. i DoAVA KAY AVALOS was interviewed at the Portland office of the Federal Bureau of Investigation (FBI) from October 7-21, 1985, on an intermittent basis. She was interviewed pursuant to alleged criminal activity which had occurred at Rajneeshpuram, Oregon, and was interviewed based upon an immunity agreement arranged between her attorney, TOMMY HAWK, and numerous District Attorneys, the Attorney General of the State of Oregon, and the United States (U.S.) Attorney for the District of Oregon. Present during the interview were Special Agents PAUL H. HUDSON and H. HADLEY MC CANN of the Portland Division; MARLEN HEIN, oregon State Police; Investigator ROBERT GREENE, Department of Justice; and her attorney, TOMMY HAWK. On December 7, 1979, AVA meet BHAGWAN personally and became a Sannyasin. AVA returned to the University of California, Berkeley, during the spring of 1980 where she attended one additional quarter. During that period of time, she was employed as'a secretary by an architectural firm in San Francisco. In March or April of 1981, AVA moved to southern California and became involved with Utsava Rajneesh Meditation Center in Laguna Beach, California. Approximately 16 months later, she attended the festival of Rajneeshpuram and was invited to stay at the ranch.% From the time of the festival in July of 1982, to November of 1982, AVA was a guest at the ranch. In November of 1982, she became a full commune member. Her first six months at the ranch, she was assigned to work as a typist. In late November, the commune asked for volunteers to rotate into Portland to run a disco that would be opening in December. AVA volunteered, and began working as a cook and then bartender at the Portland disco. "Portland rotators" usually spend three to four weeks in Portland and then returned to the ranch for two weeks. In June of 1983, she took a post at Hotel Rajneesh in Portland as Manager. In July of 1983, the hotel suffered a bomb explosion, and as a result, security at the hotel was dras~ tically increased. AVA indicated that people were searched routinely, and that she was personally responsible for organizing a good deal of security at the hotel. AVA indicated that at that time MA YOGA VIDYA, President of Rajneesh Neo~Sannyas International Commune, was her Coordinator (or Supervisor). Attention was drawn to AVA and the work she had accomplished. It was during this period that AVA first became personally acquainted with the top ranch administrators. AVA soon replaced MA MAHIMO, who, at the time, was having personal conflicts with PUJA. was feared and disliked by personnel AVA observed that PUJA at RMC, which included the physicians. PUJA behaved as a tyrant. The medical center was a very serious and unhappy place to work according to AVA. She indicated that she talked to VIDYA about the conditions at RMC, and that people feared and disliked PUJA. As a result of AVA's conversation, VIDYA addressed the RMC staff and told them to get along with PUJA and to "drop" being afraid of her. After discussions, everyone at the get along with PUJA. AVA commented that PUJA's power clinic agreed to try to over the doctors was significant, and that her decisions (even-medical diagnosis) were final. In late February of 1984, during one of AVA's rota~ tions as Manager in Portland, she was contacted by MA BARKHA. BARKHA discussed a meeting she had attended, which had been called by SHEELA. BARKHA explained that a special security team was being formed to increase protection for BHAGWAN. The meeting was attended by 24 ranch coordinators, who SHEELA felt were "ready to give their lives in order to protect This special security force was set up and received special training in various weapons. AVA believed that the power struggle began in India where DEVARAJ was BHAGWAN's personal physician, a position which PUJA coveted. A review of everything that DEVARAJ ordered medically for BHAGWAN had to be passed through RMC and get PUJA's approval. No matter how simple or straight forward DEVARAJ's purchases or requests might be, PUJA questioned every~ thing that DEVARAJ did. This would irate DEVARAJ, and the gap that existed between the two groups continued to widen. When AVA mentioned to SHEELA that she felt this situation should be sorted out, SHEELA explained that actually DEVARAJ was ex- perimenting with BHAGWAN's body without BHAGWAN's knowledge. SHEELA expressed her frustration over the situation, and that BHAGWAN trusted DEVARAJ and wanted him to remain his physician, while DEVARAJ continued to experiment with, and jeopardize/ BHAGWAN health . AVA advised that there was a power struggle between Jesus Grove (a residential area in Rajneeshpuram) and Lao Tzu Mohamed Grove. Lao Tzu is the residence of BHAGWAN and his personal staff, Mohamed Grove is a residential area where a group commonly referred to as "The Hollywood Gang" lived. The residents of Lao Tzu and Mohamed were friendly toward each other, however, neither of these two groups got along with the people at Jesus Grove. AVA indicated that RMC became a tool used against the residents of Lao Tzu and Mohamed in this power struggle. AVA indicated that normally anyone becoming ill and needing to rest was sent to Koran Grove. Those persons were to spend a period of time at Koran Grove, in isolation, until they were well enough to return to work. Koran Grove discouraged anyone from taking time off from work due to illness. However, PUJA personally cared for, and looked after the residents of Jesus Grove, dispensing her own medications and drugs to those patients and rarely sent them to Koran Grove to be treated like everyone else. In the spring of 1984, MA PREM HASYA (DEVARAJ's wife) suffered a neck injury which DEVARAJ treated. DEVARAJ contacted a chiropractor at RMC and asked for a neck brace for HASYA. PUJA found out about DEVARAJ's request and demanded that HASYA go to Koran Grove. It angered HASYA that she had to go to Koran Grove, but she did comply. AVA pointed out that HASYA is an extremely wealthy person, and that for her to go to Koran Grove would be a very demeaning experience for her and, more importantly, it was medically unnecessary. This episode forced AVA to again ask SHEELA what could be done about these factions that existed on the ranch. SHEELA told AVA that the people at Lao Tzu, HASYA and her friends, could not be trusted. SHEELA presented arguments to establish that and convinced AVA. SHEELA also played a tape of a conversation between DEVARAJ and his wife, HASYA, in which they discussed the Jesus Grove people. HASYA was mad at the time about having to go to Koran Grove. AVA stated that because of this tape, and SHEELA's arguments, she was completely won over to the side of SHEELA and Jesus Grove. AVA stated that she did not realize at the time that the conversation between DEVARAJ and HASYA had been obtained through wiretapping (telephonic), but she added that this would have been the first indication that she had that wiretapping was occurring at the ranch. AVA commented that while HASYA was in Koran Grove, she developed conjunctivitis and was placed in isolation. PUJA immediately called for all of the Lao Tzu residents to be tested and set the protocol so stiff that most of the people from Lao Tzu were put into isolation. Because of the protocol, many people from Jesus Grove were also put into isolation. AVA commented that it was almost humorous in_a way because these two groups were put into the same small trailer, and right away arguments raged over who could better take care of BHAGWAN. AVA remembered writing a letter to BHAGWAN about these arguments, and when SHEELA read the letter, she refused to take it into him. During the spring of 1984, a plan was contrived by SHEELA to remove DEVARAJ as BHAGWAN's physician. The plan was to make DEVARAJ sick so that he would have to be hospitalized long enough to allow SHEELA to replace him with a physician of her chosing as BHAGWAN's doctor. AVA