Grewal Dear Governor and Members of the Legislature: 2019 was a sobering year for our State. There were 994 reported bias incidents in New Jersey—a 75% rise from 2018 to 2019. While many of these incidents involved bias-based harassment or vandalism, they also include one of the deadliest days in our State’s history: the December 10th attack at the JC Kosher Supermarket and the Bayview Cemetery in Jersey City, in which two shooters, fueled by hate, killed four of our fellow New Jerseyans. Simply put, acts of bias have unfortunately become all too commonplace in our society, and every one of the 994 reported bias incidents documented herein represents an affront to what we stand for as New Jerseyans and Americans: the freedom and opportunity to thrive in our society regardless of who you are. That is why combatting bias continues to be one of my top priorities. We must root out the implicit and systemic biases that fuel the incidents that come to the attention of law enforcement. Last April, I released updated standards to ensure that all bias incidents are reported to law enforcement and that complaints are quickly and comprehensively investigated. Throughout 2019, the New Jersey State Police, the Division of Criminal Justice, the Division on Civil Rights, and other law enforcement agencies worked together to educate all of our communities on how to report bias incidents, and to help law enforcement officers identify and respond to such incidents in a uniform and timely fashion. Although the recent spike may be due in part to this enhanced focus on public outreach and increased coordination, the alarmingly high total means we still have much work to do to ensure a safer New Jersey regardless of identity, group affiliation, or heritage. I am confident that all members of the Department of Law and Public Safety, along with local law enforcement, stand ready to face this moment with the professionalism, compassion, and integrity necessary to counter the forces of prejudice and dehumanization that still persist in our State. This year’s report sadly makes clear that the tide is still rising: The number of reported bias incidents in New Jersey jumped from 569 in 2018 to 994 in 2019. While that figure is staggering on its own, it is important to remember the profound human impact wrought by any act of bias, prejudice, or hate. Every time a student is harassed because of their national origin or gender identity, every time a racial slur is thrown, every time a person is demeaned, dehumanized, or excluded because of who they are, it inflicts immeasurable pain not only on individuals but on entire communities. We are living in a unique moment. In addition to a sharp increase in individual acts of interpersonal bias, especially against members of our Asian-American community, COVID-19 has exposed and exacerbated systemic inequalities in the United States. And the killings of Ahmaud Arbery, Breonna Taylor, and George Floyd laid bare our country’s continued struggle to address systemic racism. For all of these reasons, there is, rightfully, a renewed focus on rectifying systemic racism and other systemic biases that continue to plague our society. Both in this report and in the separate report released today by the Governor’s Interagency Task Force to Combat Youth Bias, the Division on Civil Rights strives for an honest accounting of the forces of bias, prejudice, and inequality that live on in New Jersey, both interpersonal and systemic. This report focuses on honestly cataloguing acts of interpersonal bias across our state. The Youth Bias Task Force report takes a broader view. After analyzing where bias and prejudice are learned, and our current efforts to address it, that report contains a comprehensive set of recommendations for how we can come together to build what Representative John Lewis called a “Beloved Community,” in which people “la[y] down the burdens of division” to “demand respect for human dignity” for all people. We hope that both reports together set New Jersey on the path of working together to ensure a future in which the humanity of all people in our State is celebrated. Introduction In 2019, there were 994 total reported bias incidents in New Jersey. That is, there were 994 acts reported to local law enforcement, and reported by local law enforcement to the State, as having been committed because of the victim’s actual or perceived race, religion, national origin or ethnicity, gender, sexual orientation, gender identity or expression, or disability. This represents an alarming 75% increase over the 569 total reported bias incidents in 2018, which itself comes after a 32% increase in the number of reported bias incidents from 2016 to 2017 and another 4% increase from 2017 to 2018. The tide of hate in New Jersey unfortunately continues to rise. In 2019, the wave of hate crested with the tragic murder of four innocent victims in Jersey City. On December 10, two shooters attacked a kosher grocery store in the city—the JC Kosher Supermarket— and murdered a police officer at the Bay View Cemetery. They killed Detective Joseph Seals of the Jersey City Police Department; supermarket owner Mindy Ferencz; Douglas Miguel Rodriguez, who worked at the supermarket; and rabbinical student Moshe Deutsch, who was shopping at the store. The attackers also injured two other law enforcement officers and another customer of the store, before they were killed in the ensuing shootout. This vicious attack on New Jersey’s Orthodox Jewish community and law enforcement was only one of the 994 bias incidents reported to law enforcement in 2019. 