May 1, 2011 SUPERSESSION: OPR: OBO EFFECTIVE DATE: 05/01/10 REVIEW MONTH: February Tom Clements Executive Director POLICY It is the policy of the Department of Corrections (DOC) to govern the monetary consideration given an offender upon parole or discharge of his/her sentence. II. PURPOSE The purpose of this administrative regulation (AR) is to provide guidelines for distributing monetary allowances to offenders who are paroling or discharging their sentence. III. DEFINITIONS None. IV. PROCEDURES A. Offenders Eligible for Allowance: The following offenders shall be provided $100.00 upon departure: 1. 2. All those paroled, except under circumstances cited in section IV.B. All offenders discharged at the completion of their maximum sentences, except as cited in section IV.B. B. Offenders Ineligible for Allowance: The following offenders shall not be eligible for an allowance: 1. Any paroled offender who has been returned to the custody of a correctional facility before the completion of his/her parole period and has previously received such sum of money. 2. Any offender released by a court order which vacates the sentence. 3. Any offender released upon the posting of a bond. 4. Any offender released by the court on a suspended sentence. 5. Any offender paroled from a community corrections center or the Intensive Supervision Program. 6. Any offender paroled or discharged to another felony charge. Any offender, who at the time of release or parole has a mandatory savings account exceeding $100.00, due to participation in a Correctional Industries Prison Industry Enhancement (PIE) program. (Eligible offenders with a mandatory PIE savings account balance less than $100.00 will receive an allowance equal to the difference between $100.00 and their PIE savings.) C. Transportation: Public bus transportation shall be available to offenders discharged at the completion of their maximum sentences(s), or offenders paroled, except for those released under section IV.B.5 through IV.B.7 above, if requested, to: 1. An authorized destination within the state of Colorado. 2. The farthest city within Colorado in those cases where the authorized destination is outside the state of Colorado. 3. When available, DOC transport may be used to deliver the offender at the discretion of the administrative head, or designee. D. Any variance to this AR must be approved in accordance with AR 100-01, Administrative Regulation Process. E. Upon release, offenders with a balance of $25 or more in their inmate account will be issued a prepaid release debit card, which will also include the $100 release money, if eligible. The prepaid release debit card may be used to make cash withdrawals at an automated teller machine (ATM), cash withdrawals over the counter with a bank teller, or to make purchases at merchants that accept Visa debit cards. Offenders with balances below $25 will be issued a check. V. RESPONSIBILITY A. The DOC Business Office shall comply with this AR and maintain appropriations for the payment of funds, in accordance with this regulation. B. Administrative heads shall comply with this regulation and may develop local procedures, where necessary. C. The Office of Budget and Business Operations shall review this AR annually and update, as necessary. VI. AUTHORITY A. 17-1-103. Duties of the executive director. B. 17-22.5-202.