indicated that there was no specific meeting in which this plan was discussed but rather just a general acceptance. AVA stated that the plan was initiated when DEVARAJ came to Koran Grove, and someone (believed to be PUJA) put Dulcolax into his coffee (Dulcolax is a strong laxative and, as with any laxative, causes abdominal pain and diarrhea.). AVA stated that DEVARAJ may have had other beverages in other locations contaminated during the same period of time. DEVARAJ became ill, and everyone began to comment on how sick he looked. A couple of days after drinking the contaminated coffee at Koran Grove, DEVARAJ entered Koran Grove as a patient. Very early on during DEVARAJ's stay at 5 I/r PD 250page Koran Grove, PUJA handed AVA a small envelope containing what she.belieVed to be crushed Dulcolax pill(s) making a yellow powder. PUJA told AVA to put the yellow powder into DEVARAJ's breakfast. AVA was the Coordinator for RMC at the time and had free access to the kitchen area. AVA went to the kitchen and put the powder into DEVARAJ's oatmeal. AVA did not know who delivered the oatmeal to DEVARAJ or if he ate it. PUJA had DEVARAJ administered an I.V. due to his dehydrated con~ dition. AVA did not know what the IV contained. AVA stated that the day after putting the yellow powder~into DEVARAJ's oatmeal, she entered Koran Grove during the morning and found that DEVARAJ had become very ill and had been coded (emergency life saving treatment). AVA Observed that PUJA was frantically trying to help DEVARAJ, and that Doctor SHUNYO had "freaked out," and that the emergency crash cart had been called. AVA stated that DEVARAJ's blood pressure was very low. Sometime after DEVARAJ's recovery from this emergency situation, AVA was told by PUJA that she (PUJA) had injected contaminated water into DBVARAJ's I.V. PUJA told AVA that she used "flower water." AVA thought that PUJA meant i that she obtained the water from a flower vase. PUJA told AVA that she simply wanted to make DEVARAJ sick and cause an infection. The thought behind causing an infection was that if a person is infectious, they could not be near the BHAGWAN. AVA stated it was not PUJA's intent to kill DEVARAJ but rather just to make him sick. DEVARAJ recovered from the incident and was released from Koran Grove. AVA stated that in August of 1984, around the time of the third festival, she was assigned to assist Doctor DEVAM (a at RMC) with mentally unstable persons attending the festival. AVA commented that it was never said that the Share-A-Home people were actually being brought in to register to vote to win the election, but it was obvious to persons close to SHEELA (the inner~circle) that this was the purpose. AVA 6 PD 250-3 Conlinualion ol F0302 ol ,On Page commented that the interest of the commune did not include humanitarian interests, and that no one had ever heard BHAGWAN indicate he had any desire to take care of the poor. AVA commented that the first two busloads of "derelicts" arrived from New York. She recalls that aboard the bus she encountered one case of AIDS, bronchitis, rashes, venereal disease, mental problems, and other diseases. She stated that buses kept coming, and that some of the men arriving were violent. AVA indicated that the medical problems that were encountered because of the influx of "street people" were overwhelming. AVA commented that the commune's medical facilities were not capable of caring for the numbers of medical problems that were arriving on a daily basis. AVA was coordinating the medical clinic at this time and rarely received help from PUJA who was con- tinually with SHEELA in meetings of one kind or another. AVA used as an example, an incident involving a street person by the name of DEREK. DEREK was an individual who was extremely violent and mentally ill. At one time, DEREK punched out a window in the dorm he was staying at. DEREK was liked by VIDYA, and she had him brought to the medical clinic. While at the clinic, DEREK started to break up furniture and get extremely violent. VIDYA had to come to the clinic to calm DEREK down, and DEREK asked to see SHEELA. SHEELA spoke to DEREK on the phone, and after the conversation, ordered AVA to put DEREK on the RMC staff and rehabilitate him. AVA commented that this was not a realistic order. Sometime later, DEREK was in the area between Jesus Grove and_Nagarjuna. AVA received a phone call saying DEREK had tore off a phone from a wall and was harassing people in the area. AVA responded to take care of DEREK. Upon arrival, she observed DEREK swinging a chair. AVA managed to calm DEREK down and sat with him on a bench engaging him in conversation. During the conversation, AVA mentioned the term "police," and DEREK went "crazy," throwing rocks and screaming at AVA. He then started to stop traffic in the area, pulling people out of cars and throwing them on the ground. The armed Peace Force arrived but could do little to control DEREK who was like a maniac. AVA went to Nagarjuna, and DEREK followed her in, threatening to hit her with a.rock he had in his other hand. DEREK was demanding to see VIDYA. SHEELA arrived instead and asked DEREK what was wrong., At that point, DEREK started to strangle SHEELA. AVA commented that more violent scenes went on for hours, before PUJA convinced DEREK to drink some water. AVA stated PUJA had spiked the water, and DEREK was sedated enough to be put on a bus going out of the ranch. Later, AVA was made to believe by VIDYA and SHEELA that she was responsible for the incident with DEREK because she did not keep him under control. This bothered AVA a great deal, and she was extremely frustrated by these situations. AVA stated that RMC was overwhelmed by the number of sick people coming onto the ranch. She commented about one evening when she observed a woman that had breast cancer laying across her bed hardly breathing. The woman, who was turning blue, had no one to take care of her the way she needed. She was sent to a hospital in Madras and later returned to Chicago where she died. AVA stated that PUJA explained that the reason Haldol was used was because it had no taste. When AVA heard of the idea to put Haldol into the beer, she objected and told SHEELA and PUJA, in conversation, that she did not feel everyone should be PD 250~3 Continuation _Page 9 tranquilized. The large use of Haldol became known to the news media from a leak made by an employee of a Haldol distributor. Questions were raised about the use of Haldol, not only by the press, but also the State Board of Pharmacy. The State Board of Pharmacy required that RMC provide records on the use of the Haldol. AVA commented that because PUJA had ordered the Haldol herself, the ranch pharmacy was not even aware of the existence of the large amount of Haldol on the ranch. AVA stated that PUJA created false medical records to justify the amount of Haldol used at the commune. PUJA created these records with the assistance of AVA, PUJA and DEVAM sat up all Doctor DEVAM. According to night fabricating the records, DEVAM objected to doing this, but PUJA and AVA convinced him that the Haldol had been used in order to maintain control of Very violent situations. DEVAM did not know the Haldol had been used in the beer. The records did not give names and only indicated false physical descriptions, false illnesses, and false doses of Haldol being administered. These fabricated records were later sent to the State Board of Pharmacy. AVA stated that PUJA was supposed to the back-up information on records sent to the State Board of Pharmacy, She failed to do this, and after an amount of time passed, the need for that back-up information occurred. VIDYA found out that PUJA did not take the steps to create the back-up information and got extremely upset and angry at PUJA. VIDYA told AVA to get the back~up information and to assemble records that would justive the re~ cords sent to the State Board of Pharmacy. MANOHAR told AVA that