2019’s figures represent the highest total of bias incidents, and the largest year-over-year increase, since New Jersey began reporting bias incident data in 1994. This increase is extremely disturbing. Sadly, it is not surprising. Public displays of hate are rising around the country, and New Jersey’s reported bias incidents have been rising since 2015—from 2015 to 2019, there was a 171% increase in reported bias incidents. 1 Bias Incident Report 2017-2018 Bias Incident Report 2019 At least some of the rise in reported bias incidents from 2018 to 2019 likely reflects significant efforts by New Jersey’s law enforcement community to standardize their reporting practices, build trust with New Jersey’s most vulnerable populations, and ensure that all acts of bias reported to local law enforcement are immediately reported to the State.1 In 2019, New Jersey took significant steps to (1) raise awareness around the scourge of bias incidents; (2) build trust with affected communities to ensure bias incidents are reported to local law enforcement; (3) improve the ways local law enforcement agencies report those incidents to the State; and (4) train local law enforcement to ensure that all bias incidents that are reported to them are immediately reported to the State.2 To the extent that increased reporting is driving the rise, that is a sign that these efforts to tackle bias head-on are working. However, because the data captures only incidents that are reported to local law enforcement in the first place, the numbers will always remain under-inclusive: the statistics will never capture incidents that a resident did not report. Despite the State’s efforts to encourage victims of bias to report to local law enforcement, there remain many reasons that victims may not feel comfortable doing so.3 1. N.J. See id. at n.6 & Part II.B.2 & 3. 2 Bias Incident ReportReport 2017-2018 Bias Incident 2019 In a separate report released today, the New Jersey Interagency Task Force to Combat Youth Bias (Youth Bias Task Force), analyzes the root causes of hate, bias, and prejudice in New Jersey’s schools and universities and among New Jersey’s students and young adults.4 New Jersey’s children and young adults continue to make up a disproportionate number of both bias incident offenders and victims. New Jerseyans who are 25 years old or younger account for 57% of known bias incident offenders, and 48% of victims. Minors alone account for 46% of known bias incident offenders. The Task Force Report reviews existing laws, programs, and strategies intended to address bias, prejudice, stereotyping, and hate among young people. And it sets forth comprehensive recommendations on how to build a more equitable New Jersey for our State’s next generation. The work of the Youth Bias Task Force is a direct response to the 2017-2018 Bias Incident Report, which documented the dramatic increase in reported bias incidents between 2016 and 2018, and rendered visible the significant role that New Jersey’s children and young adults play in driving this rise in bias. The Youth Bias Task Force’s report also outlines additional steps the State can take to further improve reporting and ensure that all individuals victimized by bias in New Jersey feel comfortable reporting those incidents. Just as the important work of the Youth Bias Task Force began with the publication of the 2017-2018 Bias Incident Report, New Jersey’s efforts to prevent and combat bias must begin with increasing the visibility of the bias incidents experienced by its residents. The goal of this 2019 Bias Incident Report is to provide as accurate and complete an analysis as the data presently allows. 4. Defining Reported Bias Incidents A “bias incident” is any suspected or confirmed act of bias intimidation.5 Bias intimidation occurs when an enumerated offense, such as harassment, assault, terroristic threats, criminal mischief, arson, or homicide, is committed with the purpose to intimidate or with knowledge that the offense would intimidate an individual or group of individuals “because of race, color, religion, gender, disability, sexual orientation, gender identity or expression, national origin, or ethnicity.”6 The Attorney General’s Bias Incident Investigation Standards recognize that law enforcement must adopt a flexible approach when determining whether a reported incident constitutes a suspected or confirmed bias incident and, therefore, is reported as such. The standards acknowledge that “[s]ome suspected bias incidents may not clearly fit the described definition,” and direct law enforcement to use “a common sense approach” to ensure that “[i]f an incident appears to be bias-based, it [is] investigated and reported as such.”7 Thus, under the standards, “[v]erification of motive and intent” is to be made “during the ensuing investigation,” not before reporting the incident.8 The standards direct law enforcement to take a broad view of what conduct to report, because even when “a single bias incident may initially appear as less serious in the larger context of all crime … 5. Bias Incident Investigation Standards, supra note 5, at 3 (emphasis added). 