependent upon you to speak up. If your meetings are not being held at 5 PM on the 29th at the board of elections office and on subsequent Tuesdays thereafter, please let us know immediately so we can let our observers know. Unfortunately the rules surrounding the election process are in a constant state of flux. Changes could come at any moment requiring us to adjust our approach, but we will do our best to keep you informed. The Democrats are trying to undermine the election process through backroom shenanigans that should not be tolerated by our board members at any level.
