1 Introduced by Council Member Dennis: 2 3 4 ORDINANCE 2020-620 5 AN ORDINANCE CREATING A NEW PART 1 (POSSESSION 6 OF 7 PARAPHERNALIA), CHAPTER 606 (DRUGS), ORDINANCE 8 CODE, TO CREATE A CIVIL CITATION WITHIN THE CITY 9 OF JACKSONVILLE ORDINANCE CODE FOR POSSESSION OF 10 20 GRAMS OR LESS OF CANNABIS OR PARAPHERNALIA; 11 AMENDING SECTION 609.109 (APPLICABLE CHAPTERS 12 AND 13 CITATIONS), ORDINANCE CODE, TO ESTABLISH NEW 14 CLASS FINES IN SCHEDULE “A” FOR VIOLATIONS OF 15 PART 1 (POSSESSION OF TWENTY GRAMS OR LESS OF 16 CANNABIS OR PARAPHERNALIA), CHAPTER 606 (DRUGS), 17 ORDINANCE 18 PROVIDING AN EFFECTIVE DATE. TWENTY GRAMS PARTS), OR CHAPTER CODE; LESS 609 PROVIDING OF (CODE FOR CANNABIS OR ENFORCEMENT SEVERABILITY; 19 20 BE IT ORDAINED by the Council of the City of Jacksonville: 21 Section 1. Creating a New Part 1 (Possession of Twenty 22 Grams or Less of Cannabis or Paraphernalia), Chapter 606 (Drugs), 23 Ordinance Code. A new Part 1 (Possession of Twenty Grams or Less of 24 Cannabis or Paraphernalia), Chapter 606 (Drugs), Ordinance Code, is 25 hereby created to read as follows: 26 27 28 CHAPTER 606. DRUGS PART 1. POSSESSION OF TWENTY GRAMS OR LESS OF CANNABIS OR PARAPHERNALIA 29 Sec. 606.101. - Applicability. This part shall be applicable 30 within the City of Jacksonville. Nothing herein provided is intended 31 to create a civil citation for the legal possession of cannabis 1 (marijuana) for the medical use as defined and permitted by Section 2 29 of the Florida Constitution or as otherwise permitted by Florida 3 law. 4 Sec. 606.102. - Definitions. 5 As 6 intended: used in this part, unless some other meaning is plainly 7 Cannabis means all parts of any plant of the genus Cannabis, 8 whether growing or not; the seeds thereof; the resin extracted from 9 any part of the plant; and every compound, manufacture, salt, 10 derivative, mixture, or preparation of the plant or its seeds or 11 resin. 12 in Section 381.986, Florida Statutes, if manufactured, possessed, 13 sold, purchased, delivered, distributed, or dispensed, in conformance 14 with Section 381.986, Florida Statutes; “hemp” as defined in Section 15 581.217, Florida Statutes, or “industrial hemp” as defined in Section 16 1004.4473, Florida Statutes. 17 18 Law This term does not include: "low-THC cannabis," as defined Enforcement Officer means a member of the Jacksonville Sheriff’s Office (JSO). 19 Paraphernalia means any object used, intended for use, or designed 20 for use, in ingesting, inhaling, smoking, or otherwise introducing 21 cannabis into the human body. 22 23 Sec.606.103. – Violations. (a) Any person, 18 years old or older, who possesses 20 grams or 24 less of cannabis as defined herein except as otherwise 25 authorized by law commits a violation of this Part. 26 (b) Any person, 18 years old or older, who possesses paraphernalia 27 as defined herein except as otherwise authorized by law 28 commits a violation of this Part. 29 (c) For purposes of this section, a person charged with possession 30 of cannabis under subsection (a) may not be charged with 31 possession of paraphernalia under subsection (b) arising out - 2 - 1 2 3 of the same incident. Sec. 606.104. – Enforcement and Penalties.