4 Bias Incident ReportReport 2017-2018 Bias Incident 2019 any suspected or confirmed bias incident is serious by its very nature.”9 As the standards explain, “[w]hat may appear to be a minor incident can easily escalate into a larger problem or public safety concern.”10 In 2019, Attorney General Grewal made it a priority to ensure that law enforcement agencies at the local, county, and state level were effectively reporting bias incidents. Among other improvements, the Attorney General launched three major initiatives in this regard. First, in February of 2019, New Jersey State Police (NJSP) implemented a new Electronic Uniform Crime Reporting (eUCR) portal to facilitate centralized reporting of bias incidents by local law enforcement agencies to NJSP, the Division of Criminal Justice (DCJ), and other relevant state agencies in a highly effective and streamlined manner. Prior to the new portal, bias incidents were faxed or mailed into DCJ or NJSP in a process that was not standardized. Second, in April of 2019, Attorney General Grewal issued revised Bias Incident Investigation Standards, requiring all New Jersey law enforcement agencies to report all suspected or confirmed bias incidents within 24 hours using the eUCR portal.11 Under the prior standards, bias incidents were supposed to be reported by the following month. 8. Id. at 3. 5 Bias Incident Report 2017-2018 Bias Incident Report 2019 Third, throughout 2019, DCJ engaged in extensive training to educate all law enforcement officers at the local, county, and state levels on how to recognize, respond to, and report bias incidents. DCJ training underscored that the standards apply broadly to “bias incidents,” not just to conduct that is ultimately charged as a bias offense. To ensure that all bias incidents are reported by local law enforcement to the State, DCJ’s trainings encouraged local law enforcement to report any attempted or completed action that is motivated by bigotry and bias regarding a person’s real or perceived race, color, religion, gender, disability, sexual orientation, gender identity or expression, national origin, or ethnicity, not just actions that would constitute criminal offenses. Some portion of the dramatic increase in reported bias incidents in 2019 is likely a result of these three initiatives. With these initiatives, the Attorney General has set a clear tone that he takes bias incidents seriously, and expects every law enforcement officer in the State to do so as well. As a result of law enforcement’s renewed efforts, the data collected in 2019 likely represents a more complete accounting of bias incidents in New Jersey than data reported in previous years. Consistent with the Bias Incident Investigation Standards, the 994 bias incidents analyzed herein reflect all reported bias incidents, regardless of whether the underlying conduct was found to rise to the level of a chargeable offense. 6 Bias Incident ReportReport 2017-2018 Bias Incident 2019 III. Detailed Analysis of Reported Bias Incidents in New Jersey The data released today and analyzed in this report is based on bias incident reports submitted to the New Jersey Uniform Crime Reporting System in 2019 by every New Jersey law enforcement agency pursuant to New Jersey’s Bias Incident Investigation Standards.12 For comparison purposes, portions of this report also analyze data submitted to the New Jersey Uniform Crime Reporting System by every New Jersey law enforcement agency from 2006 through 2019, which is reflected in annual reports released by the New Jersey State Police for each of those years. As discussed above, there was a significant rise in bias incidents this year, to the highest number since New Jersey began reporting bias incidents in 1994. Bias Incidents by Type of Bias The reported motivations for reported bias incidents in New Jersey for 2019 were broken down as follows. Note that because a single bias incident can be motivated by two or more different kinds of bias (e.g., a person may be targeted because of their race and gender, or graffiti in a park can dehumanize people based on race and religion), the number of motivations exceeds the total number of bias incidents13: n Race, ethnicity, or ancestry accounts for 51% of the 1218 reported motivations (627 reported motivations); n Religion accounts for 34% of reported motivations (417 reported motivations); n Gender (which includes sex, gender identity, gender expression, and transgender status) or sexual orientation accounts for 14% of reported motivations (165 reported motivations); n Physical or mental disability accounts for slightly less than 1% of reported motivations (9 reported motivations). 13. The data for motivation (i.e., type of bias) for each reported bias incident in 2019 was collected and calculated differently than in previous years. Specifically, updates to the new UCR Repository that were implemented in January of 2019 enabled law enforcement, for the first time, to log up to five different motivations for any single bias incident. Previously, only one type of motivation could be listed per bias incident. This was a significant limitation, as bias incidents can frequently be motivated by multiple kinds of prejudice. For instance, a person who paints the letters KKK on a school may be motivated by both anti-Semitism and anti-Black racism. Accordingly, although there are 994 reported bias incidents in 2019, the number of reported motivations for those 994 incidents adds up to 1218. 