she still had the file at her residence and asked AVA what she should do with it. AVA instructed her just to simply hold on to it. AVA indicated that technically the file belongs to RMC. AVA stated that during the Share-A~Home Program, an incident occurred in October of 1984, involving a person by the name of FELTON WALKER. AVA stated that she was con- tacted by PUJA in the evening and told to clear Pythagoras of any people by about 7:00 which AVA did. Soon after 7:00 PUJA arrived and told AVA to go to SU's A-frame at Jesus Grove and pick up two men (AVA believes one of these men was SWAMI DIPAK, the other she does not remember.) and to go to Walt Whitman and pick up FELTON WALKER. The three arrived at WALKER's A-frame, and AVA explained to WALKER and his roommate that their third roommate had tested positive for tuberculosis, and that they both had to come to Pythagoras immediately to get tested. The two agreed and were driven to Pythagoras. AVA stated that the men were taken to PUJA. PUJA examined WALKER's roommate and then dismissed him. WALKER was then examined by PUJA and given an injection which put him to sleep. About this same time, the following people arrived at Pythagoras: SHEELA, JULIAN, DIPO, K.D., GATHA, SAVITA, ANUGITEN, and VIDYA, While WALKER was asleep, GATHA (a licensed physician in the State of Washington) injected WALKER with Sodium Pentathol (truth serum). The group gathered around WALKER on the examination table. WALKER was then slapped on the face to wake him up by ANUGITEN with K.D. assisting. In his delirious state, WALKER was played a tape recording of a telephone conversation between WALKER and someone in Seattle, Washington (WALKER had placed a PD 250-3 Continuation of FD302 of AVA KAY AVALOS on 10/7-21/85 Pme ll call from a pay phone at the ranch.). The tape recording indicated that WALKER had talked of a plan to kill BHAGWAN and'referred to the person who he was talking to in Seattle as "father," AVA commented that WALKER and "father" talked in code. AVA stated that the WALKER tape was played for the 38 members of the special security force at a later date, probably within the month. ANUGITEN and K.D. continued to wake WALKER up and interrogate him about who "father" was and about the plot to kill BHAGWAN. WALKER was allowed to sleep and then awakened repeatedly and re-questioned. AVA stated that this continued on through the night until approxi- mately 3:00 a.m. AVA stated that nothing was learned from WALKER during this interrogation. SHEELA and PUJA told AVA that WALKER was to be her responsibility. PUJA had WALKER put into the clinic and prescribed AVA stated first day, she wanted being kept a massive dose of Valium to be given intravenously. WALKER was kept drugged for three days. After the AVA stated she contacted SHEELA and asked her what done with WALKER, pointing out to her that he was drugged. AVA stated SHEELA wanted him kept that way. AVA kept coming back to SHEELA and, finally on the third day, SHEELA gave permission to revive and release WALKER. PUJA created a fake file for WALKER which indicated that he was it treated for a'heardfcondition (AVA recalled it involving migrating platlets). Doctor DEVAM signed a letter (medical records) indicating that WALKER was treated for`a heart dis- ease. AVA commented that Doctor DEVAM has since left the ranch and is believed to be residing in the Santa Rosa, California area. AVA felt DEVAM's departure was due to his having awdkr4@ pakp/ 9? false entries on medical records. AVA also mentioned another street person by the name of WILLIAM ALLEN. AVA commented that this was the street person that was found dead in the area of Government Camp and died of exposure and drug overdose. AVA stated that she was familiar with ALLEN, and that ALLEN was a but non-violent. She stated that his death occurred sometime between September and October of 1984. AVALOS commented that ALLEN would pretend to be smoking or drinking, and that he had a condition which she described as a split with reality. She considered him ex- tremely mentally ill. AVALOS recalls being called to Desiderada and being told that someone was "freaking out." AVALOS believes, although not certain, that she was accompanied by Doctor SHUNYO, Doctor MEGHA, and DOCTOR PRAGITAN. AVALOS Stated that ALLEN was inside the tent carrying on and yelling but was not violent. ALLEN was carried to a medical trailer and given anti-depressant rm/ PD 250-3 ccnunuanon of AVM05 ,medication. The following night, AVALOS went to see ALLEN, and_he appeared to be in good health but did not want to take his medication. AVALOS commented that the next thing she heard about ALLEN (within a day or two of visiting him) is that he had been given a bus ticket back to where he came from. AVALOS commented that because of the expense and overcrowding at RMC, it was a general rule that if any of the street people were really sick, they would get a ticket back to where they came from. AVALOS heard that ALLEN was found dead in Government Camp and died of exposure and drug overdose. She commented that this would have occurred within.a day or two of her last visit with him. AVALOS also commented that it was customary to give anyone being sent back who was sick, a three-day supply of their medication; In a later conversation with the ranch pharmacist, MADHUNAD, AVALOS learned that ALLEN had overdosed once already at the ranch, and, because of this, MADHUNAD had not given him the three-day supply of medication. AVALOS advised that this period of October and November, 1984, when the Share-A-Home Program was happening, it was a very volatile time at the ranch. She stated that during this time period, PARAMBOHDI, the laboratory technician at RMC who was a good friend of hers, was asked by PUJA if he could culture Salmonella. AVALOS stated that PARAMBOHDI informed PUJA that this would be very dangerous, but she (PUJA) informed him that she wanted to develop cultures of both Salmonella and Typhus. AVA advised that the main emphasis of SHEELA and her group was winning the election in The Dalles. They generally considered people from Wasco County, and in par- ticular The Dalles, as very backward and stupid. She stated that PUJA had a large_freeze dryer with tubes and other equipment and an incubator. She described the incubator as being green in color and stated that it was about the size of a small apartment~type refrigerator. When asked, she advised that JAGRUDI and SAMADHI may have been involved in the placing of Salmonella culture, but she does not recall or know specifically what part they played in the distribution AVALOS advised that all of the people at the ranch were told, during this time period, not to eat any meals outside of the ranch, and she stated later this was expanded to include anywhere in Oregon. AVALOS advised that based on meetings and conversa~ tions, the following individuals had direct knowledge of the poisoning attempts: SHEELA PUJA JULIAN VIDYA BODHI YOGINI SU KRISHNA DEVA (known as K.D.) SAVITA AVALOS advised that PUJA was doing numerous things with experimenation of drugs, and she (AVALOS) was not aware of all of them. AVALOS was specifically asked about possible Salmonella poisonings in Cottage Grove, Oregon, and at the Marriott Hotel in Portland. She advised that she did not know about those, but that based on the orders to in- dividuals at the ranch not to eat at any restaurants in Oregon, outside the ranch, she would not be surprised if other possible poisonings did occur. She believed she had observed Salmonella culture in the incubator and stated that it was in Petrie Dishes. She advised that the lab was later moved_from the Chinese laundry and put into an A frame at Alan Watts. AVA indicated that she had only a limited amount of knowledge concerning the.poisoning of the water system in The Dalles. AVA stated this would have occurred around the same time as the Salmonella poisonings. Two days after SHEELA left