Unfortunately there is a fairly corrosive atmosphere today in Sixth Circuit and it is fraught with agendas. The dissents are truly insulting to the experienced African American trial lawyer who was hired by the Circuit to impartially investigate the circumstances of the complaint and to the multi-sex panel of judges who unanimously adopted her report. The personal attacks on their fellow judges of the investigating panel are reflective of that environment. I trust the Circuit will provide her report to the press to show what she did, what she concluded and what was adopted. I would like to note that the complainant has never appeared in court before me. The investigator found the complainant was employed by and assisted in the preparation of her complaint and the gathering of the supporting materials by an ex-prisoner, convicted of armed robbery and assault to commit murder, who is obsessed with the owners of the prison where he was incarcerated and, oddly enough, the club at issue. He also gave testimony during the investigation. Regardless I am pleased the Circuit found I was not athwart of the Code of Conduct for United States Judges and needless to say I am looking forward to my retirement from the federal judiciary at the end of the year.