8 Bias Incident ReportReport 2017-2018 Bias Incident 2019 Reported Motivations of Reported Bias Incidents in NJ, 2019 Religion 417 (34%) Disability 9 (1%) Race / Ethnicity 627 (51%) Gender / Sexual Orientation 165 (14%) As was the case for every year from 2006-2018, in 2019 Black people were once again the most frequent targets of raciallymotivated bias incidents. Overall, anti-Black racism was the reported motivation for a reported bias incident 371 times, accounting for 30% of all reported motivations in 2019. Also consistent with historical trends, Jewish people remained the religious group most frequently targeted in reported bias incidents in 2019. Specifically, anti-Jewish bias was the reported motivation for bias incidents 345 times in 2019, accounting for 28% of all reported motivations in 2019. Anti-Hispanic or Latinx14 bias was the most common reported motivation for reported bias incidents motivated by ethnicity. Anti-Hispanic or Latinx bias was the motivation for reported bias incidents 48 times. 14. The phrase “Latinx” is used to include all people residing in the United States who identify as of Latin American descent. The term “Hispanic” is used to include all people residing in the United States who identify as of Spanish-speaking descent. Although these two terms overlap significantly, they are not interchangeable, in that “Hispanic” does not include people who identify as from Brazil, Guyana, Suriname, or any other Latin American country in which the predominant language is not Spanish, and “Latinx” does not include people who identify as from Spain, Equatorial Guinea, or any other predominantly Spanish-speaking country outside of Latin America. Because the underlying data covers both anti-Hispanic and Latinx discrimination, this report uses both terms together. 9 Bias Incident Report 2017-2018 Bias Incident Report 2019 Anti-gay bias was the most frequently reported motivation for reported bias incidents motivated specifically by sexual orientation. Bias against gay males was reported as a motivation for a bias incident 73 times in 2019. The large number of reported bias incidents against the above groups of people are especially concerning. But due to the dramatic increase in reported bias incidents in 2019 compared to 2018, the number of incidents targeting nearly every group jumped as well. Gender and disability comprised only 3% and slightly less than 1% of reported motivations for bias incidents reported to law enforcement in 2019, accounting for 32 and 9 total reported incidents, respectively. Feedback received by the Youth Bias Task Force suggests that these numbers do not necessarily reflect an absence of incidents, but a series of barriers members of each community face to reporting. The State has begun to implement policies and engage in additional outreach to attempt to overcome these barriers and ensure that New Jerseyans are empowered to report bias incidents motivated by gender or disability. For example, in November 2019, the Attorney General issued a new directive to all state, county, and local law enforcement agencies that governs interactions with transgender individuals. Attorney General Directive 2019-3, known as the “LGBTQ Equality Directive,” is designed to ensure that all individuals are guaranteed safety and dignity in their encounters with law enforcement, regardless of their sexual orientation, gender identity, or gender expression.15 15. Bias Incidents by Offender & Offense Of the 386 known offenders in 2019: n 176 (46%) were minors; n 314 (81%) were male, 67 (17%) were female, and the gender of 5 offenders (1%) was unknown; n 306 (79%) were white, 40 (10%) were Black, 14 (4%) were Asian, 3 (1%) were Pacific Islander, 2 (0.5%) were multiple races, 1 (0.3%) was American Indian, and 20 (5%) were unknown. This is similar to the breakdowns for 2018. Of the 227 known offenders in 2018: n 105 (46%) were minors; n 179 (79%) were male and 48 (21%) were female; n 180 (79%) were white, 36 (16%) were Black, and 4 (2%) were Asian. Of the 4116 known offenders from 2006 to 2019: n 1566 (38%) were minors n 3051 (74%) were male and 1060 (26%) were female; n 3380 (82%) were white, 552 (13%) were Black, and 69 (2%) were Asian. In 2018, there were 244 harassment offenses and 212 intimidation and destruction/damage/vandalism offenses. In 2019, there were 421 harassment offenses and 409 intimidation and destruction/ damage/vandalism offenses. Thus, although the total number of reported bias incidents increased substantially, the ratios of types of offenses remained relatively stable. 