for Europe, SAVITA told AVALOS to go to the air- port in Portland, pick up a specified car (believed to be a blue Buick), and wash it clean inside and out. AVALOS under-_ stood this to mean to eliminate any fingerprints that might be present. AVALOS was then instructed to park the'vehicle in downtown Portland (in a parking lot across from Director's). AVALOS complied with this with the aid of BOHDI and left the keys in the vehicle. It is belief that the vehicle was used by ANUGITEN and JULIAN when they poured something into the water tanks of The Dalles. AVALOS does not know what was put into the water but recalls PUJA contacting DEBAL (Resource Manager at the ranch) and telling her to bring some raw sewage to her. AVALOS also speculates that rats may have been put into the tanks because of empty cages at the "Chinese' lab." AVALOS also recalls that there was something mentioned about ANUGITEN and JULIAN possibly losing a flashlight when they poured whatever they poured in The Dalles water tanks. AVALOS became aware that The Dalles water tanks were poisoned while in SHEELA's room during a conversation (before the event) between SHEELA, JULIAN, ANUGITEN, and possibly K.D. AVALOS commented that K.D. was in and out of the room and was some~ times forced to be involved in the conversations by SHEELA. There was a comment made by SHEELA that she wanted to be in Europe when the poisoning of The Dalles water tanks occurred. AVALOS recalls JULIAN asking SHEELA if other people could help, and SHEELA telling him that the plan was to stay as it was and not to ask again., AVALOS recalled SAVITA saying she had waited all night for ANUGITBN and JULIAN to call. AVALOS stated there was a general consensus of opinion after this particular opera- tion that JULIAN was not to be taken on any further operations because he "freaks out." AVALOS stated that she had direct knowledge and involvement in the poisoning of Wasco County Judge WILLIAM HULSE. AVALOS recalls this incident occurring during the Share-A-Home Program. AVALOS received a telephone call from PD 250-3 cammuammn of Fnaoz ol AVA KAY AVALOS ,_page PUJA instructing her to come to Jesus Grove. AVALOS met with SHEELA in PUJA's room. SHEELA advised that Judge HULSE was coming to the ranch with a couple of other county commissioners. AVALOS commented that HULSE was known to be 'an official of the Wasco County government that was not friendly towards the ranch. SHEELA instructed AVALOS to go to Antelope where HULSE was either eating or to be eating and see if she could put something in his food. SHEELA described HULSE to AVALOS and also described Commissioner VERGIL ELLET. SHEELA told AVALOS to be sure and not put anything into ELLET's food because he was perceived to be a friend. AVALOS stated the intent of putting something into HULSE's food was to make him sick enough to no longer be concerned with his business at the ranch and leave. AVALOS was given a vial similar to the one involved in the Salmonella poisonings in The Dalles by PUJA. AVALOS commented that PUJA was experimenting in Hepatitis cultures at the time. AVALOS did not know what was in the vial but stated it had the same "murky water" (light yellow/brown in color) and had the same foul odor as the Salmonella vials she had used in The Dalles. AVALOS went to the Zorba the Buddha Restaurant in Antelope and stated that it was easy to identify HULSE from the description given by SHEELA. AVALOS walked behind the counter, and as she did so, was asked by HULSE for a glass of water. AVALOS saw this as an oppor~ tunity to put the contents of PUJA's vial into HULSE's water. AVALOS recalls being concerned that the murky color and odor of the fial contents might alert HULSE to the contamination. She poured a couple of drops into HULSE's water and felt that the odor and color might readily be recognized by HULSE. She poured some of the water out and added additional clear water. AVALOS then gave the water glass to HULSE. AVALOS commented that HULSE suspected nothing and drank the water. AVALOS stated a short time after this, HULSE and the others left for the ranch. AVALOS indicated there were three men, HULSE, VERGIL (ELLET), and one other (MATTHEWS). Later in the day, AVALOS heard that someone had flattened HULSE's tire at the ranch. AVALOS did not know who caused HULSE's tire to be flattened but speculated that SU had something to do with it because she was in charge of the garage. AVALOS stated that while changing the tire (It was a hot day.), PUJA offered water to HULSE which she had contaminated- AVALOS commented she had knowledge of this because of a converSa~ tion with PUJA. AVALOS stated ISABEL was not involved in anything. ISABEL was kept in the dark as to the activities of SHEELA's inner-(QW security people. AVALOS later read in the newspaper that HULSE thought someone at RMC had poisoned him. AVALOS commented that HULSE did not get sick until after leaving the ranch. AVALOS expressed knowledge of the abuse of SHEELA and VIDYA. In November of 1984, AVA went to VIDYA to complain about people at RMC not being able to get along with PUJA. AVALOS was told by VIDYA that she and the others would have to work with PUJA. AVALOS commented that VIDYA always backed PUJA. A short time later, AVALOS wanted to see SHEELA about the problems with PUJA at RMC. AVALOS was given a ride to Jesus Grove by PUJA. PUJA was aware that AVALOS was going to SHEELA and was about to complain about her (PUJA). PUJA drove very slow and tried to talk AVALOS out of seeing SHEELA. AVALOS did Contact SHEELA, and SHEELA backed PUJA in the same manner in which VIDYA had. AVALOS was told that she and the others would have to get along with PUJA. SHEELA had advised AVALOS that she did not know anything about medicine and should not question PUJA's knowledge AVALOS then told SHEELA it was not the medicine that she was concerned about, but the poor record keeping, and that the system in general was being ineffectively operated. In December of 1984, AVALOS again contacted VIDYA to tell her of the continuing problems with PUJA at RMC. Again VIDYA backed PUJA and told AVALOS that PUJA was the best doctor they had at the ranch. AVALOS pointed out to investigators that PUJA was not a doctor but just a nurse. AVALOS commented that PUJA was SHEELA's private nurse, and that PUJA kept SHEELA supplied with Valium, Percodan, Demarol, and even Morphine. AVALOS stated SHEELA had overdosed on a couple of occasions, and almost stopped breathing. GATHA was called to care for SHEELA on those occasions because of her knowledge of anethesiology and that PUJA also kept VIDYA supplied with large quantities of Valium and Percodan. mev PD 250-3 Conlinualion of of_l'i7_'1LKAY AVALGS On i Page When PUJA would be absent from the commune, other doctors would occasionally care for VIDYA and SHEELA and would become very upset with the amounts and mixtures of drugs being prescribed to them. Doctor INDIVAR refused to even treat VIDYA due to the types and amounts of drugs prescribed by PUJA to VIDYA. Sometime shortly after her last contact with VIDYA, AVA was told in passing (at the mall of the ranch) that she was being transferred to the RNSIC offices, and that she was being re- placed by MA ANAND DURGA. AVA was surprised to find that she was Being transferred rather than PUJA since it was PUJA that was causing so many problems at RMC. AVA stated that DURGA was a nurse and was very competent and easy to get along with. AVA then became a Financial Administrator and Assistant to MA SAT PRABODHI, who was the Treasurer of RNSIC. Prior to taking her new post, AVA got sick and was treated by PUJA. PUJA's diagnosis placed AVA in isolation for over two weeks. AVA did not assume her new post of Financial Administrator until January, 1985. The financial aspects of RNSIC were managed by PRABODHI and many other corporations received their financial advice from MA PREM SAVITS. There was an ongoing personal conflict between