Michael Houston, Springfield, Illinois More Information: Nathan Mihelich, 789-2200 August 8, 2013 nathan.mihelich@cwlp.com CITY FILES MOTION FOR JUDGMENT (Springfield, Ill. - August 8, 2013) Attorneys representing the City of Springfield filed a Motion for Judgment in favor of the Plaintiff in Sangamon County Case Number 2013-MR-341 which is captioned Calvin Christian III v. City of Springfield, and John Does 1-6. The pleading was filed late Thursday afternoon. The motion requests the court enter judgment, in part, for Mr. Christian on Count 1 of the Amended Complaint. Count 1 relates to the destruction of the Internal Affairs file of Deputy Chief Clifford Buscher. The City will pay a $5,000 civil penalty as required by the Illinois Freedom of Information Act. "I properly referred this matter to the Attorney General for investigation," Mayor Houston said. "I await the report and if further action needs to be taken, I will take it." The City of Springfield will continue to litigate counts 2-73 which stem from a separate FOIA request by Mr. Christian where he requested all Internal Affairs files. The City of Springfield asked Mr. Christian to narrow his request because it was unduly burdensome. Instead, he filed suit. http://www.springfield.il.us ###