11 Bias Incident Report 2017-2018 Bias Incident Report 2019 C. Bias Incidents by and Against Students and Minors In 2019, more bias incidents were reported in elementary and secondary schools than in any other location. In fact, almost onequarter of reported bias incidents (245 out of 994) occurred at elementary and secondary schools, which is consistent with 2018. Although this represents a nearly 78% increase over 2018, when 138 reported bias incidents occurred in elementary and secondary schools, school-based incidents continue to account for nearly one-quarter of all reported bias incidents (24.6% of reported bias incidents in 2019 and 24.2% in 2018). Bias incidents in colleges and universities make up a slightly smaller percentage of all incidents than they did in 2018. In 2019, 48 bias incidents were reported in colleges and universities, accounting for 5% of all reported bias incidents. In 2018, they accounted for 7%.16 In addition, the data makes clear that young people continue to make up a disproportionate share of offenders and victims of reported bias incidents. The 2017-2018 Bias Incident Report highlighted this, and those disturbing statistics led to the creation of the Youth Bias Task Force, whose report is also being released today. In 2019, 218 out of the 386 known offenders (56%) were age 25 or younger, and 176 of the 386 known offenders (46%) were minors (age 17 or younger). Although this represents a 68% increase over 2018, when 105 of the known offenders were minors, the proportion of all known offenders who are age 17 or younger remained constant at 46%. 16. In 2018, 177 of the 569 reported bias incidents (31%) occurred in schools, colleges, or universities. Of those 177, 39 reported bias incidents occurred at a college or university, while 138 occurred at an elementary or secondary school. The 2017-2018 Bias Incident Report reported that 145 reported bias incidents occurred at a college or university and that 32 such incidents occurred at an elementary or secondary school in 2018. See 2017-2018 Bias Incident Report at 10. However, a subsequent manual audit of the New Jersey’s Uniform Crime Reporting system revealed that some 2017-2018 data from elementary and secondary schools had been erroneously coded as having occurred at colleges and universities. This discrepancy in the data has since been corrected pursuant to the results of the manual audit, and the numbers reported herein are consistent with the results of that audit. 12 Bias Incident ReportReport 2017-2018 Bias Incident 2019 In 2019, 294 of the 822 individual victims of bias offenses were minors (36%). Between 2006 and 2019, minors comprised nearly 30% of the victims of bias incidents. And factoring in all young people, nearly half of all victims of reported bias incidents in 2019 (397 out of 822, or just over 48%), were age 25 or younger. These statistics illustrate that young people are inextricably connected with the rise in hate discussed in this bias incident report. Bias Incidents by County The increase from 2018 to 2019 in total number of reported bias incidents is also reflected in the county-specific data. From 2018 to 2019, all but one county reported an increase in the number of reported bias incidents; only Gloucester County reported a decrease (from 26 reported bias incidents in 2018, to 22 in 2019). Cumberland and Cape May Counties had the largest proportional increase in 2019 compared to 2018. The number of reported bias incidents in Cumberland County more than tripled (14 in 2018 to 44 in 2019), while the number of reported bias incidents in Cape May County multiplied by 7, from 2 in 2018 to 14 in 2019. Eleven counties had more than one reported bias incident per 10,000 residents in 2019: Bergen, Burlington, Camden, Cape May, Cumberland, Mercer, Middlesex, Monmouth, Morris, Ocean, and Passaic. By comparison, only three counties had more than one reported bias incident per 10,000 residents in 2018. Under the Bias Incident Investigation Standards, it is expected that not all reported incidents will result in arrests. Since bias incidents encompass both suspected and confirmed bias offenses, conduct may be reportable as a bias incident even if, upon further investigation, authorities determine it does not rise to the level of a chargeable offense. This broader definition enables law enforcement to identify concerning conduct that could escalate into a larger public safety concern, and provides data that can be used by the State to target anti-bias initiatives where they are most needed. Additionally, conduct that does not rise to the level of a criminal offense may still violate other New Jersey laws, such as the New Jersey Law Against Discrimination. 17 Bias Incident Report 2017-2018 Bias Incident Report 2019 IV. Conclusion As detailed in this report, bias incidents in New Jersey—whether motivated by race, ethnicity, religion, gender, sexual orientation, gender identity or expression, or disability— have been on the rise since 2015. This year’s increase likely indicates both that more bias incidents actually occurred in 2019 than in prior years, and also that bias incidents that occurred in 2019 were reported to law enforcement at higher rates than in prior years. In any event, the goal of this report is to document New Jersey’s bias incidents as accurately and completely as possible, and to lay bare the impact of hate and dehumanization in our State. As we noted in the 2017-2018 Bias Incident Report, addressing the rise in hate, bias and prejudice requires a clear understanding of where we have been and where we are today.18 This report seeks to provide a clear accounting of where we are today. The State Police and Division on Civil Rights join the other members of the Youth Bias Task Force in issuing today’s Youth Bias Task Force report and recommendations to the Governor and the Attorney General. The report outlines a vision for how New Jersey can best address hate, bias, and prejudice moving forward.