PRABODHI and SAVITA. AVA stated to investigators that she had direct knowledge and involvement in the arson of Wasco County Planning Commissioner DAN DUROW's office in The Dalles. AVA stated that SAVITA had asked AVA if she would like to assist ANURAG in setting up an apartment in Portland, shortly before the burning of DUROW's office. SAVITA made reference to SAMADHI and JAGRUTI having the need to do commune business in non-Sannyas clothes without being questioned about what they were doing. ANURAG rented the apartment in Portland in the name of ANTHONY BURKHARDT. The address of the apartment was: The May Apartments 1416 S.W. Taylor, Apartment 406 Portland, Oregon AVALOS stated a telephone calling card was used by ANURAG, and that she recalls the number being (503) 226-2343-2391>> ANURAG and another commune member named SWAMI DEVA ALLEN were the people who purchased vehicles for secret operations away from the ranch. SAVITA ad~ vised AVA of the names of persons and their jobs that were utilized in supporting and setting up secret operations. This was done so that AVA could take SAVITA's place in her absence. During the Share~A~Home Program, September/October/ November, l984, AVALOS met with SHEELA, PUJA, JULIAN, and possibly K.D. SHEELA talked about harassing DUROW and asked the others present if they could think of a way to destroy DUROW's office. One suggestion was to put termites in the building. A short time after this meeting, AVALOS was called by VIDYA for a second meeting. SHEBLA, VIDYA, SU, and PUJA were all present at that meeting. AVALOS was told to go to DUROW's office and harass him over the situation about the medical and hospital permits. AVALOS and another commune member by the name of SWAMI WADUD went to DUROW's office. AVALOS explained that DUROW is vocally anti-Rajneesh and gets extremely mad at the sight of a Sannyassin. AVALOS stated that WADUD and DUROW engaged in a very heated argument. Months later, AVALOS was at the restaurant at the ranch when SHEELA, SAVITA, and several others came up to her. The group was holding a conversation, and they overheard SHEELA ask if it was a good time to go. Someone in the group commented that it was. SHEELA then asked AVALOS if she was up for an adventure._ AVALOS _indicated that she was, and SHEELA told her to come to Jesus Grove. AVALOS went to SAVITA's room, and present in the room were SHEELA, YOGINI, ANUGITEN, SAVITA, and JAYANADA (JAYANADA may have been in and out of the room). AVALOS observed a book of plans that included photographs of DUROW's office and floor plans which AVA recalls being on bed. AVALOS advised that_the plan was SHEBLA's, and that SHEELA, SAVITA, and possibly SU had been working on it for some time. This was the first time AVALOS was aware of a serious plan to actually destroy DUROW's office. A discussion was held among those present concerning the plan to destroy DUROW's office. Ideas were being bounced off SAVITA. At some point in the discussion, AVA was advised by SAVITA that she was going to be driving YOGINI and ANUGITEN to The Dalles. AVA indicated the plan developed was quite complicated and, with but a few deviations, was carried out as planned. This meeting occurred one or two days prior to the arson of DUROW's office. On the way, AVALOS stated they stopped in Gresham, and she purchased two quart cans of "Wizzard" lighter fluid (the type to light barbecues) which was to be used in setting fire to DUROW's office in The Dalles. AVALOS believed that JAYANADA went into the store with her, but he was not present when she purchased the lighter fluid. During the day, AVALOS and ANURAG cleaned the apartment and arranged furniture. That evening, ANUGITEN and YOGINI arrived, and ANURAG left. ANUGITEN was experimenting with the candles to be used as part of a device to set off a fire in DUROW's office. AVALOS commented that ANUGITEN had out out squares of cardboard with X's out out in the middle through which the candles were placed. At one point during the evening, the lights went out in the apartment, and AVALOS recalls ANUGITEN commenting that it did not matter that the lights were out, and that it was good practice for him to experiment in the dark because it was those conditions he would be working in at DUROW's office. AVA recalls that ANUGITEN had a backpack, lighters, cardboard, candles, and a flashlight. Sometime prior to midnight, JAYANADA dropped AVALOS, ANUGITEN, and YOGINI off at the Portland International Airport. At the airport, AVALOS, ANUGITEN, and YOGINI attempted to locate the vehicle purchased by ANURAG in the airport parking lot. They did finally locate the vehicle but found it was in "ridiculous condition." AVALOS noted that the vehicle had a flat tire. AVALOS stated they had knowledge of a second car which had been purchased by ALLEN and used on another mission which was also parked at the airport (AVALOS stated the vehicle had been used by YOGINI to surveill Oregon Attorney General DAVE j{ FROHNMEYER's residence. The clothes worn by YOGINI and ANUQITEN were dark in color (AVALOS was unaware of any hats worn by the pair.), and they were wearing gloves. During the trip back to Portland, there was little discussion in the vehicle about what was done. AVALOS commented that ANUGITEN is a very discreet, secretive person. JAYANADA was at the apartment when they arrived. There was comment made th?@Mthey should call SAVITA and advise her of the status of their mission. This was to be done by making the call to SAVITA, letting it ring once, and then hanging up. It was understood that this would mean they were all right (This call was not made until AVALOS, ANUGITEN, YOGINI, and ALLEN were en route to San Francisco.) JAYANADA thought at the time that they were referring to another commune member by the name of SAVITA. It was obvious to AVALOS that JAYANADA was distrubed and incapable of helping in the plan. AVALOS stated that the original plan was to take the car back to the airport and leave it. Because they used a different car, the plan had changed. AVALOS, ANUGITEN, and YOGINI then drove to a phone booth near the Rajneesh Hotel in Portland and called ALLEN (It was part of the plan that ALLEN would be waiting for a phone call from them.), When ALLEN came to the phone, AVALOS simply said and hung up. ALLEN then came out of the hotel and met AVALOS, ANUGITEN, and YOGINI on 12th Avenue. From Portland, they drove to San Francisco where they stayed at the Colombus Inn in North Beach. AVALOS stated that they spent approximately two days at the inn. She advised that ANUGITEN registered in his real name, RICHARD KEVIN LANGFORD, and that she >commune member that had supposedly loaned SHEELA a large sum of money. SHEELA refused to pay the money back to BYRON, and BYRON filed a civil suit in Federal court. SHEELA fought the civil suit saying that the money was a gift and not a loan. Just prior to SHEELA leaving for the BYRON trial in Portland, AVALOS StOpped by SHEELA's room to ask'her some questions about unrelated matters. SHEELA started a conversation about BYRON and in- vited AVALOS to come along. AVALOS accepted the invitation and went to the ranch airport with SHEELA. Sometime during this Fm/1 PD 250-3 K, Conlinualion of ol On Page contact, SHEELA instructed AVALOS, ANUGITEN, and YOGINI to follow BYRON at the trial and look for an opportunity to "do BYRON in." AVALOS clarified this comment for investigators even further by indicating the intent was to look for an oppor~ tunity to kill BYRON. AVALOS stated this is the first time there had ever been any instructions to kill someone. In the past, it was simply to make them sick. SHEELA instructed them to Contact PUJA, and PUJA would give them what they needed to "do BYRON in." PUJA had been experimenting with high potency Potassium poisons and Adrenaline. PUJA gave YOGINI a kit (small zippered travel bag) containing small syringes, Haldol in eye~dropper bottles, and pills separated by dividers. PUJA