The owners of Omega Appliances and FC Locksmith, Eran Gurvich and Ilay Avnin, responded to CBC Marketplace via their legal representative, Mr Jonathan Weingarten. Below is an edited summary of Mr Weingarten’s correspondence with CBC Marketplace: Sept 23, 2020 Omega Appliances is an Operating business providing services in various locations while hiring local appliance service providers who are being fully paid. By hiring local appliance service providers in all locations, the customer and the service provider, both from same community, benefit and contribute to the well-being of the local residents. Omega Appliances is not directly involved in its marketing and promotions but hires external professional corporations to promote its services through various public media websites, as done by abundance of corporations around the globe. The methods of promotions and advertising employed by the external professional corporations are within those professional corporations’ expertise only, and Omega has no bearing on those methods and are not expected to be involved in any promotions and advertising. Omega has never created on its own fake locations since those are part and parcel of the external professional corporations’ services in promoting Omega and advertising its services. Any customer complaints are treated with all attention and respect and on many occasions, even when the complaint is found to be unjustified, the customer is fully refunded the cost of the services. Omega appliances , at large, has incredibly positive reviews and as any other service provider, cannot avoid less favorable reviews, many of which come from competitors. My clients would have stood to defend their position by way of interview with CBC but it is apparent that CBC, by virtue of its full control over all material pertaining to this matter, will be selective and unobjective in its Market Place program while revealing to the public disproportionate information in support of its purpose to undermine Omega Appliances productive services and contributions to the community as reflected in so many positive reviews. Further to your email dated September 23, 2020 please find the following response which is served as supplementary to my client’s response dated September 22, 2020. Oct 2, 2020 The companies hired to advertise and promote Omega Appliances as well as FC Lock Smith are not necessarily same companies since each business involves different methods of advertising and promotions, separate locations, and diverse prospective clientele. The realm of online business promotion is highly sophisticated and could only be delivered by experts who are up to all recent trends, technology, consumer psychology, all of which require 24/7 expertise and experience. My clients are not IT experts and have never purported to present themselves as such but confine their duties to the management of the operational aspects of the corporations. The quotes you have referred to as from Eran Gurvich complimenting Ilay Avnin should be read in the context of the Podcast it was delivered. Ilay Avnin takes care of the advertising in the sense of searching for the most suitable and appropriate website launching companies, promotion experts and advertising specialists as well as the right web platform to market the companies. All the mentioned professional operators are not necessarily the same and moreover, as mentioned above, not specifically for both FC Locksmith and Omega Appliances. When Mr. Gurvich does refer in the podcast and boasts about Mr. Avnin involvement in advertising, it is in reference to his knowledge in locating the right experts in all mentioned fields but not the methodology and precise content which, as reiterated, requires a different level of knowledge, experience, and expertise. Ilay Avnin understanding in Google Campaigns and supposedly making “the phone ring” is far from designating him as an expert and expecting him to have either the means and/or the technology to handle all advertising and promotions of the companies in 2020. Should be noted that most of the locksmith and appliance services around the world are mobile and not done in a specific store. Therefore, the true relevance of quality of service to clients is not the location of the business but the location of the service, which is at the clientele homes, all performed by local professionals and thereby serving the same local community from both ends, hence, the recipient of the service and the provider of the service. In order to serve the public with an objective, unbiased and true report on my clients and their named companies, it would be expected from CBC Marketplace to present to the viewers a comprehensive overview of many of the positive reviews unless CBC Marketplace may establish with clear proof that those positive reviews are not only fake but posted directly by my clients. Needless to mention, prime purpose of reviews is to reflect the service provided and not the location of the store. The services provided by my client’s are by their very nature, provided at clients’ doorstep by a local professional. It would be reasonable and fair to expect from CBC Marketplace to present to the viewers an unbiased and balanced program as to my clients companies’ affairs, and not as a prime objective, the alleged detrimental materials as was aired in the past episode per FC Locksmith which has broadcasted only a short segment from the undersigned full response on behalf of his clients, all in name of “objectivity” and fair response”, both which were clearly non existent. CBC Marketplace is most welcome to show to the public FC Locksmith many hundreds (and nothing but) great reviews on Homestars, instead of reflecting on Omega Appliances few complaints on BBB, all of which were resolved. Showing several complaints while ignoring far more satisfied customers as reflected in the reviews is nothing but misleading and a tendentious approach to serve the objectives of CBC Marketplace at the expense and reputation of my clients. Moreover, when CBC Marketplace chooses to refer to a single negative review of a complaint by a customer, one out of so many very good reviews, CBC Marketplace deliberately refrains from inquiring or publishing the fact that the specific client had been fully refunded regardless of the truthfulness of the negative review. CBC Marketplace should reflect on my clients’ major contributions to the Canadian Society. My clients, immigrants who came to Canada empty handed have built their way up with hard work and dedication through their integrity and honesty which are their signatures. My clients have never ever breached the law and have always treated their clients with great respect. FC locksmith won the prestigious “Best of 2019“ in Homestars due to hard work and dedication. Almost every complaining customer who is not 100% satisfied gets a refund or any other solution to their absolute satisfaction. My client’s reputation is extremely important to them and they will not permit any biased and unobjective presentations to the public at large. My clients educate their employees to adopt professional, honest and accommodating business culture and support the employees all the way. During COVID 19 my clients have not laid off a single employee regardless of unexpected losses associated with the Pandemic. My client’s businesses enormously support many Canadian families and the Canadian economy by hiring locals and by investing in Canadian products and businesses. My clients provide at no charge charity services on a regular basis, donate money to local and foreign entities and support individuals daily with guidance, advice, financial aid, business solutions, voluntary work etc. In relation to CBC Marketplace request for an interview, see response as follows: Mr. Gurvich and Mr. Avnin cannot accept such an invitation where CBC Marketplace is in full control of all materials to be broadcasted in the episode and is most likely to show segments of the interview which will be most effective to serve the purpose of the episode which is to portray a harmful image of them and their companies, as opposed to exposing the public to the whole interview. Its all in CBC control and having the subjects interviewed will supposedly portrait CBC Marketplace as if it had provided equal opportunity to balance the damaging image of my clients and their corporation. To sum things up, it is a zero-sum game whereby CBC has it all, it sets the rules, it is the adjudicator as well as the executor of the broadcasted episode all in its home field.
