""",,~ i! r .~ U ..~ DOB: xx-xx-1984· United States Citizen United States Code §§1324(a)(I)(A)(ii), 1324(a)(l)(A)(v)(I) Complaint for violation of Title 8 1324(a)(l )(B)(i); 1325; 18 USC §2 COMPLAINANT'S STATEMENT OF FACTS CONSTITUTING THE OFFENSE OR VIOLATION: COUNT 1: On or about October 20,2013, at or near Why, in the District of Arizona, Tammy Leigh Stephens and Jason Miles English, named herein as defendants and conspirators, did knowingly and intentionally combine, conspire, confederate, and agree with each other and other persons, known and unknown, to transport an illegal alien, Marlene Josefina Rodriguez-Fernandez, for profit, and did so for the purpose of private financial gain; in violation of Title 8, United States Code, Sections 1324(a)(1)(A)(ii); 1324(a)(l)(A)(v)(I); and 1324(a)(l)(B)(i). COUNT 2: On or about October 20,2013, at or near Why, in the District of Arizona, Tammy Leigh Stephens and Jason Miles English, did unlawfully aid and abet a certain alien, Marlene Josefina Rodriguez-Fernandez, to elude examination and inspection by Immigration Officers of the United States of America; in violation of Title 8, United States Code, Section 1325 and Title 18, United States Code, Section 2. (MISDEMEANOR) BASIS OF COMPLAINANT'S CHARGE AGAINST THE ACCUSED: On or about October 20, 2013, at or near Why, Arizona, a white Mitsubishi Gallant, driven by Tammy Leigh Stephens with two passengers, Jason Miles English and Marlene Josefina Rodriguez-Fernandez, approached a Border Patrol checkpoint located on State Route 85. When the inspecting agent questioned Marlene Josefina Rodriguez-Fernandez, Tammy Leigh Stephens stated to the agent that Marlene Josefina Rodriguez-Fernandez was a U.S. citizen. At secondary inspection, Marlene Josefina Rodriguez-Fernandez presented a U.S. passport which did not belong to her. Marlene Josefina Rodriguez-Fernandez admitted that she was not a citizen or national of the U.S. and that she did not possess documents to be in the U.S. legally. After Miranda was waived, Jason Miles English stated he agreed to accompany Tammy Leigh Stephens to the border and pick up a friend. The material witness stated that she made arrangements to be smuggled into the U.S. illegally and agreed to pay money for the use of a U.S. passport. She stated that after crossing the international boundary fence she was instructed to travel to a gas station and board a vehicle with a female driver. The witness positively identified Tammy Leigh Stephens and Jason Miles English through photo line-ups. The witness stated that Tammy Leigh Stephens was waiting at the gas station in a vehicle and allowed her to board.