described what these drugs were, how they were to be used, and what they were to be used for. She also discussed the effects of each of them with AVALOS, YOGINI, and ANUGITEN. AVALOS stated on May 21 and 22 (1985), during the BYRON trial, ANUBHAVO used his credit card to rent rooms at the Marriott Hotel for ANUGITEN and AVALOS. The reason for them staying at the Marriott Hotel is that BYRON was also staying there during the trial. At one point, AVALOS stated she was in the elevator with BYRON and even complimented BYRON on her shoes. Attempts were made to locate BYRON's room, but the hotel would not give out that information. YOGINI tried to obtain employment in the kitchen due to her background in nutrition. While in the kitchen area, she observed a security room containing security monitors. She observed ANUGITBN on one of the monitors, and one of the security personnel following him. ANUGITEN normally has long, red hair and a beard, but on this occasion (because he could easily be recognized), he used a wig to disguise himself. AVALOS, ANUGITEN, and YOGINI were extremely upset and paranoid about the elaborate security precautions present at the Marriott Hotel. AVALOS called VIDYA and told her that the situation at the hotel did not feel right. She pointed out to VIDYA that there was a great deal of security, and that ANUGITEN had become very serious. AVALOS stated that they finally calmed down, and the three of them checked out of the hotel and went to the Rajneesh Hotel for the remainder of the BYRON trial. By the time AVALOS, YOGINI, and ANUGITEN got back to the Rajneesh Hotel, BYRON had won the trial, and SHEELA was very depressed. AVALOS, YOGINI, and ANUGITEN returned to the Marriott Hotel once again to see if they kill BYRON. AVALOS used the term "bumping her off" to describe the intent of the trio in going back to the hotel, AVALOS and the others had dinner at a table next to BYRON and her party. AVALOS commented 25 PD 250-3 AVALOS ,On 10/7-21/85 Pwe 26 that there was no opportunity to poison BYRON due to the number of people around her and those coming up to congratulate her on the trial. AVALOS stated even LES ZAITZ of "The Oregonian" was among those congratulating her. AVALOS commented that during the trial, the judge spoke to Rajneesh attorney SWAMI SUBHAN. AVALOS and the others returned to the ranch with the feeling that the Rajneesh could never get a fair trial in Oregon. It seemed clear that drastic measures were needed in order to survive, and AVALOS and YOGINI expressed that to SHEELA in the hotel. AVALOS advised that after everyone returned to the ranch, it was apparent that SHEELA had gotten very serious after the HELEN BYRON trial. She stated that a series of meetings were held, and the tenure of the meeting was that "This is it." SHEELA advised all of those present that morals did not work anymore, and anyone who had morals should not attend the meetings that she would be having. She told them that they had to drop any morality that they might have because of the situation which occurred. AVALOS advised that SHEELA was using rhetoric in the meetings, and that she would describe the meetings as very intense. She advised that not everyone in attendance at the meeting went along with SHEELA. She stated that PATIPADA was one who said that she could not kill people and was very upset at SHEELA's remarks. AVALOS advised that during one of these meetings, SHEELA again made the statement about having to chose between one enlightened master and one thousand unenlightened, then the master must be chosen. SHEELA indicated that if necessary, the one thousand people would have to be killed. AVALOS further advised that during these meetings held up AVALOS, YOGINI, and ANUGITEN as examples of those who had been doing good work, people who were "strong." AVALOS advised that those in attendance all agreed that they would be doing it on their own, and they would not be forced into doing anything. SHEELA informed them that BHAGWAN was not to know what was going on, and that if BHAGWAN were to ask them about anything that would occur,'they would have to lie to BHAGWAN. She stated that in one of the meetings, SHEELA quoted BHAGWAN as saying that HITLER was a good person, and that it was necessary to get SHEELA's people strong to that point. AVALOS advised that others in the meetings also disagreed with the way things were going, and this included PADMA, JAYANADA, and BODHI. She advised that VIDYA, who is BODHI's girl- friend, became very upset at this and really started to de- teriorate at that time and continued to deteriorate until her departure from the ranch in mid-September, 1985. AVALOS advised that KRISHNA DEVA also objected, but he could not be sent away so SHEELA kept him in line by embarrassing and humiliting him in the meetings. This also happened to PADMA, who was logically abused by SHEELA regularly. SHEELA advised the group that in order for the commune to survive, certain people would have to be killed. She wanted them to devote full time_to the hit team and told them she would take care of them in whatever way they needed. She stated that she would provide money, airline tickets, and arrangements in the event they had to leave the country for any other center to take care of them. She told this group that they should always be ready to travel and always be packed and have their passports ready. AVALOS advised that SHEELA was always playing one person against another to get them involved in the operations. AVALOS advised that she had once been assigned to monitor a speech given by Oregon Attorney General DAVE FROHNMEYER, and she recalled that this was a speech to educators, She was assigned specifically to determine if he had any security with him when he travelled, and she stated that during this speech, she noted a number of persons around him but no one she could identify as a "bodyguard," After FROHNMEYER had completed his speech, AVALOS followed him and observed him to enter a blue van, possibly a Volks- wagen. She noted the license number of the vehicle and made a written record of it. AVA knew of no serious plans to harm It was shortly after these meetings that SHEELA decided the group would have to obtain guns and obtain them under false identification for the assassinations they were planning. SHANTI BHADRA was very devoted to SHEELA, and SHANTI BHADRA would do anything that SHEELA wanted her to do. She stated also that SHANTI BHADRA was a very good shot with a handgun. AVALOS advised that SHEELA instructed SHANTI BHADRA to go with RIKTA and obtain the guns. AVALOS stated that RIKTA had recently gotten involved in the group, and her first involvement was putting something in food which was being provided to JOHN and HASYA. AVALOS stated that RIKTA was selected for this assignment since she was originally from Texas, and they thought Texas would be a place to obtain guns. AVALOS advised that she later learned that RIKTA and SHANTI BHADRA travelled to Chicago with SHEELA and were used in Chicago to obtain information regarding SHEELA's brother, BIPPIN. AVALOS stated that BIPPIN owns a_trucking company in Chicago, and she believed him to be involved with the Chicago mafia. AVALOS i PD 250-3 I, KAY AVALOS _On 10/7~2l/35 Pug advised that SHEBLA was concerned that BIPPIN was going to draw her into some of his tax problems, and she used SHANTI BHADRA and RIKTA to go into BIPPIN's house when he was not home, and to go through some papers that he kept there. AVALOS advised that she was also aware that SHEELA went on to New York for a television show, and she believes that SHANTI BHADRA and RIKTA went to New York to obtain false identification. AVALOS provided, on October 7, 1985, a New York State Identification Card which displayed a photograph of SHANTI BHADRA, but it was in the name of CINDY M. LINDQUIST, 83 Barrow Street, Number lK, New York, New Hork. At the time AVALOS provided the identification card, she