Republican National Committee Counsel’s Office November 1, 2020 VIA EMAIL: Cliff.Li@asian.gop Mr. Cliff Li “National Committee of Asian American Republicans” “Asian.GOP” “Asian.GOP PAC” 910 17th Street, NW Eighth Floor Washington, D.C. 20006 Re: Demand for Immediate Cease and Desist of Unauthorized Use of Trademarked Republican Logo Mr. Li: It has come to the Republican National Committee’s (“RNC”) attention that you, and the abovelisted organizations which you control, are using a registered trademark of the RNC without authorization and in violation of the RNC’s intellectual property rights. Your website, “Asian.GOP,” uses a trademark which is confusingly similar to the RNC’s Official Elephant Logo (Federal Trademark Registration Number 1908397). Neither you nor your organizations are authorized by or affiliated with the Republican Party in any way, nor are you authorized to use the RNC’s trademarked logo. Your unauthorized use is deceptive and is likely to lead individuals to believe that the RNC has authorized, sponsored, approved, endorsed, or provided financial support to you or the above-listed groups, which it emphatically has not. This is especially troubling, given that you appear to be actively working against the RNC’s interests. While falsely purporting to represent Asian-American Republicans, as well as soliciting funds, your website endorses Joe Biden’s candidacy for President. Meanwhile, your recent interview with a Chinese Communist Party-controlled media outlet leaves little doubt about your own motives or which American candidate the Chinese Communist Party prefers. The RNC vigorously defends its intellectual property rights. Accordingly, the RNC demands that you and the above-listed organizations: (1) immediately cease and desist from any use of the “Asian.GOP” elephant logo or any other mark that is confusingly similar to the RNC’s Official Elephant Logo; and (2) refrain from claiming or otherwise suggesting that you or your organizations are in any way affiliated with, authorized by, or representative of the Republican Party or any Republican candidate or committee. The RNC takes such violations seriously and will pursue all available legal remedies at its disposal if such activity does not cease immediately. To indicate your agreement to these terms, you must provide the RNC with prompt written confirmation of the same by signing the enclosed agreement and returning the signed version to me, by mail, email, or fax. In view of the urgency of the matter, the RNC requires your response no later than 5:00pm EST on Friday, November 13. Sincerely, J. Justin Riemer Chief Counsel, RNC Page 2 of 3 * * * * AGREEMENT TO CEASE AND DESIST I, Cliff Li, a duly authorized representative of the National Committee of Asian American Republicans, Asian.GOP, and Asian.GOP PAC, do hereby agree to: (1) immediately cease and desist from using the “Asian.GOP” elephant logo or any other mark that is confusingly similar to the RNC-trademarked Official Elephant Logo; and (2) refrain from claiming or otherwise suggesting that I or the above-referenced organizations are in any way affiliated with, authorized by, or representative of the Republican Party or any Republican candidate or committee.