stated she be~ lieved this was used in some way in the purchase of>>the hand- guns. She believed that after they obtained the false identi- fication in New York, they travelled to Texas, possibly Amarillo, Texas, and were able to obtain five handguns which were referred to,as "five easy pieces." She believed this would have been in early June of 1985. AVALOS advised that the guns were stored in an A-frame at Alan Watts when they first arrived at the ranch. AVALOS advised that she later heard that RIKTA had flown back to the ranch, but SHANTI BHADRA had taken the bus in order that the guns would not be detected. AVALOS also advised that ANUGITBN had been given the assignment to make silencers for the guns, but to her know~ ledge he had failed. She stated that SHANTI BHADRA and ANUGITEN had actually test-fired through one of the silencers, but it did not work. SHEELA had informed the group not to shoot the guns at the ranch, but she was aware that they had actually done some target practice with the guns on the ranch (using the silencers). AVALOS stated they started attempting to find silencers through other sources, and that SU had given her, AVALOS, a catalog of a place to buy silencers in Idaho. AVALOS advised that she was not aware of any silencers which had been obtained for the handguns. She stated that she had observed the handguns which had been purchased, and she des- cribed them as all revolvers, one being small, one having a very long barrel, and three others being normal sized re- volvers with wooden handles. AVALOS advised that she knew that SHANTI BHADRA and ANUGITEN had taken the revolvers out, and that SHANTI BHADRA had actually been the one who test- fired the revolvers because she was the best shot. AVALOS advised that prior to the HELEN BYRON trial, ANUGITEN had been assigned by SHEELA or VIDYA to ob- tain materials to make bombs. She stated she later heard that they had found a place in the dingy part of Los Angeles where they were able to buy everything that they had needed. She stated that they packed the plane almost full of materials and had to separate some of the materials because if they had been packed together, they would be very volatile. She stated that they flew the materials to the ranch first and placed them in the lab at the Chinese Laundry, but ANUGITEN did not like it there, so it was moved to Alan Watts (possibly F13 or Fl4). She stated that ANUGITEN had set up in one side of the A~frame at Alan Watts, and PUJA used the other side. AVALOS advised that she possessed a key to this but she can never recall going into the A-frame after She stated she was aware that containers, and other medical to the A-frame at Alan Watts. AVALOS advised that JULIAN had been re- moved from the Edison Temple, and that GHAVANI had taken over as Coordinator of Edison Temple. She stated that any purchase orders signed by JULIAN and her (AVA) would probably be used for illegal activities, and any signed by GHAVANI and would probably be for legitimate Edison Temple functions. AVALOS advised investigators that she had personal knowledge and involvement in a conspiracy to murder a resident of The Dalles by the name of ED COMINI. AVALOS advised that COMINI owned a liquor store in The Dalles and was a City Councilman. COMINI was also an outspoken critic of the Rajneesh and a fundamentalist Christian. Due to this situation, AVALOS, YOGINI, and PUJA left the hospital and made no further attempts at killing COMINI. AVALOS commented that when they prepared to leave the hospital, they found the vehicle (the green Maverick) had a dead battery. AVALOS advised investigators that she had personal knowledge and involvement in a conspiracy to murder VIVEK on or about June 12, 1985. AVALOS stated that SHEELA and VIVEK became enemies early on in the establishment of the Rajneesh commune in Poona, India. VIVEK is BHAGWAN's caretaker. According to AVALOS, SHEELA was jealous of V1VEK's closeness to BHAGWAN and the influence which she exerted over him. AVALOS stated that SHEELA convinced her followers that VIVEK was con- spiring with DEVARAJ to kill BHAGWAN. PUJA did comment that Potassium would cause a great deal of pain and discomfort whereas Adrenaline would not. The plan was formulated to kill VIVEK that night in her room at Lao Tzu. To accomplish this assassination, it was necessary to rearrange the security guard schedule for Lao Tzu. VIDYA and SU rearranged that schedule so that persons assigned to kill VIVEK could get to Lao Tzu. AVALOS stated there were two guard posts manned by two security people in each. VIDYA assigned conspirators to those posts which AVALOS believes tO have been PADIPATA, SAVITA, SHANTI BHADRA, and ANUBHAVO. AVALOS, JULIAN, and SU were assigned the task of killing VIVEK by SHEELA. AVALOS stated that sometime between 11:00 p.m. and 1:00 a.m. (on the same day the plan was formu- lated), it was decided to make an attempt on VIVEK's life. PUJA gave the Ether/Catomine to SU and a syringe containing the poison substance to AVALOS. JULIAN carried a Motorola handset to maintain communications with the guard posts. His assignment was to go along and keep his eyes open. A master key had been obtained from DOLMA (Coordinator of the Commune Construction Company/Chuangtzu) for Lao Tzu. According to AVALOS, DOLMA was probably unaware of du2plot1x>kiLlVIVEK,and the request for the key was not unusual. AVALOS stated that she, SU, and JULIAN drove to Lao Tzu and walked up to the porch where the door to VIVEK's room was located. In a grove of trees just prior to reaching the porch, the Ether was poured into a rag which was contained in a rubber anesthesiologist's mask. AVALOS and SU then went to the door and attempted to open it with a key. According to AVALOS, the key did not work, and they could not get the door open. Because of this, they abhorted their plan and returned to Jesus Grove. AVALOS commented that because they were exposed to the odor of the Ether/Catomine, both she and SU became ill. They`contacted SHEELA at Jesus Grove, and SHEELA became angry at their failure to kill VIVEK. She questioned their dedication and added that if BHAGWAN was killed by DEVARAJ or VIVEK, it would be their fault. The day following the attempt on VIVEK's life, a similar attempt was made on the life of DEVARAJ. AVALOS advised that she had personal knowledge and involvement in this attempt on DEVARAJ's life. AVALOS commented that the motivation for killing DEVARAJ was a carry~over from the same reasons VIVEK had been targeted. In addition to this, SHBELA expressed a fear that DEVARAJ would "sink the ship" (referring to the commune) with regard to a Federal Grand Jury convened by the Department of Immigration. SHEELA implicated DEVARAJ as being responsible for unaccounted drugs at Lao Tzu and widespread drug use at that location. On or about June 12, 1985, DEVARAJ's coffee was contaminated with a substance while he was at Jesus Grove. DEVARAJ was at Jesus Grove being interviewed by a tribunal in preparation for his testimony at the grand jury. AVALOS commented that the contamination of DEVARAJ's coffee was not an isolated thing, but occurred whenever there was an opportunity. Within days of DEVARAJ drinking the coffee at Jesus Grove, he became obviously sick, and Doctor SHUNYO advised him that he needed to go to bed. DEVARAJ was then sent to Koran Grove and placed in isolation. SAGUN, one of the conspirators, was also sick at the time and was purposely put in a room next to DEVARAJ to monitor him for SHEELA. AVALOS explained that SHEELA had no one to take care of DEVARAJ due to 34 I PUJA being removed (for disciplinary reasons) as Head of AVALOS contacted DURGA (PUJA's replacement as Head of RMC) and QQUWVY advised her of DEVARAJ's attempt to kill BHAGWAN and SHEELA's plan for DEVARAG. AVALOS indicated they were a little more careful with the Ether/ Catomine and poured it onto a rag which was contained in a plastic bag to prevent fhe fumes from effecting the person carrying it. Prior to the actual attempt on DEVARAJ's life, AVALOS and one or two others went to Koran Grove to check things out. AVALOS commented that they did not observe DEVARAJ and returned to Jesus Grove. Approximately one hour later, the persons assigned by SHEELA to kill DEVARAJ went to Koran Grove. Their expectation was that DEVARAJ would be sleeping. PUJA had indicated to them that she had removed the contents of Benedryl capsules which DEVARAJ was supposed to be getting and replaced the contents with a strong sedative. It was expected that DEVARAJ would be sedate when the attempt to kill him was made. ANUBHAVO stayed outside while the others entered Koran Grove. AVALOS indicated K.D. made a great deal of noise slamming doors and opening closets. AVALOS stated JULIAN opened DEVARAJ's door and looked in while the others waited out of sight in the hallway. The plan was for . JULIAN to enter the room and place the rag containing Ether/ Catomine over DEVARAJ's face to immobilize him. AVALOS and SHANTI BHADRA were then to enter the room and administer the lethal injections with the syringes they had provided by PUJA. DEVARAJ was awake, however, and JULIAN left the door. As a result of this unexpected circumstance (DEVARAJ being awake), the attempt to kill him was abhorted. AVALOS stated that she and the others then left Koran Grove and returned_to Jesus Grove. AVALOS advised that she saw VIVEK in SHEELA's arms with SHEELA trying to comfort her. AVALOS stated that someone (believed to be PUJA) had put something into VIVEK's drink to make heart beat faster. SHEELA appeared to be very concerned and assisted in getting VIVEK back to Lao Tzu. Also, toward the end of June, 1985, DEVARAJ had occasion to be at the ranch pharmacy reviewing perscription records. While at the pharmacy, DEVARAJ was contacted by DURGA and RIKTA and invited to have coffee at the mall restaurant. AVALOS stated that either DURGA or RIKTA pui something in DEVARAJ's coffee. AVALOS used this as an example of the continuing contamination of food and beverage of DEVARAJ. Due to this constant con~ tamination of his food, DEVARAJ exhibited physical signs and irrational actions. AVALOS advised that during the period of_mid~June, 1985, the decision was made that although DEVARAJ and VIVEK would be poisoned, the guns which had been purchased would be used against CHARLES TURNER, the United States Attorney for the District of Oregon.~ The motive given for his assassination was that it was felt the Immigration and Naturalization Service (INS) grand jury would be slowed down considerably if something were to happen to TURNER. AVALOS advised that the test~firing of the weapons and preparation of the AVALOS she was approached that SHEELA wanted get information on both surprised and the attempt to obtain a Silencer was all in assassination of TURNER. advised that in approximately mid~June, 1985, by SAMADHI, and SAMADHI informed her (AVALOS) AVALOS to come to Portland with SAMADHI to CHARLES TURNER. AVALOS advised that she was hurt that SHEELA had not told her directly, and that she (AVALOS) went to SHEELA and asked her about this assignment. SHEELA informed AVALOS that SAMADHI knows the whole story, and that AVALOS should go with SAMADHI and handle the assignment. AVALOS advised that she felt like she was being "gotten rid of" and felt very mad that she had to go to Portland. AVALOS advised that she did come to Portland with SAMADHI and determined that SAMADHI had done a considerable amount of background investigation. She stated that SAMADHI had found out that and that also when TURNER actually lived in Sherwood, Oregon, on a trip to Washington, D. C., she had obtained some information, including the college that TURNER had attended. She stated that SAMADHI had also obtained the uonlinu PD 10 yearbook of that college and had obtained two pictures of TURNER from that yearbook. She recalled that one of these pictures showed two individuals, one standing and one seated. AVALOS advised that she and SAMADHI went to Sherwood, Oregon, and checked at the Voter Registration files and were able to find the name CHARLES TURNER. She stated that the Voter Re- gistration rolls contained his route and box number, but that they had no idea where this might be located. She advised that they went to the information from post office, but they were unable to get the the post office as to exactly where the re- sidence was located. She stated they also went to the Portland Public Library, but they were unable to find any information of value there. She stated that they then decided to drive around Sherwood find the this and same box and look at the different mailboxes in an attempt to address. She stated they spent all afternoon doing eventually did find three mailboxes, one which had the and route number as they had obtained for TURNER. She stated they later went back and located the same three mailboxes and turned right, down a road, at the mailboxes, She mailboxes, they house, and then to TURNER. She stated that this was the 21st Avenue apartment. AVALOS advised that she had indicated to SAMADHI that she relation did not feel that anything would be accomplished in to the INS grand jury by killing TURNER, and that the investigation would continue. SAMADHI relayed to her that she felt the main purpose was to delay the INS investigation and the grand jury investigation. AVALOS advised the following day after they had located TURNER's house, VIDYA arrived in Portland, and she was informed that they had found the TURNER residence. They 37 ,Page asked if VIDYA wished to see the residence, and she informed them she did. AVALOS and SAMADHI took VIDYA and showed her the house and discussed the planning of the assassination plot. AVALOS advised that YOGINI also arrived at the apart~ ment on this particular day, and that she had come to Portland on a communal plane with HASYA. The purpose given for YOGINI flying with HASYA was to attempt to poison her en route to Portland. AVALOS stated that she was made aware that HASYA continued on to Los Angeles, and that YOGINI was unsuccessful in her attempt to poison HASYA. AVALOS advised that AVALOS, SAMADHI, YOGINI, and went to the TURNER residence to come up with a plan to assassinate TURNER. She stated that the plan discussed most prevalently was a plan where they would pretend to have car trouble near TURNER's residence, and when he stopped his car to assist them, he would be shot. Another plan discussed in~ volved the parking lot where he parked his vehicle when he came to work at the Federal Courthouse. AVALOS advised that she later learned that the surveillance had been successful in locating the office where TURNER worked and also where he parked his vehicle. She also heard that it had been determined that he did not use the same door as the general public but used a side door. AVALOS advised that the surveillance on TURNER was done primarily in two vehicles, a green Maverick and a white Toyota . AVALOS advised that during the surveillance, she decided that she wanted to gc back to the ranch, and that YOGINI stayed in Portland with SAMADHI. Later on, SHANTI BHADRA came to stay with SAMADHI, and YOGINI was relieved. AVALOS advised that she did not know if SHANTI BHADRA had any weapons when she was surveilling TURNER. AVALOS advised that she was under the impression that SHANTI BHADRA stayed in Portland until it was time to return to the ranch for the festival. Three days into the festival, SAVITA asked AVALOS if she would like to learn about the corporate structure of the Rajneesh commune. SAVITA took AVALOS aside and began to teach her the intricacies of corporate organization. AVALOS was previously working for PROBHODI (the commune Treasurer), and to work directly for somewhat of a promotion for AVALOS. Just prior to the festival, VIDYA began to "go down the tubes" emotionally due to her boyfriend, BOHDI, being sent to Europe by SHEELA.
